CC RESOLUTION 3528RESOLUTION NO. 3528 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, RECITING THE FACT OF THE GENERAL MUNICIPAL ELECTION HELD IN SAID CITY OF EL SEGUNDO, ON THE 12TH DAY OF APRIL 1988; DECLARING THE RESULT THEREOF AND SUCH MATTERS AS ARE PROVIDED BY LAW. WHEREAS, a regular general municipal election was held and conducted in the City of E1 Segundo, California, on Tuesday, April 12, 1988 as required by law; and WHEREAS, notice of said election was duly and regularly given in time, form and manner as provided by law; that voting precincts were properly established; that election officers were appointed and that in all respects said election was held and conducted and the votes cast thereat, received and canvassed and the returns made and declared in time, form and manner as required by the provisions of the Elections Code of the State of California for the holding of elections in cities; and WHEREAS, pursuant to Resolution No. 3506 adopted December 15, 1987, the City Clerk of said City canvassed the returns of said election and has certified the results to this City Council, said results are received , attached and made part hereof as "Exhibit A." NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. That the whole number of votes cast in the City except absent voter ballots was 3,455. That the whole number of absent voter ballots cast in the City was 352 making a total of 3807 votes cast in the City. SECTION 2. That the names of persons voted for at the election for Members of the City Council of the City are as follows: SCOT D. DANNEN NESTOR SYNADINOS GARY R,. SCHULTZ JIM CLUTTER CARL JACOBSON THOMAS JOLLY J.B. WISE SECTION 3. That the names of persons voted for at the election for City Clerk of the City are as follows: RICHARD G. FENNELL RONALD L. HART SECTION 4. That the name of the person voted for at the election for City Treasurer of the City is as follows: LOUISE ECKERSLEY SECTION 5. That the measures voted upon at election are as follows: 49 CITY MEASURE D UTILITY USER TAX Shall the ordinance: which imposes a Utility User Tax of 2% on certain commercial and industrial users of electric, gas and water utilities in the City of El Segundo, 0 be adopted? CITY BALLOT MEASURE C REASONABLE LIMITS ORDINANCE A Reasonable Limits Ordinance is hereby established. Floor Area Ratio's established by Title 20 of the Municipal Code as of February 1, 1987 of two times the parcel area for the C -3 zone and one times the parcel area for the M -11 M -2 and C -3W zones are hereby established by a vote of the people. The Floor Area Ratio for the C -M zone shall be one times the parcel area. Floor Area Ratio limits hereby established shall not be circumvented by development agreements, precise plans, specific plans, zone changes or any other device without a subsequent vote of the electorate. The City Council shall enact any amendments to the General Plan deemed necessary to accomplish this purpose. The effective date of this ordinance shall be February 1, 1987. If any section, part, clause or phrase hereof is for any reason held invalid or unconstitutional, the remaining sections shall not be affected but will remain in full force and effect. SECTION 6. That the number of votes given at each precinct and the number of votes given in the City to each of such persons above named and each measure listed above, were as listed in Exhibit "A" attached. SECTION 7 The City Council does declare and determine that: Scot D. Dannen was elected as Member of the City Council of the City for the full term of four years. Jim Clutter was elected as Member of the City Council of the City for the full term of four years. Carl Jacobson was elected as Member of the City Council of the City for the full term of four years. . Ronald L. Hart was elected as City Clerk of the City for the full term of four years. Louise Eckersley was elected as City Treasurer of the City for the full term of four years. MEASURE D WAS PASSED BY A MAJORITY OF 2237 VOTES. MEASURE C WAS DEFEATED BY A MAJORITY OF 2072 VOTES. SECTION 8. The City Clerk shall enter on the records the City Council of the City, a statement of the result of the election showing: (1) The (2) The (3) The (4) For (5) The each pe: (6) The person, whole number of votes cast in the City; names of persons voted for; measures voted upon; what office each person was voted for; number of votes given at each precinct to -son; and for and against each measure; number of votes given in the City to each and for and against each measure. SECTION 9. That the City Clerk shall immediately make and deliver to each such persons so elected a Certificate of Election signed by the City Clerk and duly authenticated; that the City Clerk shall also administer to each person elected, the go Oath of Office prescribed in the State Constitution of the State of California and shall have them subscribe thereto and file the same in the office of the City Clerk. Whereupon, each and all of said persons so elected shall be inducted into the respective office to which they have been elected. • SECTION 10. That the City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of original Resolutions of said City; and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said City, in the minutes of the meeting at which the same is passed and adopted.
