A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF EL SEGUNDO, CALIFORNIA, RECITING THE FACT
OF THE SPECIAL MUNICIPAL ELECTION HELD IN
SAID CITY OF EL SEGUNDO, ON THE 7TH DAY OF
MARCH 1989;DECLARING THE RESULT THEREOF AND
SUCH MATTERS AS ARE PROVIDED BY LAW.
WHEREAS, a Special Municipal Election was held and conducted
in the City of E1 Segundo, California, on Tuesday, March 7, 1989
as required by law; and
WHEREAS, notice of said election was duly and regularly given
in time, form and manner as provided by law; that voting precincts
were properly established; that election officers were appointed
and that in all respects said election was held and conducted and
the votes cast thereat, received and canvassed and the returns made
and declared in time, form and manner as required by the provisions
of the Elections Code of the State of California for the holding
of elections in cities; and
WHEREAS, pursuant to Resolution No. 3566 adopted, November 21,
• 1988, the City Clerk of said City canvassed the returns of said
election and has certified the results to this City Council , said
results are received, attached and made part hereof as Exhibit "A."
NOW, THEREFORE, THE CITY COUNCIL OF CITY OF EL SEGUNDO,
CALIFORNIA , DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS
FOLLOWS:
SECTION 1. That the whole number of votes cast in the City
except absent voter ballots was 1672.
That the whole number of absent voter ballots cast in the City
was 154 making the total of 1826 votes cast in the City.
SECTION 2. That the measures voted upon at the election are
as follows:
CITY MEASURE E AMENDS EXISTING UTILITY USER TAX
BALLOT MEASURE E
_40 Do you approve an ordinance which amends the existing utility users
tax on certain commercial and industrial users of electric, gas and
water utilities in the City of E1 Segundo to:
1. Increase the tax rate from 2% to 4% and
2. Eliminate an exemption for electrical corporations which
use gas to generate electricity; and
3. Eliminate the "sunset" clause which currently terminates
the tax on July 1, 1991.
CITY MEASURE F IMPOSES ANNUAL EXCISE TAX
BALLOT MEASURE F
Do you approve an ordinance which imposes an annual excise tax on
the use of real property in the City on the following bases:
1. A tax of sixty dollars ($60.00) per unit on all occupied
residential units, except for owners of units who qualify for the
City's Water Life Line rate; and
2. A tax of two hundred dollars ($200.00) on all occupied non -
residential parcels of five thousand (5,000) square feet or less
of floor area; and

3. A tax on all occupied non- residential parcels with over
five thousand (5,000) square feet of floor area calculated by a
formula based upon six and six tenths cents ($0.066) per square
foot of floor area, the total square feet of floor area, and the
ratio of floor area to the lot size of the parcel.
SECTION 3. That the number of votes given at each precinct and
the number of votes given in the City to each measure listed above,
were as listed in Exhibit "A" attached.
SECTION 4. The City Council does declare and determine that:
MEASURE E WAS DEFEATED BY A MAJORITY OF 1047 VOTES.
MEASURE F WAS DEFEATED BY A MAJORITY OF 1608 VOTES.
SECTION 5. The City Clerk shall enter on the records that the
City Council of the City of El Segundo, a statement of the result
of the election showing:

SECTION 6. That the City Clerk shall certify to the passage
and adoption of this resolution; shall enter the same in the book
of original Resolutions of said City; and shall make a minute of

the City Council of said City, in the minutes of the meeting at
which the same is passed and adopted.

I, Ronald L. Hart City Clerk of the City of E1 Segundo,
California, DO HEREBY CERTIFY that the whole number of members of
the City Council of the said City is five; that the foregoing
resolution, being Resolution No. 3586 was duly passed and adopted
by the said City Council, approved and signed by the Mayor of
said City, and attested by the City Clerk of said City, all at a
adjourned regular meeting of the said Council held on the 14th
day of March 1989 and that the same was so passed and adopted by
the following vote:
