THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA,
DOES HEREBY RESOLVE AS FOLLOWS:
to SECTION 1. Sections 1A2.106, 1A2.107, 1A2.108, 1A2.135,
1A2.136, 1A2.137 and 1A2.137.1 of CHAPTER 1A2 (MANAGEMENT-
CONFIDENTIAL SERIES) and 1A6.141 and 1A6.150 of CHAPTER 1A6
(GENERAL RULES) of TITLE lA of the El Segundo Administrative Code
are herewith deleted in their entirety to read as per Exhibit "A"
attached hereto and incorporated 'herein by reference as though
set forth in full and at length.
SECTION 2. Sections 1A2.010, 1A2.0401 1A2.060, 1A2.070,
1A2.100, 1A2.105, 1A2.115, 1A2.130, and 1A2.134 of CHAPTER 1A2
(MANAGEMENT- CONFIDENTIAL SERIES) and 1A6.090 of CHAPTER 1A6
(GENERAL RULES) of TITLE IA of the E1 Segundo Administrative Code
are herewith amended in their entirety to read as per Exhibit "A"
attached hereto and incorporated herein by reference as though
set forth in full and at length.
SECTION 3. Sections 1A2.087, 1A2.106, 1A2.108, 1A2.109,
1A2.135, 1A2.136, 1A2.137, 1A2.138, 1A2.139 and 1A2.139.1 of
CHAPTER 1A2 (MANAGEMENT- CONFIDENTIAL SERIES) are hereby added to
read as per Exhibit "A" attached hereto and incorporated herein
by reference as though set forth in full and at length.
SECTION 4. All resolutions and orders of the City
Council heretofore passed and adopted with reference to the same,
or any of the matters and subjects hereinabove set forth or
referred to, are hereby rescinded insofar as the same conflict
with the provisions hereof.
SECTION 5. The City Clerk shall certify to the passage
and adoption of this resolution; shall enter the same in the book
of original resolutions of said city; and shall make a minute of
the passage and adoption thereof in the records of the proceed-
ings of the City Council of said city, in the minutes of the
meeting at which the same is passed and adopted.

SECTION 1A2.030 EXPLANATION OF SALARY SCHEDULE QUARTILE SYSTEM.
Each salary range enumerated in Section 1A2.010 consists of a minimum
and maximum salary that is divided into quartiles which the City
Manager may use as practical guides for administrative purposes as
follows:
First Quartile. Newly hired or promoted employees shall be paid
the minimum salary unless they clearly possess unusual qualifications
and experience.
Second Quartile. Employees meeting the average job requirements
shall be paid within the second quartile.
Third Quartile. Employees demonstrating above average job per-
formance shall be paid within the third quartile.
Fourth Quartile. Employees making an outstanding contribution to
the City in their jobs shall be paid within the fourth quartile.
The foregoing practical guides shall not be construed as restric-
tions upon the discretion of the City Council or the City Manager, who
in cases they consider appropriate may disregard such practical
guides.
The control point shall be used to compare salaries in the job
. market. A salary increase above the control point is recognition of
above average service.

SECTION 1A2.060 EVALUATION BY CITY MANAGER -- DEPARTMENT HEADS.
The City Manager shall evaluate those employees who report directly to
him. The remaining Management- Confidential employees shall be
'. evaluated by their department heads.

The City Manager shall approve all performance salary adjustments.
Criteria for granting salary adjustments shall include but not be
limited to:
1. Present salary.
2. Length of service.
3. Quality and quantity of work performed.
4. Increased competence in handling job responsibilities.
5. Attitude and loyalty to City duties.
6. Efforts toward self - improvement.
7. Exceptional performance.

SECTION 1A2.070 SALARY INCREASES BASED ON PERFORMANCE. Salary
Ic increases shall be based on evaluation of an individual's performance
and shall acknowledge and reflect the level of job proficiency indi-
cated by the employee's performance evaluation; there shall be no
automatic step progression and no longevity step increases.
Salary increases shall normally be made once each year on or near
October 1. Increases may be made at other times on the basis of
superior job performance or unusual circumstances. If the employee's
anniversary date or other salary increase effective date falls in the
first week of the pay period, the effective date of the increase will
be the first day of that pay period; if the date falls in the second
week of the pay period, the effective date of the increase will be the
first day of the following pay period.
Annual salary adjustments shall be granted predicated on merit and
the criteria in Section 1A2.060 as follows: employees rated Satis-
factory are eligible to an increase up to the annual across - the -board
percent change to the salary ranges; employees rated Above Average and
oilOutstanding are - eligible to receive an additional 1 -5o merit increase;

and employees rated Below Average or Unsatisfactory are not eligible
to receive a pay increase; however, no salary shall fall below the
minimum of the salary range assigned to the affected employee's
corresponding classification or position.
The maximum increase that may be approved by the City Manager for
employees whose salaries are above the control point is ten percent in
any fiscal year. Increases in excess of ten percent for employees
whose salaries are above the control point shall be submitted to the
City Council for approval.

