CC RESOLUTION 3405RESOLUTION NO. 3405 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, AMENDING SECTIONS 1A4.010, 1A4.020, 1A4.0251 1A4.030, 1A4.035, 1A4.131, 1A4.1451 1A4.148 AND 1A4.155; AND ADDING SECTIONS 1A4.031, 1A4.156 AND 1A4.157 OF CHAPTER lA4 (FIRE SAFETY SERIES) AND AMENDING SECTIONS 1A6.141 AND 1A6.150 OF CHAPTER 1A6 (GENERAL RULES) OF TITLE 1A OF THE EL SEGUNDO ADMINISTRATIVE CODE. THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. Sections 1A4.010, 1A4.020, 1A4.025, 1A4.0301 1A4.035, 1A4.131, 1A4.145, 1A4.148 and 1A4.155 of CHAPTER lA4 (FIRE SAFETY SERIES) and 1A6.141 and 1A6.150 of CHAPTER 1A6 (GENERAL RULES) of TITLE lA of the E1 Segundo Administrative Code are herewith amended in their entirety to read as per Exhibit "A" attached hereto and incorporated herein by reference as though set forth in full and at length. SECTION 2. Sections 1A4.031, 1A4.156 and 1A4.157 of CHAPTER IA4 (FIRE SAFETY SERIES) are hereby added to read as per Exhibit "A" attached hereto and incorporated herein by reference as though set forth in full and at length. SECTION 3. All resolutions and orders of the City Council heretofore passed and adopted with reference to the same, or any of the matters and subjects hereinabove set forth or referred to, are hereby rescinded insofar as the same conflict with the provisions hereof. SECTION 4. In order to maintain accuracy and consistency, the methodology used in computing future salary adjustments shall be as follows: Future adjustments are to be computed from the amount shown in the box below Ranges 483 -F, 583 -F, 497 -E, 597 -E, 510 -E, and 610E of the Basic Salary Schedule which shall be multiplied by the percent of the adjustment, e.g. 5% increase = F x 1.05 (Ranges 483 and 583) or E x 1.05 (Ranges 497, 597, 510 and 610) using a 12 -digit calculator. All other calculations shall be based on this new amount. Each salary step shall be calculated by using the raw unrounded figure in the calculator for the previous salary step. Once all of the salary steps have been computed, each salary figure shall be rounded off to two (2) decimal places (i.e. if the third decimal place is 5 or greater, the second digit is rounded up 1 cent; if 4 or lower the second digit would remain unchanged) which then shall comprise the then current salary schedule. Firefighters temporarily assigned as Inspector or to other special assignments which may be approved by the City Manager from time to time, shall be compensated at a range and step equal to thirteen percent above the range and step of the classification to which they are entitled by length of service and performance. (Reso. 3334) 11/85 SECTION 1A4.035 SPECIAL ASSIGNMENT -- PARAMEDIC. Firefighters assigned to paramedic training level or paramedic service shall receive an additional salary over and above their current range and step in the classification to which they are entitled by length of service and performance as follows: 1A4 -7 7/86 • • M 1. while assigned to the trainee level, six percent; 2. During their first year of paramedic service, nine percent; 3. During their second year of paramedic service, eleven per - cent; 4. After two years of paramedic service, fourteen percent. (Reso. 3405) 7/86 SECTION 1A4.036 FIREFIGHTER COMPENSATION /PROBATIONARY PERIOD. Fire service employees shall be appointed to the position of Fire- fighter, compensated at Step A of the range assigned to Firefighter in the Basic Salary Schedule for the first six months from their date of hire, and be on probation during the first eighteen months from their date of hire. (Reso. 3334) 11/85 SECTION 1A4.040 EDUCATIONAL INCENTIVE PAY PROGRAM. There is herewith established an Educational Incentive Pay Program which shall apply to uniformed members of the Fire Department enumerated in this Chapter. (Reso. 2620) 4/75 SECTION 1A4.045 EDUCATIONAL INCENTIVE PAY PROGRAM -- EXCEPTION. Members of the fire service enumerated in Section 1A4.030 of this Chapter shall not be eligible to participate in the Educational Incentive Pay Program, except that any employee in the following classifications: Fire Captain; Fire Engineer; Firefighter 1A4 -8 7/86 • • r1 V' shall remain eligible to participate in the Educational Incentive Pay Program provided that they are appointed to the class of Firefighter as it then existed on or before July 5, 1975. (Reso. 2940) 9/79 SECTION 1A4.050 EDUCATIONAL INCENTIVE PAY -- ADMINISTRATION. The Educational Incentive Pay Program for employees in the fire service shall be administered in accordance with the "Fire Department Educa- tional Incentive Pay Program" effective on January 1, 1972, a copy of which is on file in the Office of the