CC RESOLUTION 34904 RESOLUTION NO. 3490 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DETER- MINING THAT THE PUBLIC NECESSITY, HEALTH, SAFETY, AND WELFARE REQUIRE THE FORMA - TION OF AN UNDERGROUND UTILITY DISTRICT IN THE ALLEYS EAST AND WEST OF MAIN STREET IN BLOCKS 10, 11, 22, 23, 43, 58, 59, 74, AND 75 BOUNDED BY EL SEGUNDO BOULEVARD ON THE SOUTH AND MARIPOSA AVENUE ON THE NORTH AND BLOCK 42 (THE CIVIC CENTER) BOUNDED BY HOLLY AVENUE ON THE NORTH, GRAND AVENUE ON THE SOUTH, STANDARD STREET ON THE EAST, AND MAIN STREET ON THE WEST IN THE CITY OF EL SEGUNDO. WHEREAS, pursuant to Resolution No. 3483 adopted by the City Council on July 21, 1987, a public hearing was called for August 18, 1987, at the hour of 7:00 p.m. in the Council • Chamber in the City Hall, E1 Segundo, California, to ascertain whether the public necessity, health, safety and welfare require the removal of poles, overhead wires and associated overhead structures and the underground installation of wires and facili- ties for supplying electric, communication, cable television or similar or associated service in the alleys east and west of Main Street in Blocks 10, 11, 22, 23, 43, 58, 59, 74, and 75 bounded by E1 Segundo Boulevard on the south and Mariposa Avenue on the north and Block 42 (The Civic Center) bounded by Holly Avenue on the north, Grand Avenue on the south, Standard Street on the east, and Main Street on the west in the City of E1 Segundo; and WHEREAS, notice of such hearing has been given to all affected property owners as shown on the last equalized assessment roll and all utilities concerned, in the manner and time required by law;.and WHEREAS, such hearing has been duly and regularly held, and all interested persons have been given an opportunity to be heard; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES HEREBY RESOLVE, FIND AND DETERMINE AS FOLLOWS: SECTION 1. That the public necessity, health, safety and welfare require the removal of poles, overhead wires and associated structures, and the underground installation of wires and facilities for supplying electric, communication, cable Reso.3490 television or similar or associated service in the alleys east and west of Main Street in Blocks 10, 11, 22, 23, 43, 58, 59, 74, and 75 bounded by E1 Se, Avenue on the north Holly Avenue on the Street on the east, El Segundo and such Underground Utility jundo Boulevard on the south and Mariposa and Block 42 (The Civic Center) bounded by north, Grand Avenue on the south, Standard and Main Street on the west in the City of described area is hereby established as District No. 3. SECTION 2. That the following exceptions in said Underground Utility District No. 3, be, and they are hereby, authorized: • (a) Any municipal facilities or equipment installed under the supervision and to the satisfaction of the City Engineer. (b) Overhead wires (exclusive of supporting structures) crossing any portion of the District within which overhead wires have been prohibited, or connecting to buildings on the perimeter of the District, when such wires originate in an area from which poles, overhead wires and associated structures are not prohibited. (c) Overhead wires attached to the exterior surface is of a building by means of a bracket or other fixture and extending from one location on the building to another location on the same building or to an adjacent building without crossing any public street. (d) Temporary poles, overhead wires and associated structures used or to be used in conjunction with construction projects. SECTION 3. That all poles, overhead wires and associated overhead structures shall be removed and underground installations made in said underground utility district within the following times: J -2- .r Reso. 3490 (a) Underground installation by utility companies and • property owners and reconnections not later than February 1, 1989. (b) Removal of poles, overhead wires and other asso- ciated overhead structures not later than April 1, 1989. SECTION 4. That the City Clerk within ten days after the adoption of this resolution, shall mail a copy of this resolution and a copy of Chapter 14.08 of the "El Segundo Municipal Code" to affected property owners as such are shown on the last equalized assessment roll and to the affected utilities. SECTION 5. That the City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of original Resolutions of said City, and shall make a iminute of the passage and adoption thereof in the records of the proceedings of the City Council of said City, in the minutes of the meeting at which the same is passed and adopted.
