THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: SEC3'ION 1. Sections 1A5.010, 1A5.020, 1A5.023 and 1A5.025 of CHAPTER 1A5 ( POLICE SAFETY SERIES) of TITLE lA of the *.,,,,,E,l Segundo Administrative Code are herewith deleted in their entirety to read as per Exhibit "A" attached hereto and incor- porated herein by reference as though set forth in full and at length. SECTION 2. Sections 1A5.040, 1A5.100, 1A5.160, 1A5.212, 1A5.235, and 1A5.240 of CHAPTER 1A5 (POLICE SAFETY SERIES) and 1A6.090, 1A6.120, 1A6.140, 1A6.141 and 1A6.150 of CHAPTER 1A6 (GENERAL RULES) of TITLE lA of the El Segundo Administrative Code are herewith amended in their entirety to read as per Exhibit "A" attached hereto and incorporated herein by reference as though set forth in full and at length. SECTION 3. Sections 1A5.010, IA5.011, 1A5.012, 1A5.013, 1A5.015, 1A5.016, 1A5.017, 1A5.018, 1A5.020, 1A5.021, 1A5.0221 1A5.023, 1A5.095, 1A5.213, 1A5.217, 1A5.218, and 1A5.219 of CHAPTER 1A5 (POLICE SAFETY SERIES) are hereby added to read as per Exhibit "'A" attached hereto and incorporated herein by ref- erence as though set forth in full and at length. SECTION 4. All resolutions and orders of the City Council heretofore passed and adopted with reference to the same, or any of the matters and subjects hereinabove set forth or referred to, are hereby rescinded insofar as the same conflict 0 with the provisions hereof. and adoption of this resolution; shall enter the same in the book of original resolutions of said city; and shall make a minute of the passage and adoption thereof in the records of the proceed- ings of the City Council of said city, in the minutes of the meeting at which the same is passed and adopted. In order to maintain accuracy and consistency, the methodology used in computing future salary adjustments shall be as follows: Future adjustments are to be computed from the amount shown in the box below Ranges 685 -E, 700 -E, 785 -E and 800 -E of the Basic Salary Schedule which shall be multiplied by the percent of the adjustment, e.g. 5% increase = E x 1.05 using a 12 -digit calculator. All other calculations shall be based on this new amount. Each salary step shall be calculated by using the raw unrounded figure in the calcu- lator for the previous salary step. Police Officer Trainees shall be compensated at eighty percent of the rate of pay of Police Officer Step "A" of the Basic Salary Schedule. Not- withstanding the above, a Police Service Officer who is appointed to the position of Police Officer Trainee shall continue to receive his /her former rate of pay as a fixed amount as long as it exceeds the salary to which he /she would otherwise be entitled based on job performance and length of service as a Police Officer Trainee. The affected employee's salary shall change to the appropriate salary range for his /her classification upon that salary being more than the aforementioned frozen (Y- rated) salary. (Reso. 3272) 8/84 SECTION 1A5.035 POLICE OFFICER TRAINEE -- TEMPORARY DISABILITY SPECIAL SUPPLEMENTAL PAYMENT. Whenever a Police Officer Trainee becomes eligible for benefits pursuant to Labor Code Section 4850 as a result of a disability incurred while on regular patrol duty in the City of E1 Segundo such Trainee shall be paid in addition to the benefit called for by Labor Code Section 4850 a sum equal to the 1A5 -17 7/86 • • 0 0 L-1 '• 100 difference between rate of pay of Police Officer Trainee and the rate of pay of Police Officer Step "A" of the Basic Salary Scheule, during the period he or she receives benefits pursuant to Labor Code Section 4850. (Reso. 2709) 8/76 SECTION 1A5.040 FIREARMS QUALIFICATION. The Chief of Police is authorized to conduct in his department drills, practices or tests in the use and firing of sidearms and small arms by the members of his department in order to increase the efficiency of the members of his department in the use of such firearms. Such practices, tests or drills shall be held at such times and at such places as said Chief shall designate and shall be participated in by such members of the department as the Chief may from time to time authorize so to do. Such tests, practices and drills shall be held under such conditions and at such times and subject to such rules as to enable said Chief to properly make the certifications hereinafter referred to, to the Personnel Officer. Said additional compensation shall be payable only upon certification by the Chief of Police that the particular officer or member has qualified during the quarter preceding the certification with a score of 375 or better (indicating score), and that such person is entitled to the additional compensation for a class as set forth in such schedule. The prior approval of the employee's immediate supervisor is required to take said time off. This leave shall be separate and distinct from other leave paid time of (i.e., vacation, compensatory and sick leave), shall not be accrued for more than 12 months from the date it is credited, and if the leave time is not used shall expire without monetary