City Clerk. (Reso. 2940) 9/79 SECTION 1A4.060 EDUCATIONAL INCENTIVE PAY -- ELIGIBILITY. Each employee who qualifies for educational incentive pay shall remain eligible until his employment with the City of El Segundo is termi- nated or he receives an unsatisfactory performance evaluation. Should an eligible employee receive an unsatisfactory rating, the educational 0 incentive pay shall be discontinued until such time as the employee receives a satisfactory rating. (Reso. 2620) 4/75 SECTION 1A4.070 EDUCATIONAL INCENTIVE PAY -- MAXIMUM LONGEVITY. The combined total of the educational incentive pay and longevity pay for uniformed members of the Fire Department may not exceed seventeen percent (17 ranges) of Step E of the salary range set forth in Section 1A4.010 of this Chapter. (Reso. 3281) 9/84 SECTION 1A4.080 EDUCATIONAL INCENTIVE PAY BASIC SALARY SCHEDULE - STEP ADVANCEMENT. The advancement of a new employee from Step A shall 0 *be on the new employee's anniversary date which is established as the 1A4 -9 7/86 • • LJ day immediately following satisfactory completion of his first six months' service; Steps B. C. and D (E for Firefighters only) or in the case of uniformed members of the Fire Department entitled to the Educational Incentive Pay, Steps B -6, C -6, and D -6 (E -6 for Fire- fighters only); B -7. C -7, and D -7 (E -7 for Firefighters only); or B -8, C -8, and D -8 (E -8 for Firefighters only) of the Educational Incentive Pay Program Salary Schedules) contemplate one year's service in each of such classification subject to the limitations of Section 1A4.120 of this Chapter and the advancements therefrom shall be on the anni- versary date of the employee; Step F (or F -6, F -7, and F -8) for Firefighters and E (or E -6, E -7, and E -8) for Fire Engineers and Fire Captains contemplates continued service in such classification until further advancement the Fire Department eligible to receive SECTION 1A4.085 series employees hi is indicated by reason of longevity. Members of employed on and after July 1, 1974 shall not be longevity benefits. (Reso. 3334) 11/85 EDUCATION REIMBURSEMENT. Fire safety service red on and after July 1, 1974, shall receive $250 for each job related course (3 -unit semester or 4 -unit quarter system) completed at an accredited college, university, or California State Fire Academy accredited state or regional class taken during the employee's non -work hours in which a minimum "C" grade is received in the course. The employee is required to obtain the prior written approval of the Fire Chief for the course. The maximum reimbursement an employee can receive in any calendar year period is $1,000. (Reso. 3334) 11/85 1A4 -10 7/86 • • 0 SECTION 1A4.090 LONGEVITY ACHIEVEMENT. Steps X. Y and Z of the Basic Salary Schedule (in the case of uniformed members of the Fire Department entitled to the Educational Incentive Pay, Steps X -6, Y -6 and Z -6; Steps X -7, Y -7 and Z -7; or Steps X -8, Y -8 and Z -8 of the Firefighters Educational Incentive Pay Program Salary Schedules) are longevity provisions and are to be used in applying the following policy: Upon attaining seven years of continuous service with the City, an employee shall be compensated at Step X (or X -6, X -7 or X -8); upon attaining fourteen years of continuous service with the City, an employee shall be compensated at Step Y (or Y -6, Y -7 or Y -8); and upon attaining twenty -one years of continuous service with the City, an employee shall be compensated at Step Z (or Z -6, Z -7 or Z -8); pro- vided, however, that employees may be paid at a higher level than the foregoing schedule when necessary to comply with the requirements of Section 1A6.090 of this Title and provided that the uniformed members of the Fire Department shall be subject to the further limitations contained in Section 1A4.100. Members of the Fire Department hired on and after July 1, 1974, shall not be eligible for longevity pay. (Reso. 2620) 1/85 SECTION 1A4.100 LONGEVITY ACHIEVEMENT ON MERIT. Advancement of 'i uniformed members of the Fire Department enumerated in this Chapter to Steps X. An employee advanced from any range to another range of the Basic Salary Schedule shall receive a new anniversary date, which is the date of the change. Other changes in Salary, unless specifically directed by the Council or as provided in Section 1A4.120 shall not change the anniversary date, except for promotions made in accordance with the Personnel Merit System ordinance and the Personnel Rules and Regulations. The City Council reserves the right at any time, and in its sole discre- 0 tion, to change the range number assigned to any officer or employee and to determine