CC RESOLUTION 3411RESOLUTION NO. 3411 A RESOLUTION OF THE CITY, COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, GRANTING A CONDITIONAL PERMIT TO AMERICAN TRANSPORTATION ENTERPRISES, INC., dba "AM /PM TAXI," TO OPERATE A TAXICAB BUSINESS IN THE CITY OF EL SEGUNDO. WHEREAS, there has been presented to the City Council of the City of E1 Segundo, California, the application of American Transportation Enterprises, Inc., dba "AM /PM Taxi," for a permit to conduct a taxicab business in said city under the name of "AM /PM Taxi, "; and WHEREAS, the City Council has reviewed the application and has interviewed the applicant, and said Council believes that the applicant intends to operate the proposed taxicab ser- vice for the people of El Segundo in a prudent and satisfactory manner; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. That the application of American Transportation Enterprises, Inc., above referred to, is ordered placed on file in the office of the Director of Finance, open to public inspec- tion, and that said application as on file be and the same is hereby referred to and by this reference incorporated herein and made a part hereof. SECTION 2. That in the opinion of the City Council, the public convenience, necessity and interest will be served by the operation within the city of the taxicab service referred to in said application of American Transportation Enterprises, Inc. SECTION 3. That American Transportation Enterprises, Inc., dba "AM /PM Taxi," be and is hereby authorized and granted per- mission to operate a taxicab business within the City of El Segundo, California, in accordance with the provisions of the "E1 Segundo Municipal Code," relating to such matters, and subject to the following special and additional terms and conditions: (1) That this permit is temporary only and may be suspended by the Chief of Police of said City at any time in his discretion, or may be revoked by the City Council at any time in its discretion, and that such suspension or revocation may be so ordered and made at any time without cause, without notice and without liability on the part of the City of El Segundo, or any of its officers, employees, agents or representatives. (2) That while operating said business under the permission herein granted, said applicant shall conform with and abide by the provisions of the Code of said City, and such regu- lations as the Chief of Police of said City may prescribe with respect to the operation of taxicabs and taxicab businesses within said city. (3) That until the further order of the City Council, permittee shall be and is hereby authorized to operate taxicabs in connection with said business. (4) That the rates to be charged for taxicab service within the city rendered by the permittee shall be in accordance with the following schedule: A. An initial flag drop of one dollar and ninety cents for the first one -fifth of a mile. B. Twenty cents for each additional one- seventh of a mile. C. Waiting time twenty cents per minute. D. Charge for extra passengers, none. The adopted schedule must be filed with the Police Chief and the applicable schedule shall be conspicuously displayed in each cab. (5) That the permit herein granted shall not be assigned, or be subject to assignment, without the written consent of the City Council first had and obtained. (6) That permittee shall not use any vehicle more than ten years old in providing service pursuant to. this permit. 1 -2- (7) That permittee must maintain a toll -free telephone 10 line so that any person in the city of El Segundo can place a toll -free call for service. (8) That the City Council reserves the right to make such additional rules and regulations; and to prescribe such additional terms and conditions with reference to the permit herein granted and the business operated or to be operated there- under, as said Council in its discretion may from time to time determine. (9) That valid driver's permits and vehicle permits issued by the City of Los Angeles or the City of Beverly Hills shall be accepted in lieu of the permits required by Sections 1 5.16.300 and 5.16.420 of the El Segundo Municipal Code. The permittee shall notify the Chief of Police when any driver's permit or vehicle permit issued by the City of Los Angeles or the City of Beverly Hills is cancelled, revoked, or otherwise terminated. The City Council finds that the investigation by the City of Los Angeles or the City of Beverly that no unfit or improper person receives a pe automobile for hire. (10) Notwithstanding the provisions of of the E1 Segundo Municipal Code, the business be $24.00 for each cab per calendar year, plus each cab (for sticker) per calendar year. (12) This permit shall not become operative until permittee has endorsed upon a copy of this resolution an acceptance of this conditional permit, which said endorsement shall be substantially in the following form and may be subscribed to by said permittee at this point: -3- "The undersigned, being the permittee referred to in the foregoing Resolution No. 3411 , in consideration of the permit granted to him therein, does hereby state that he has carefully read the said resolution and is familiar with the terms, conditions and provisions thereof; that he accepts the permit therein referred to upon and subject to each and all of the said terms, conditions and provisions, and agrees to observe and be bound thereby. SECTION 5, The City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of original resolutions of said City; and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said City, in the minutes of the meeting at which the same is passed and adopted.