compensation. (Reso. 3144) 6/82 SECTION 1A5.047 POLICE OFFICER -- CANINE HANDLER. Effective June 26, 1982, Police Officers to whom canines have been assigned by the Police Chief shall, while functioning in the capacity of canine handlers, be paid an additional $150.00 per month above the range and step of the Police Officer classification to which they are entitled by length of service and performance; provided, however, that when such assignment continues during only part of a pay period, the special allowance provided by this section shall be prorated. (Reso. 3157) 7/82 SECTION 1A5.050 MOTORCYCLE HAZARD PAY. Effective July 11, 1981, members of the police service assigned to motorcycle duty shall, while serving in such capacity, be paid motorcycle hazard pay in the sum of $175.00 per month above the range and step of the Police Officer classification to which they are entitled by length of service and performance, except whenever any affected employee has been absent because of a disability resulting from an illness or injury occurring outside of the course and scope of his /her employment for a period of thirty consecutive calendar days, the City may, commencing the thirty - first consecutive day of such absence, terminate any motorcycle hazard pay bonus to which the employee would have been entitled had he been performing his regular duties. All terms and conditions governing the receipt of such pay for Police Officers also shall apply to a Police Sergeant. (Reso. 3272) 8/84 SECTION 1A5.055 FIELD TRAINING OFFICER PAY. Effective July 7, 1984, Police Officers who are assigned by the Police Chief as Field Training Officers to train probationary Police Officers shall, while assigned as a Field Officer or performing duties related to the Police Officer Trainee Program such as preparing or updating trainee program manuals as approved by the Chief of Police, be paid the sum of $104.50 per month above the range and step of the Police Officer classifica- tion to which they are entitled by length of service and performance; provided, however, that when such assignment continues during only part of a pay period, the special allowance provided by this section ! shall be prorated. The program shall be administered in accordance with the revised "Educational Incentive Pay Program Rules, Regulations and Procedures" as revised to August 7, 1972, a copy of which is on file 0 in the office of the City Clerk. (Reno. 2620) 4/75 SECTION 1A5.075 EDUCATIONAL INCENTIVE PAY RETENTION. Sworn personnel employed and /or reinstated on or after June 25, 1983, shall not retain pay steps A -1, B -1, C -1, D -11 E -1, X -1, Y -1, Z -1, A -2, B -2, C -2, D -2, E -2, X -2, Y -2, and Z -2 in this Code if each year following the date on which the educational incentive pay was granted and reinstated the employee has not completed three (3) semester units (or equivalent quarter units) of job related course work at an accredited college or university and attained a mimimum "C" grade in said course. Job related training such as seminars, workshops, etc. can be taken in lieu of the formal college course at twenty (20) hours of training equal to one (1) semester unit. The employee is required to obtain li prior approval of the course and training in terms of its job re- latedness from both the Police Department's Training Officer as I� designated by the Chief of Police and the employee's Bureau Commander. Courses and training selected by the employee shall be taken at the employee's expense (no City funds shall be used for this purpose). The City reserves the right to send sworn personnel for training based on the Police Department's needs, which would be at the City's expense. In the event the educational incentive pay is rescinded, the •� employee will be compensated at the pay step in the Basic Salary 1A5 -22 7/86 • • M n LJ Schedule to which the employee is entitled by length of service and job performance. Educational incentive pay shall be reinstated upon the employee's showing of proof of compliance with the above con- tinuing education /training requirements. (Reso. 3222) 8/83 SECTION 1A5.080 EDUCATIONAL INCENTIVE PAY PROGRAM- -STEP ADVANCE- MENT. All sworn personnel in the El Segundo Police Department employed prior to September 1, 1970 who have subscribed to and are entitled to the educational incentive pay shall advance to Step B -1 or 2; C -1 or 2; D -1 or 2; or E -1 or 2 (to whichever they are entitled by classification and length of service), in accordance with the Educa- tional Incentive Pay Program Salary Schedules for Intermediate or Advanced Certificates set forth in Section 1A5.020 of this Chapter. Educational incentive pay shall not be automatic. Each officer must continue to be proficient and is subject to annual examination and evaluation. Should a Police Officer receive an unsatisfactory rating, the eductional incentive pay shall be terminated until such time as the employee receives a satisfactory rating. (Reso. 2620) 4/75 SECTION 1A5.090 STEP ADVANCEMENT- -BASIC SALARY SCHEDULE. The advancement of a new employee from Step A