SECTION 1A2.080 OVERTIME PAY -- EXCEPTION. Management- Confidential
employees shall not be paid overtime pay. Fire Battalion Chiefs
assigned to Fire Suppression shall be paid straight time rates for
time worked on platoon duty or scheduled or non - scheduled re -hires in
excess of fifty -six hours per week.

SECTION 1A2.085 OVERTIME PAY -- EXCEPTION. Notwithstanding Section
1A2.080 of the E1 Segundo Administrative Code, Police Lieutenants
shall be paid time and one -half rates for time worked on shift basis
in excess of eight hours, or ten hours when assigned to a four -day,
ten -hour working schedule, in any one day or more than forty hours per
week, excluding hours worked involving hold -over for non -shift work,
or work due to staff meetings or training.

SECTION.lA2.087 PROMOTIONS. In all cases where an employee
is promoted to a classification regulated by this Chapter for which a

higher rate of compensation is provided, then such employee so pro-
moted shall enter into such higher classification at the lowest rate
of compensation provided for such higher classification which exceeds
by not less than five percent the base rate of compensation, excluding
special assignment pay, received by said employee in such given
classification at the time of such promotion, unless otherwise ordered
by the City Council. All supervisors shall be paid a higher base
salary than any of their regularly assigned subordinates (exclusive of
longevity pay, educational incentive pay, special assignment, or any
other form of compensation). In the event that a supervisor is paid a
base salary equal to or lower than one of their regularly assigned
subordinate's base salary, the supervisor shall be granted a higher
base salary (exclusive of longevity pay, educational incentive pay,
special assignment or any other form of compensation) even if the
supervisor's new base salary is not the same as an existing pay step
in the Salary Schedule. Notwithstanding the above, the supervisor's
salary shall not exceed the salary range for which he /she is eligible
by length of service and performance.

SECTION 1A2.090 RESIDENCE REQUIREMENTS. Within eighteen months
following employment or promotion, the City Manager, Chiefs of Police
and Fire Departments, City Librarian, Directors of the Finance
Department, Building Safety Department, Planning Department, Public
Works Department, and Recreation and Parks Department shall live

SECTION 1A2.100 EXECUTIVE LEAVE. Management - Confidential em-
ployees shall be granted not less than three and not more than five
days executive leave with pay per calendar year which may be used for
personal business, attendance at educational courses, or for addi-
tional vacation. All Management - Confidential employees receive a
minimum of three days per year. In addition, those employees in
positions which require more than 40 hours' service (56 hours for Fire
Suppression shifts) annually at times other than their normal duty
hours shall be granted up to two additional executive leave days with
pay if not otherwise directly compensated. Department heads shall
determine the number of authorized executive leave days (3, 4 or 5)
eligible employees are entitled to receive in their departments and
allow said employees to use executive leave only in proportion to
number of overtime hours he or she actually works.
Partial year's service in a Management- Confidential position shall

SECTION 1A2.105 FLEXIBLE BENEFIT PLAN. Effective with the
payroll deduction made for coverage for the month of December, 1986,
upon approval of the City Manager, Management - Confidential employees
shall be eligible to participate in a Flexible Benefit Plan. A
monthly contribution by the City of $315 plus an amount equal to three
percent (30) of each Management - Confidential employee's total pay may
be used for City selected programs as follows:
1. Payment of City group health /medical insurance premium;
2. Payment of City group life insurance premium;
3. Payment of individual life insurance premium;
4. Payment of City group dental insurance premium;
5. Payment of City group psychological insurance premium;
6. Payment of fitness center memberships, subject to federal
and state tax laws; and
7. Taken as salary or other benefits which the employee may
elect and which the City Manager approves.
This section shall be limited to the requirements of the City's
insurance agreements and to once a year unless the City Manager
determines that circumstances necessitate otherwise.

SECTION 1A2.106 INSURANCE BENEFITS -- EMPLOYEE DENTAL /OPTICAL /LONG
TERM DISABILITY (NON —JOB RELATED).
(A) Dental.
The City shall-pay the cost of the employee only premium
under the City's group dental program for those personnel
regulated by this Chapter.
(B) Optical.
Effective December 1, 1986, the City shall provide all
personnel regulated by this Chapter a contribution toward
employees' and dependents' premiums under the City's group
optical program up to $7.42 per month for the employee and
two or more dependents; provided, however, that employees who
have single coverage or employees who have employee and one
dependent coverage shall be provided with payment of optical
premiums in full or a maximum of $7.42 per month, whichever
is less.
(C)= Long Term Disability (Non —Job Related)
Civilian non —sworn Management— Confidential employees, who do.
not receive the single highest year retirement calculation
formula under the California State Public Employees' Retire-
ment System, shall be covered by the City under a long term
disability insurance plan.