the particular step in any range number which is to be thereafter assigned to any such officer or employee. (Reso. 2620) 4/75 SECTION 1A4.120 STEP INCREASES ON MERIT - -BASIC SALARY SCHEDULE. An employee will be eligible for advancement to a higher step on the basis of service time as described in Section 1A4.080 and satisfactory performance of duties. An employee will be presumed to merit an increase unless his Department Head notifies the Personnel Officer in writing at least ten days in advance of the scheduled increase that the increase should be withheld, stating reasons. Except as otherwise herein pro- vided, the members of the Fire Department shall work on a fifty -six hour per week schedule in shifts to be promulgated and established from time to time by the City Manager. It is provided, however, that where members of the Department are required to work overtime, such members shall be entitled to additional compensation at straight time rates, based on forty hours per week for special details and assign- ments other than fire and rescue calls, and when required to work overtime on a regular fire fighting company assignment, shall be paid straight time based on the regular fifty -six hour week; Fire Depart- ment Members who are recalled to work at a time other than their scheduled work day shall receive a minimum compensation of $5.00 per call. Firefighters must successfully complete a drill tower approved by the Fire Chief before they are eligible to be rehired to work overtime. (Reso. 3334) 11/85 SECTION 1A4.131 OVERTIME PAY -- RECALL /HOLDOVERS /FORCE HIRES. The uniformed members of the fire service enumerated in this Chapter shall receive time and one -half pay for overtime due to the following: 1) All emergency recall, all emergency holdovers, and platoon hold- 1A4 -13 7/86 I• 0 overs and nonscheduled force hires for the first 150 shifts per fiscal year, and 2) scheduled force hires. A partial year shall be prorated. (Reso. 3405) 7/86 SECTION 1A4.135 DEFERRED COMPENSATION PLAN (ICMA). Fire safety service series personnel are eligible to participate in the City's deferred compensation plan in which the contributions shall be wholly by the employees (i.e. no City contribution). (Reso. 3334) 11/85 SECTION 1A4.140 HOLIDAY PAY - -SHIFT WORK. Fire Department per- sonnel who work shifts and are regularly required to work on holidays notwithstanding any provisions herein to the contrary, shall be paid for one hundred thirty -two hours in lieu of holidays once a year on or about the 10th day of December. Employees who terminate shall be paid holiday pay on a pro rata basis. (Reso. 2685) 2/76 SECTION 1A4.142 HOLIDAY PAY- -SHIFT WORK -- DECEMBER 1982. Effective with the payroll deduction made in Novem- ber, 1985, for coverage in the month of December, 1985, the City shall provide all sworn personnel of the fire service enumerated in Section 1A4.030, a contribution toward the employees' and dependents' dental premiums in a sum up to 900 of the dental insurance premium for an employee and two or more dependents, not to exceed $33.49 per month; provided, however, that employees who have single employee coverage or employees who have employee and one dependent coverage shall be provided with payment of dental premiums in full or a maximum of $33.49 per month, whichever is less. Personnel of the fire service enumerated in Section 1A4.030 who service retire from City employment after December 1, 1985, are eligible to receive a contribution from the City in the sum of up to $50 per month toward the retiree's and up to 1 dependent's medical insurance coverage regardless of whether the medical coverage is a plan offered by the City. In the event the actual medical insurance premium is less than $50 per month, the City shall.pay the actual premium cost. For retirees who continue their City medical coverage, the retiree will remit to the City the difference between the premium 0 cost of their coverage less the $50 per month. For retirees with medical coverage not offered through the City, the retiree shall furnish the City with proof of their medical insurance coverage anytime during the year and be remitted a City check up to $600 for a 12 consecutive month period; coverage for less than a full year shall 0 be compensated on a prorated basis. (Reso. 3405) 7/86 SECTION 1A4.150 SICK LEAVE; LEAVE WITH PAY DUE TO ILLNESS; ACCUMULATION OF SAME; SHIFT WORK. Sick Leave with pay may be granted for an absence from duty because of personal illness, injury, or legal quarantine not compensable under the provisions of the Workers' Com- 1A4 -16 7/86 • 1 L1 pensation Law of the State of California. Permanent employees shall