shall be on the new em- ployee's anniversary date which is established as the day immediately following satisfactory completion of his or her first six month's 1A5 -23 7/86 • • w 0 service; Steps B, C and D contemplate one year's service in each of such classifications subject to the limitations of Section 1A5.130 and the advancements therefrom shall be on the anniversary date of the employee; Step E contemplates continued service in such classifica- tions until further advancement is indicated by reason of longevity. (Reso. 2620) 4/75 SECTION 1A5.095 PROMOTIONS. In all cases where an employee regulated by this Chapter is promoted to a classification for which a higher rate of compensation is provided, then such employee so pro- moted shall enter into such higher classification at the lowest rate of compensation provided for such higher classification which exceeds by not less than five percent the base rate of compensation, excluding special assignment pay, received by said employee in such given classification at the time of such promotion, unless otherwise ordered by the City Council. All supervisors shall be paid a higher base salary than any of their regularly assigned subordinates (exclusive of longevity pay, educational incentive pay, special assignment, or any other form of compensation). In the event that a supervisor is paid a base salary equal to or lower than one of their regularly assigned subordinate °'s base salary, the supervisor shall be granted a higher base salary (exclusive of longevity pay, educational incentive pay, I� special assignment or any other form of compensation) even if the supervisor's new base salary is not the same as an existing pay step in the Salary Schedule. Notwithstanding the above, the supervisor's salary shall not exceed the salary range for which he /she is eligible by length of service and performance. If the employee's overall performance evaluation improves to a satisfactory level the longevity pay step will be granted or reinstated upon the issuance of a satisfactory performance report. Other changes in salary, unless specifically directed by the Council or as provided in Section 1A5.130, shall not change the anniversary date, except for promotions made in accordance with the Personnel Merit System Ordinance of the Personnel Rules and Regulations. The City Council reserves the right at any time, and in its sole discre- tion, to change the range number assigned to any officer or employee and to determine the particular step in any range number which is to be thereafter assigned to any such officer or employee. An employee will be eligible for advancement to a higher step on the basis of service time as described in Section 1A5.090 and satisfactory performance of duties. An employee will be presumed to merit an increase unless his or her Department Head notifies the Personnel Officer in writing at least ten days in advance of the scheduled increase that the increase should be withheld, stating reasons. The reasons shall be provided to the employee in writing. Except as otherwise hereinafter provided, the members of the Police Department of said City shall work regularly scheduled shifts to be promulgated and established from time to time by the City Manager. It is provided, however, that where a member of the Police Department is required to render more than eight hours service, or ten hours service when assigned to a four -day ten - hour working schedule, in any one day or more than forty hours per week, such member shall be entitled to receive and there shall be paid to him additional compensation for such overtime at one and one -half time his or her regular rate of pay. Straight time only will be paid all police personnel entitled to overtime for the following duty assignments: 1. Approved departmental in- service training and specialized training schools, except that: a. Officers promoted in rank and who are required to attend in- service classes to gain the knowledge necessary to perform their new duties and responsibilities of said position, shall not be compensated in overtime pay for the hours spent in training over and above a normal eight -hour day, or a ten -hour day for employees assigned to a four -day ten -hour working schedule; and b. overtime pay shall not be paid to police personnel who attend a basic recruit school learning the duties and responsibilities of their new career in law enforcement. 2. Staff meetings. 