CC RESOLUTION 3444RESOLUTION NO. 3444 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, CALLING AND GIVING NOTICE OF THE HOLDING OF A SPECIAL MUNICIPAL ELECTION ON TUESDAY, FEBRUARY 241 1987, FOR THE SUBMISSION TO THE QUALIFIED VOTERS AN ORDINANCE RELATING TO THE IMPOSITION OF A BUSINESS LICENSE. WHEREAS, the City Council of the City of E1 Segundo, on August 6, 1986, adopted Ordinance No. 1075 amending Title 5 (Business Regulations and Licensing of the Municipal Code). law; and WHEREAS, the ordinance was published as required by WHEREAS, State of California Proposition 62 was approved It by the electorate on November 4, 1986; and WHEREAS, Proposition 62 provides in part as follows: Any tax imposed by any local government or district on or after August 1, 1985, and prior to the effective date of this Article, shall continue to be imposed only if approved by a majority vote of the voters voting in an election on the issue of imposition, which election shall be held within two years of the effective date of this Article. Any local government or district which fails to seek or obtain such majority approval shall cease to impose such tax on and after November 15, 1988; and WHEREAS, the City Council is authorized to submit the Itthe ordinance to the voters; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. That pursuant to the requirements of the laws of the State of California relating to general law cities, there is called and ordered to be held in the City of El Segundo, California, on Tuesday, February 24, 1987, a Special Municipal Election for the purpose of submitting the following ordinance for vote of the electorate of the City: • Shall Ordinance No. 1075, an ordinance of the City Council of the City of Yes E1 Segundo, California, imposing increased business registration fees on certain businesses located in the City of E1 Segundo continue to be imposed after November 15, 1988. No SECTION 2. That the text of the ordinance submitted to the voters is attached as Exhibit A. SECTION 3. That the ballots to be used at the election shall be in form and content as required by law. SECTION 4. That the City Clerk is authorized, instructed and directed to procure and furnish any and all Isofficial ballots, notices, printed matter and all supplies, equipment and paraphernalia that may be necessary in order to properly and lawfully conduct the election. SECTION 5. Pursuant to Section 14206 of the Election Code that the polls shall be open at seven o'clock a.m. of the day of the election and shall remain open continuously from that time until eight o'clock p.m. of the same day when the polls shall be closed, except as provided in Section 14301 of the Elections Code of the State of California. SECTION 6. That in all particulars the election shall be held and conducted as provided by law for holding municipal elections. SECTION 7. That notice of the time and place of holding the election is given and the City Clerk is authorized, instructed and directed to give further or additional notice of the election, in time, form and manner as required by law. SECTION 8. The City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of original resolutions of said city; and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said city, in the minutes of the meeting at which the same is passed and adopted.