SECTION 1A2.108 INSURANCE BENEFITS -- SERVICE RETIREE MEDICAL - -CITY
CONTRIBUTION. In the event an employee regulated by this Chapter,
while in the City's employ, and who has been employed continuously by
the City for five or more years in a management or confidential
0 classification, service retirees under the California Public
Employees' Retirement System after December 1, 1985, he /she shall be
eligible to receive a contribution from the City in the sum up to $100
per month toward the retiree's and up to 1 dependent's medical
insurance premiums regardless of whether the medical coverage is a
plan offered by the City. In the event that the actual medical
insurance premium is less than $100 per month, the City shall pay the

actual premium cost. For retirees who continue their City medical
coverage, the retiree will remit to the City the difference between
the premium cost of their coverage less the $100 per month. For
retirees with medical coverage not offered through the City, the
retiree shall furnish the City with proof of their medical insurance
coverage anytime during the year and be remitted a City check up to
$1,200 for a 12 consecutive month period; coverage for less than a
full year shall be compensated on a prorated basis.

SECTION 1A2.109 INSURANCE BENEFITS -- DISABILITY RETIREE PARTICI-
PATION IN CITY'S GROUP MEDICAL INSURANCE PLAN AFTER TEN YEARS' CITY
SERVICE: Management - Confidential employees who have been employed
continuously by the City for ten years or more may, upon retirement
for disability from City employment, participate in the City's group
health insurance plan. Each such employee, if he or she elects to
participate in the City's group health insurance plan, shall be
responsible for and shall pay any premium required to maintain such
insurance. Participation in the City's group health insurance program
by employees who retire for disability shall be contingent upon
acceptance of such employee in the group plan by the insurance
carrier. This section shall not apply to any employee who retired
prior to December 20, 1983.

employed full time by the City shall not accept other work or actively
participate in the management of a private profit- producing activity

SECTION 1A2.115 EDUCATION
EXPENSES -- REIMBURSEMENT. Management -
Confidential employees shall, upon an approved application and agree-
ment to the provisions of this section, be reimbursed eighty percent
of the cost of tuition and books to a maximum of $1,250 per calendar
year for work- related college courses; provided, however, such courses
have been approved by the City Manager. Employees voluntarily ter-
minating employment with the City within two months from completion
of coursework shall have deducted from their final pay 100 percent of
the amount reimbursed; thereafter, ten percent less than 100 percent
shall be deducted from their final pay for each full month worked up
to twelve months from the date of the completion of the course.

tion plan has been established as a benefit to Management- Confidential

SECTION 1A2.131 SICK LEAVE ACCUMULATED FOR PHYSICAL EXAMINATION.

MULATION OF SAME. Sick Leave with pay may be granted for an absence
from duty because of personal illness, injury, or legal quarantine not
compensable under the provisions of the Workers' Compensation Laws of
the State of California. Permanent employees shall accumulate Sick'
Leave at the rate of one eight -hour day accumulation for each month's
service not to exceed a maximum of 1056 hours (for Fire Shift person-
nel- -1534 hours). Hours worked in addition to a regular work week
shall not entitle an employee to additional Sick Leave accumulation.
Sick Leave taken by an employee shall be deducted from his or her
accumulated credit.

SECTION 12A.137 SICK LEAVE -- CONVERSION TO SALARY 1 -YEAR BEFORE
RETIREMENT. Personnel regulated by this Chapter who have been
employed by the City for five or more years in a management or con -
'• fidential position may establish an irrevocable date for retirement by
giving written notice to their department head who, in turn, shall
notify the Personnel Director at least one year in advance of said
date. The employee may then elect to reduce their accumulated sick
leave by 10% and have the monetary value of that accumulated sick
leave, redistributed uniformly throughout the twelve month period
prior to said retirement date as wages subject to retirement contri-
butions. The distribution of such additional compensation shall

only pertain to increasing the employee's final year of compensation
for retirement purposes only and shall not apply as base salary for
any other purposes which are calculated upon, the base hourly rate of
pay including, but not limited to overtime, vacation cash -in pay, .
vacation and /or sick leave pay upon termination, annual sick leave pay
for excess accrual, or any other benefit or form of compensation
predicated on the employee's salary. Employees who declare their
intent to retire by January 1, 1987 and set a retirement date on or
before June 30, 1987, may catch -up by having the 10% of their sick
leave balance equally distributed over the remaining months of their
employment prior to June 30, 1987.