3. Photography work. 4. Such other similar duty that may develop in the future. Police officers required to make presentations approved by the Chief of Police to community groups during scheduled off -duty hours will be paid at one and one -half times his or her regular rate of pay 1A5 -27 7/86 • • 0 0 0 0 0* Police officers required to appear in court during scheduled off- duty hours will be paid for a minimum of two hours duty. Police officers entitled to marksmanship compensation who are required to shoot in Manhattan Beach during off -duty hours in order to qualify for marksmanship compensation shall be entitled to be paid one hour at straight time salary rates for each time they are required to shoot, but not in excess of once each calendar month. (Reso. 3272) 8/84 SECTION 1A5.155 OVERTIME PAY -- COMPENSATORY TIME. Compensatory Time may be substituted for overtime pay if approved by the City Manager; provided, however, the accumulation and use of Compensatory Time does not exceed forty hours per employee at any one time. No more than eighty hours may be accumulated or used in any one calendar year. Compensatory Time may be used in conjunction with normal Vacation Leave with prior approval of the City Manager. (Reso. 3272) 8/84 SECTION 1A5.160 HOLIDAYS -- PAYMENT IN LIEU. Police Department personnel who are regularly required to work on holidays, notwith- standing any provision herein to the contrary, shall be paid for ninety -six hours in lieu of holidays once a year on or about the 10th day of December. Employees who terminate shall be paid holiday pay on a pro rata basis. Effective December 1, 1987 for the preceeding 12 month period, the City shall pay to the California Public Employees' Retirement System a flat dollar amount equal to one -half (500) of the employees' contribution to the California Public Employees' Retirement System on the holiday pay specified herein as follows: 1A5 -28 7/86 • A. For personnel under the 2% at 50 PERS Plan up to 4.5% of the total 9.0% employee share. B. For personnel under the 2% at 55 PERS Plan up to 3.5% of the total 7.0% employee share. The City shall allow lateral entry of qualified peace officers from other agencies who desire employment in the E1 Segundo Police Department in the position of policeman in an advanced status, in accordance with the provisions hereinafter set forth. (Reso. 2620) 4/75 SECTION 1A5.180 LATERAL ENTRY -- COMPENSATION UNDER BASIC SALARY SCHEDULE. Subject to the approval of the City Manager, police officers entering the service of the El Segundo Police Department under the Lateral Entry Program shall receive compensation under the Basic Salary Schedule at the salary step to which they are entitled by their total number of years.of law enforcement experience. (Reso. 2627) 4/75 SECTION 1A5.190 LATERAL ENTRY -- QUALIFICATIONS FOR EDUCATIONAL INCENTIVE PAY. Police officers who enter the service of the E1 Segundo Police Department under the Lateral Entry Program and have qualified for and are entitled to the Educational Incentive Pay shall receive compensation in accordance with the Educational Incentive Pay Program Salary Schedule for Intermediate or Advanced Certificates set forth in Section 1A5.020 of this Chapter. (Reso. 2620) 4/75 SECTION 1A5.200 LATERAL ENTRY - -SICK LEAVE TRANSFERABLE. Police- men who enter the service of the E1 Segundo Police Department under 1A5 -29 7/86 • • M • the Lateral Entry Program shall be allowed to transfer their accumu- lated sick leave from the preceding employing agency at a rate of one hundred percent up to a maximum of two hundred forty hours. SECTION 1A5.210 LATERAL ENTRY -- VACATIONS AND OTHER BENEFITS. 0 Police Officers who enter the service of the E1 Segundo Police Department under the Lateral Entry Program shall be new employees with no rights of seniority in the treatment of vacation or any other benefit accrued by the right of seniority. (Reso. 2620) 4/75 SECTION 1A5.212 INSURANCE BENEFITS -- EMPLOYEE MEDICAL /DENTAL/ OPTICAL. (A) Medical. Effective with the payroll deduction made in June, 1986, for coverage in the month of July, 1986; the City shall continue to provide all sworn personnel of the police service enumerated in Section 1A5.030, a contribution toward the employees' and dependents' medical premiums in a sum up to 90% of the premiums under the more costly of the medical insurance plans (including outpatient psycho- logical coverage) offered by the City for an employee and two or more dependents, not to exceed $23G.32 per month; provided, however, that employees who have single employee coverage or employees who have employee and one dependent coverage shall be provided with payment of medical premiums in full or a maximum of $236.32, whichever is less. (B) Dental. (1) All sworn personnel of the police service enumerated in Section 1A5.030 shall receive a total of $14.23 per month for dental insurance premiums for the employee only. 1A5 -30 7/86 • • (C) Optical. Effective with the payroll deduction made in November, 1986, for coverage in the month of December, 1986, the City shall provide all sworn personnel of the police service enumerated in Section 1A5.030, a contribution toward the employees' and dependents' optical premiums in the sum up to 900 of the optical insurance premium for the employee and two or more dependents, not to exceed $6.68 per month; provided, however, that employees who have single coverage or employees who have employee and one dependent coverage shall be provided with payment of optical premiums in full or a maximum of $6.68 per month, whichever is less. (D) Insurance Premiums Borne by Employees. During the annual open enrollment insurance process which normally occurs in November