accumulate sick leave at the rate of one eight -hour day accumulation for each month's service not to exceed a maximum of 1056 hours. Members of the Fire Service in the positions enumerated in Section 1A4.030 of this Chapter who work shifts shall accumulate sick leave at the rate of one twelve -hour day accumulation for each month's service, not to exceed a maximum of 1584 hours. Hours worked in addition to a regular work week shall not entitle an employee to additional sick leave accmulation. Sick leave taken by an employee shall be deducted from this accumulated credit. (Reso. 2793) 3/77 SECTION 1A4.150.1 BEREAVEMENT LEAVE -- PERSONAL EMERGENCIES -- IMMEDIATE FAMILY DEFINED. A. Bereavement Leave. Commencing November 51 1985, in the case of death in the "immediate family" of the employee or the employee's spouse, a maximum of three days Bereavement • Leave with pay may be granted per incident. Proof of death may be required before charging an absence to Bereavement Leave. Bereavement Leave shall be distinct from all other leave benefits and may not be accumulated. B. Personal Emergencies - -Use of Eligible Leaves. For other types of personal emergencies, that is, a serious illness of an "immediate family" member of the employee or the employee's spouse and for cases of extreme and unusual hardship of an emergency nature, employees, upon request, shall be entitled to utilize accumulated vacation leave or compensatory time -off, for which prior notification is required; • however, in certain instances notification requirements may be waived. 1A4 -17 7/86 • • L� C. In the event an employee regulated by this chapter, while in the City's employ, service retires under the California Public Employees' Retirement System with unused Sick Leave to his or her credit, he or she shall be compensated in an amount equal to sixty percent (60a) of the value of such Sick Leave based upon his or her salary at the time of retirement, without the inclusion of overtime pay or additional compensation. In the event that an employee regulated by this chapter, while in the City's employ, disability retires under the California Public Em- ployees' Retirement System with unused Sick Leave to his or her credit he or she shall be compensated in an amount equal to one -half the value of such Sick Leave based upon his or her current salary at the time of retirement without the inclusion of overtime pay or additional compensation. Twelve working days per year with full salary for the first seven years of continuous service with the City. 2. Seventeen working days per year with full salary after seven years and until the completion of fourteen years of continuous service. is 3. All or part of these hours may be used for other conferences or seminars with the approval of the City Manager. (Reso. 2778) 7/77 SECTION 1A4.190 UNIFORM AND SAFETY EQUIPMENT ALLOWANCE. Effec- tive August 18, 1984, except as provided in Section 1A4.195 and 1A4.196, fire fighting employees who are required to purchase and continuously maintain prescribed items of uniform clothing, personal equipment, and safety equipment, including a minimum of three uniforms with shoulder patches and one pair of shoes, shall be compensated at the rate of $235.00 per year. is (Reso. 3281) 9/84 SECTION 1A4.195 UNIFORM AND SAFETY EQUIPMENT ALLOWANCE /EXCEPTION. At the time of employment newly appointed fire department personnel shall be advanced a uniform allowance equal to 150 percent of the annual uniform allowance. 2. Upon the first anniversary of appointment newly appointed fire department personnel shall receive payment of a uniform allowance of 50 percent of the annual uniform allowance. 3. At regular intervals thereafter newly appointed fire depart- ment personnel shall receive payment of a uniform allowance prorated at the rate of one - twelth of the annual uniform allowance per month; such intervals shall be no less frequent than three months. If newly appointed firefighters or fire trainees satisfactorily complete a period of one year of service following their appointment, said advance uniform payment shall be deemed a uniform allowance. However, if a firefighter or fire trainee resigns during the first full year of employment, the employee upon termination shall reimburse the City on a pro rata basis, one - twelfth of the advance payment heretofore made for each full month remaining until the first anniversary of the employee's appointment. The amount shall be deducted from any pay otherwise due the employee upon termination of city employment and certification by the Fire Chief to the Director of Finance of the amount to be deducted pursuant to the provisions of this section.