SECTION 1A2.138 PHYSICAL EXAMINATIONS. Notwithstanding Section
1A6.270 of the E1 Segundo Administrative Code, Management - Confidential
employees shall receive at City expense comprehensive medical exami-
nations and recommended further testing, including individual fitness
consultation, periodic follow -up monitoring, and "wellness" lectures.
Following the implementation year in which all Management- Confidential
employees shall receive examinations, the frequency of testing shall
• be determined by the City doctor and approved by the City Manager.
Employees who supply test results from similar timely medical
examinations may be waived from the examination provided for herein.

the approval of the employee's supervisor after a minimum of seven (7)
days prior notice.

Police Lieutenants shall be paid for 96 hours in lieu of holidays once
a year on or about the 10th day of December. Employees serving as
Lieutenants less than a year shall be paid holiday pay on a pro rata
basis. Upon the employee's request and department head approval, time
off may be taken in lieu of holiday pay.

SECTION 1A2.144 VACATIONS. Employees regularly employed shall
accumulate vacation time in accordance with the following schedule:
1. Twelve working days per year with full salary for the first
seven years of continuous service with the City.

SECTION 1A2.148 BEREAVEMENT LEAVE -- PERSONAL EMERGENCIES- -IMME-
DIATE FAMILY DEFINED. A. Bereavement Leave. Commencing June 28,
1980, in the case of death in the "immediate family" of the employee
or the employee's spouse, a maximum of three days Bereavement Leave
with pay may be granted per incident. Proof of death may be required
before charging an absence to Bereavement Leave. Bereavement Leave
shall be distinct from all other leave benefits and may not be
accumulated.
B. Personal Emergencies - -Use of Eligible Leaves. For other types
of personal emergencies, that is, a serious illness of an "immediate
family" member of the employee or the employee's spouse and for cases
of extreme and unusual hardship of an emergency nature, employees,
upon request, shall be entitled to utilize accumulated vacation leave,
compensatory time -off, or Personal Leave Day /Floating Holiday, for
which prior notification is required; however, in certain instances
10 notification requirements may be waived.
C. Immediate Family Defined. For the purpose of this section,
"immediate family" shall mean spouse, child, mother, father, or

SECTION 1A6.080 TEMPORARY SERVICE IN HIGHER CLASSIFICATION. In
any case where an employee is qualified for and is required for an
appreciable period of time to serve temporarily in and have the
responsibiliy for work in a higher class or position, when approved by
the City Manager, such employee, while so assigned, shall receive the
entrance salary rate of that class or whatever step thereof that is
not less than five percent above his or her present rate, whichever is
higher. For the purpose of this section, "appreciable period of time"
is defined as thirty consecutive working days (twenty -four working
days if on Four /Ten Plan) or longer for department and division heads
and ten consecutive working days (eight working days if on Four /Ten
Plan) or longer for all other classifications.

SECTION 1A6.090 PROMOTIONS. In all cases where an employee
regulated by Chapters lA3 and 1A4 is promoted to a classification in
Chapters 1A3 or 1A4 for which a higher rate of compensation is pro-
vided, then such employee so promoted shall enter into such higher
classification at the lowest rate of compensation provided for such
higher classification which exceeds by not less than five percent the
j� base rate of compensation, excluding special assignment pay, received
by said employee in such given classification at the time of such
promotion, unless otherwise ordered by the City Council. All super-
visors shall be paid a base rate not less than the next higher base
rate than any of their subordinates. In the event that a supervisor
is paid a base rate of pay equal to or lower than one of his regularly
assigned subordinate's base rate, the supervisor's base rate shall be

SECTION 1A6.100 TERMINATION PAY. Upon termination of employment
during a pay period, pay shall be prorated and paid for each day
worked in said pay period and the terminal salary warrant shall
include accrued vacation pay to the time of termination.

SECTION 1A6.120 SICK LEAVE CERTIFICATION. Any employee taking
sick leave shall, upon his or her return to work, sign a statement
certifying the reasons for such sick leave. Employees absent five or
more consecutive working days, or four consecutive working days for
employees assigned to a four -day ten -hour working schedule must submit
a statement from a doctor that the employee was under his care and is
able to return to work. The City Manager may, before allowing such
leave or before permitting an employee to return to work, require
submission of a doctor's certificate for any absence. Any employee
who makes a false claim to sick leave or who refuses to cooperate in
tan investigation by the City of his or her claim shall be subject to
disciplinary action.
