CC RESOLUTION 34510 io RESOLUTION NO. 3451 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, ADOPTING A HELICOPTER LANDING FACILITIES POLICY. WHEREAS, the Planning Commission recommended a Helicopter Landing Facilities Policy by forwarding to the City Council of the City of El Segundo Resolution No. 2152 which is attached hereto and incorporated by reference, and WHEREAS, the City Council of the City of E1 Segundo on August 19, 1986 received testimony, documentation, and information at a properly noticed public hearing. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES RESOLVE AS FOLLOWS: SECTION 1. The City Council after careful consideration of the documentation referred to in Resolution No. 2152, adopts the statement of facts and the statement of findings contained in Planning Commission Resolution No. 2152. SECTION 2. The City Council of the City of E1 Segundo hereby adopts the following Helicopter Landing Facilities Policy: A. NEW HELICOPTER LANDING FACILITIES (1) Emergency, medical, police, fire and other public and private use of helicopter landing facilities with substantial public health and safety benefits shall be permitted within the City. (2) Potential future private helistop users are strongly encouraged to examine the possible use of existing helistops rather than construct new facilities. Firms, businesses or property owners with a current, valid Unclassified Use Permit (UUP) are encouraged to concentrate future needs at that facility rather than establish a new facility. (3) Ground -level helicopter landing facilities are generally discouraged for individual users, but encouraged if they have the potential to result in meeting multi -user needs. (4) Helistops will be considered for approval provided the applicant can demonstrate that the intended use of the proposed facility will not significantly increase community exposure to adverse health (particularly noise), safety, or nuisance impacts; (5) Helicopter landing facility shall be an accessory and incidental use to the primary use. -1- 3387 -R.PL • It 0 (6) Helicopter landing facilities shall not be established within 2500 feet of an existing operating helistop. (7) Regularly scheduled commercial flight operations such as, but not limited to, bank operations and commuter passenger service operations, shall not be permitted, approved or established at any new or existing helicopter landing facility. (8) New helistop facilities shall not be established west of Sepulveda Boulevard; with the possible exception of facilities located on the Chevron Refinery site and public health and safety uses. B. EXISTING AND FUTURE HELICOPTER LANDING FACILITIES (1) Flight operations of all helistops shall take place only during the hours of 7:00 a.m. to 7:00 p.m., Monday through Friday, except that operation may be permitted until 9:00 p.m., if necessary to accommodate a business emergency. If an operation is conducted between 7:00 p.m. and 9:00 p.m., Monday through Friday, for a business emergency, the permittee shall notify the Planning Department on the next business day of the circumstances justifying that operation. Flight operations will not be allowed on New Year's Day, Memorial Day, Labor Day, Thanksgiving or Christmas Day. (2) The intermittent use of helicopters for maintenance, construction, moving of equipment and other spot usage on Saturdays and Sundays and outside of specified operating hours may be allowed subject to prior reasonable notification and approval by the City. (3) Expansion of existing facilities, or activities at existing facilities shall be permitted only with approval of the City. Reapportionment of existing flight levels are permitted at helicopter landing facilities located east of Sepulveda Boulevard. Reapportionment of existing flight levels for helicopter landing facilities located west of Sepulveda Boulevard shall be permitted only with the approval of the City. (4) Each helistop facility shall provide the City with the name and phone number of a contact person available 24 hours per day should any questions arise concerning operation of the facility; and a current list of helicopters using the facility, their corresponding identification numbers, and the noise and performance specifications of said aircraft. -2- 3387-R. PL il (5) A "Fly Neighborly Program" shall be filed with the City and approved by the Director of Planning and the City's Noise Abatement Officer. The program shall emphasize noise abatement and community awareness through actions in at least the following areas: Pilot awareness and sensitivity to community concerns Pilot training and flight operations planning Public information (6) All helicopters using shall have large size numbers, a minimum of the bottom of the cra helicopters which use less than 5% of total facility per month. the helistop facility identification ( "N ") 12 inches in size on Et, except for the landing facility operations of the (7) All UUPs shall be reviewed by the Planning Commission every two years via a monitoring report to be prepared by the applicant. Such report shall consist of data on the types of helicopters using a facility, hours of operation, performance standards, number of monthly flights, and all other relevant data as determined by the City. The cost of such review and report shall be assumed by the applicant. (8) Helicopter landing facility owners and operators shall enter into an indemnification agreement with the City as regards the operation of the helistop, and shall provide adequate proof of liability insurance to the approval and satisfaction of the City Attorney. (9) All helicopters using the landing facility within the City of E1 Segundo must be equipped with a Mode A/3 transponder with Mode C altitude reporting capabilities. (10) Emergency, medical, police, fire and other public and private use helicopter landing facilities with substantial public health and safety benefits shall be permitted within the City. C. ADMINISTRATIVE PROCEDURES FOR POLICY HOLDERS (1) Existing permit holders for helicopter landing facilities that have been either abandoned for over one year or not in use for at least one calendar year as of January 30, 1986, must provide evidence of current, valid FAA approval to operate. Permits for facilities not currently approved by the FAA shall be considered for revocation in a public hearing procedure per Chapter 20.96 of the El Segundo Municipal Code. -3- 3387-R. PL (2) If the existing UUP does not specify a maximum permitted level of monthly flight operations, then one shall be established through the Section 20.96.010 hearing procedures for modification. Maximum flight operations shall be determined in cooperation with the permit holder and the average level of usage over the past six months. (3) The City shall maintain an open dialogue with helistop owners /users towards the goal of consolidating existing helistop facilities usage wherever possible. (4) In reviewing all requests for continuation of existing and newly proposed helicopter landing facilities, the City shall create a noise level history of the performance characteristics of the aircraft from the information supplied from B -4 (above) and proposed aircraft at such facilities to recognize, anticipate and require the use of newer aircraft which generate less noise. SECTION 3. The City Council supports the efforts of the LAX Helicopter Operations Ad Hoc Committee, the LAX Areawide Advisory Committee, El Segundo Noise Abatement Committee, the findings of the ANCLUC study, and recommends to the Board of Airport Commissioners and the Federal Aviation Administration that an alternative flight corridor be designated, and that such alternative flight corridor be as far east of the El Segundo residential area as possible as to being reasonably conscious of surrounding communities. SECTION 4. The City Clerk shall certify to adoption of this resolution; shall enter the same original resolutions of said city; and shall mak e passage and adoption thereof in the record of th City Council of said city, in the minutes of the the same is passed and adopted.