of each year for the new insurance year that usually commences on or about December 1 of the same year, employees will have the option to pay for medical, dental, life and optical insurance premium costs not paid by the City with pre -tax dollars. An employee can make this election only during the annual open enrollment insurance period and said election shall not be changed until the next annual open enrollment insurance period in the following year. Effective with the payroll deduction made in November, 1986, for coverage in the month of December, 1986, the City shall provide all sworn personnel of the police service enumerated in Section 1A5.030, a contribution toward the employees' and dependents' optical premiums in the sum up to 900 of the optical insurance premium for the employee and two or more dependents, not to exceed $6.68 per month; provided, however, that employees who have single coverage or employees who have employee and one dependent coverage shall be provided with payment of optical premiums in full or a maximum of $6.68 per month, whichever is less. In the event an employee regulated by this chapter, while in the City's employ, and who has been employed continuously by the City as a peace officer for five years or more, service retires under the California Public Employees Retirement System after December 1, 1986, he /she shall be eligible to receive a contribution from the City in the sum of up to $50 per month toward the retiree's and up to 1 dependent's medical insurance premiums regardless of whether the medical coverage is a plan offered by he City. In the event the actual medical insurance premium is less than $50 per month, the City shall pay the actual premium cost. For retirees who continue their City medical coverage, the retiree will remit to the City the dif- ference between the premium cost of their coverage less the $50 per month. For retirees with medical coverage not offered through the City, the retiree shall furnish the City with proof of their medical insurance coverage anytime during the year and be remitted a City check up to $600 for a 12 consecutive month period; coverage for less than a full year shall be compensated on a prorated basis. (Reso. 3406) 7/86 SECTION 1A5.215 SICK LEAVE - -LEAVE WITH PAY DUE TO ILLNESS- - ACCUMULATION OF SAME. Sick leave with pay may be granted for an absence from duty because of personal illness, injury, or legal quarantine not compensatle under the provisions of the Workers' Com- pensation Law of the State of California. Permanent employees shall accumulate sick leave at the rate of one eight -hour day accumulation for each month's service not to exceed a maximum of 1056 hours. Hours 1A5 -32 7/86 worked in addition to a regular work week shall not entitle an em- ployee to additional sick leave accumulation. In the event an employee regulated by this chapter, while in the City's employ, and with a minimum 5 years' service as a peace officer with the City, service retires under the California Public Employees' Retirement System with unused sick leave to his /her credit, he /she shall be compensated in an amount equal to sixty percent (60 %) of the value of such sick leave based on his /her salary at the time of retirement, without the inclusion of overtime pay or additional compensation. ( Reso. 3406) 7/86 SECTION 1A5.218 SICK LEAVE -- PAYMENT OF UPON DISABILITY RETIRE- MENT. In the event an employee regulated by this chapter, while in the City's employ, and with a minimum 5 years' service as a peace officer with the City, disability retires under the California Public Employees' Retirement System with unused Sick Leave to his/her credit he /she shall be compensated in an amount equal to one -half the value of such Sick Leave based upon his /her current salary at the time of retirement without the inclusion of overtime pay or additional compensation. (Reso. 3406) 7/86 SECTION 1A5.219 SICK LEAVE -- PAYMENT OF UPON DEATH. In the event an employee regulated by this chapter, while in the City's employ, and with a minimum 5 years' service as a peace officer with the City, dies with unused Sick Leave to his or her credit, his /her estate shall be compensated in an amount equal to one -half the value of such Sick 1A5 -34 7/86 • 1 61 0 Leave based upon his /her current salary at the time of his /her death without the inclusion of overtime pay or additional compensation. The members of the Police Department in the positions enumerated in Section 1A5.030 of this Chapter shall accumulate vacation time in accordance with the following schedule: 1. Ninety -six hours per year with full salary for the first seven years of continuous service with the City. 2. One hundred thirty -six hours per year with full salary after seven years and until the completion of fourteen years of continuous service. 