CC RESOLUTION 3605RESOLUTION NO. 3605 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, CLARIFYING A LAND USE AMBIGUITY WITH REGARD TO SKATEBOARD RAMPS AS A COMPATIBLE ACCESSORY STRUCTURE AND USE IN ZONE R -1 AND INTERPRETING TITLE 20 (ZONING CODE) OF THE EL SEGUNDO MUNICIPAL CODE. WHEREAS, The City Council adopted Ordinance 611 in 1963, establishing Chapter 34 "Zoning Regulations of the City of El Segundo" and has from time to time amended such Ordinance, which is now codified as Title 20 of the El Segundo Municipal Code; and WHEREAS, El Segundo Municipal Code Title 20 (Zoning Code) establishes a precise land use plan for the City of El Segundo to further the public health, safety and general welfare and to provide the economic and social advantages resulting from an orderly planned use of land resources; and WHEREAS, Sections 20.12.020 and 20.16.070 "Limitation of Land Use" states that no land shall be used for any purpose other than uses specifically provided for and permitted within Title 20 (Zoning Code); and WHEREAS, Section 20.50.010 "Clarification of Ambiguity" specifically provides that in the event of ambiguity with regard to interpretation of any aspect of Title 20 (Zoning Code) it is the duty of the Planning Commission to ascertain all pertinent facts and by resolution of record, set forth its findings and interpretations, which interpretation, if approved by the City Council, shall govern; and WHEREAS, Chapter 20.20 Residential- 1 (R -1) Zone permits single family dwellings, one story accessory buildings and structures up to six hundred square feet, publicly owned parks, playgrounds, and recreational areas, but excluding ball parks, bleachers, swimming pools or other types of facilities where racing or contests are conducted or public amusement devices for hire; and WHEREAS, the citizens have become concerned about the operation of skate board ramps as an accessory 90ructure and use in the Residential -1 (R -1) Zone and communicated such concern to members of the Planning ommission and City Council; and WHEREAS, the City Council did ask the Planning Commission to study this issue and determine if skateboard ramps are a compatible accessory structure and use in the R -1 Zone; and WHEREAS, The Planning Commission did investigate and study the issue of skateboard ramps as an compatible accessory structure and use in the R -1 Zone and discussed the matter at their regular meeting of September 21, 1988 on November 10, 1988, and again on February 23, 1989, and WHEREAS, The Planning Commission opened the public hearing on March 23, 1989, and continued the public hearing until April 13, 1989. WHEREAS, through Commission and Council discussion the following facts were brought forth: Skateboard ramps as an accessory structure and use in the R -1 Zone may degrade the quality of the environment, may have impacts which are individually limited but cumulatively significant and may have impacts that will cause substantial adverse effects, either directly or indirectly. WHEREAS, after considering all testimony and documentary evidence regarding the issue of skateboard ramps as a compatible accessory structure and use in the R -1 Zone, the City Council makes the following findings: 1. Skateboard ramps in the R -1 Zone have substantial potential to degrade the quality of life and endanger the �ublic health , safety and welfare. 2. Skateboard ramps in the R -1 Zone have substantial potential to disrupt the tranquility and alter the low density residential character of a neighborhood. 3. Skateboard ramps in the R -1 Zone have substantial potential to infringe on the right of peaceful enjoyment of private property. NOW, THEREFORE, BE IT RESOLVED, that in view of the facts on the record and the above findings, the Planning Commission found that skateboard ramps are an incompatible accessory structure and use in the Residential - 1 (R -1) Zone. BE IT FURTHER RESOLVED that the City Council hereby interpreted Title 20 (Zoning Code) to prohibit skateboard ramps in the Residential -1 (R -1) Zone. The City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of original resolutions of said city; and shall make a minute of the passage and adoption thereof in the records of the proceedings of the meeting at which the same is passed and adopted.