3. One hundred seventy -six hours per year with full salary after fourteen years of continuous service. (Reso. 2620) 4/75 SECTION 1A5.230 VACATIONS -- GOVERNMENT CODE PROVISIONS. All or part of these hours may be used for other conferences or seminars with the approval of the City Manager. (Reso. 3406) 7/86 SECTION 1A5.240 UNIFORM AND SAFETY EQUIPMENT ALLOWANCES. Effec- tive July 1, 1986, Police Department employees who are required to 1A5 -35 7/86 • • E purchase and continuously maintain prescribed items of uniform clothing, personal equipment and safety equipment shall be compensated for a portion of the initial and maintenance costs thereof according to the following: 1. a. Police officers assigned to motorcycle duty -- $615.00 per year or equivalent per month of active duty. b. Police Detectives and others who normally wear civilian clothes on duty, but are required to maintain uniforms- - $325.00 per year or equivalent per month of active duty. C, All other Police Officers -- $475.00 per year or equivalent per month of active duty. 2. Newly appointed Police Officers entering the service of the Police Department under the Lateral Entry Program and newly appointed Police Officers who possess a P.O.S.T. Basic Certificate shall be provided with uniform allowances at the time of appointment and thereafter as follows: a. At the time of appointment -- 150% of annual allowance. b. At first anniversary of appointment -- 50% of annual allowance. C. After first anniversary -- 1000 of monthly allowance. (Reso. 3406) 7/86 SECTION 1A5.245 UNIFORM ALLOVIANCE -- POLICE OFFICER TRAINEE. Up to $500 shall be advanced to Police Officer Trainees for purchasing uni- forms and equipment. The Police Officer Trainee may either be issued ia gun by the Police Department or use his or her own gun assuming the weapon selected meets Department regulations. If the Police Officer Trainee is issued a gun by the Department and later elects to use his or her own gun, the Department's gun shall be returned to be used by other Trainees. Police Officer Trainees shall receive only that portion of the $500 for which documentation of purchases can be shown. • Upon satisfactory completion of the Academy training Police Officer 1A5 -36 7/86 • • Trainees shall be advanced to the rank of Police Officer. All equip- ment purchased by the Police Officer Trainee pursuant to the authority of this section shall remain the property of the City until the Police Officer Trainee satisfactorily completes three months of service as a Police Officer. (Reso. 2709) 8/76 SECTION 1A5.250 POLICE RESERVES. Reserve Police Officers shall be peace officers within the meaning of Section 830.6 of the Penal Code of the State of California. Reserve Police Officers shall be provided Workers' Compensation benefits as if they were paid the minimum wage required to qualify for such benefits. In any case where an employee is qualified for and is required for an appreciable period of time to serve temporarily in and have the responsibiliy for work in a higher class or position, when approved by the City Manager, such employee, while so assigned, shall receive the entrance salary rate of that class or whatever step thereof that is not less than five percent above his or her present rate, whichever is higher. For the purpose of this section, "appreciable period of time" is defined as thirty consecutive working days (twenty -four working days if on Four /Ten Plan) or longer for department and division heads and ten consecutive working days (eight working days if on Four /Ten Plan) or longer for all other classifications. (Reso. 3272) 8/84 SECTION 1A6.090 PROMOTIONS. In all cases where an employee regulated by Chapters 1A2, 1A3 and 1A4 is promoted to a classification in Chapters 1A2, 1A3 or 1A4 for which a higher rate of compensation is provided, then such employee so promoted shall enter into such higher classification at the lowest rate of compensation provided for such higher classification which exceeds by not less than five percent the base rate of compensation, excluding special assignment pay, received by said employee in such given classification at the time of such promotion, unless otherwise ordered by the City Council. All super- visors shall be paid a base rate not less than the next higher base rate than any of their subordinates. Upon termination of employment during a pay period, pay shall be prorated and paid for each day worked in said pay period and the terminal salary warrant shall include accrued vacation pay to the time of termination. (Reso. 2620) 4/75 SECTION 1A6.120 SICK LEAVE CERTIFICATION. Any employee taking sick leave shall, upon his or her return to work, sign a statement certifying the reasons for such sick leave. Employees absent five or more consecutive working days, or four consecutive working days for employees assigned to a four -day ten -hour working schedule must submit a statement from a doctor that the employee was under his care and is able to return to work. The City Manager may, before allowing such leave or before permitting an employee to return to work, require submission of a doctor's certificate for any absence. Any employee who makes a false claim to sick leave or who refuses to cooperate in an investigation by the City of his or her claim shall be subject to disciplinary action.
