A RESOLUTION OF THE CITY COUNCIL SEGUNDO, CALIFORNIA, REFERENCING AND CALLING FOR CONSTRUCTION BIDI WHEREAS, the City Council of the "City ") is considering the formation 3358 OF THE CITY OF EL PREVAILING WAGE SCALE 3 City of El Segundo (the of an assessment district, pursuant to the Municipal Improvement Act of 1913, being Division • 12 (commencing with Section 10000) of the California Streets and Highways Code (the "Act "), for the construction of certain public works and improvements and acquisitions, if necessary, generally described as follows: The construction of certain sewerage collection system improvements within the Assessment District and the acquisition of sewerage capacity rights together with rights to service and use from the County Sanitation Districts of Los Angeles County to serve those properties within the Assessment District, including appurtenances and appurtenant work. Specific improvements to be constructed include a force main, gravity sewer and wet well resurfacing /coating in easements and public streets. (the "Improvements "); WHEREAS, the lands to be specially assessed for the Improve- ments shall be included within an assessment district designated ASSESSMENT DISTRICT NO. 73 (SEWER IMPROVEMENTS) (the "Assessment District "); WHEREAS, it is the intention of the City to call for sealed proposals or bids for the work and improvements in the Assessment District; WHEREAS, it is necessary to determine the prevailing rate of wages for the various classifications of workers required in the performance of the work: !, • NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA DOES RESOLVE AS FOLLOWS: SECTION 1. The above recitals and each of them are true and correct. SECTION 2. It is hereby determined and ascertained that the general prevailing rate of per diem wages in the locality • in which said work described is to be performed, together with with appurtenances, in the Assessment District under the .1.46)69 provisions of the Act for each craft or type of worker or mechanic needed to execute the contract, and also the general prevailing rate for legal holiday and overtime work for each craft or type of worker or mechanic, is in accordance with the schedule obtained from the Director of Industrial Relations, pursuant to the provisions of Section 1773 of the California Labor Code, and reference is hereby made to copies thereof on • file with the transcript of these proceedings, which copies are available to any interested party upon request. Further, a copy shall be posted at each job site during the course of construction. SECTION 3. The Superintendent of Streets is hereby authorized and directed to call for sealed bids on the Improvements; the proposals or bids shall be opened and examined at a public meeting so called and the results of the bidding shall be reported to the City at the next regular meeting after the opening of the bids. SECTION 4. The terms and conditions for bidding on the Improvements for the Assessment District are set forth in full in the Specification and Contract Documents as previously approved by the City. Reference is hereby made to the notice hereby approved and identified as follows: NOTICE INVITING BIDS (CONSTRUCTION) ASSESSMENT DISTRICT NO. 73 For all particulars as to bidding, the Notice Inviting Sealed Bids (Construction) above referenced and approved by the City shall govern and all terms and conditions for bidding shall be pursuant to the Act. • SECTION 5. It is hereby determined that in the event the contractor, contracting owners included, does not complete the work within the time limit specified in the contract or within such time limit as the City shall authorize, the contractor or contracting owners, as the case may be, shall pay as liquidated damages the amount or amounts set forth in the specifications • for the Improvements, which provisions and amounts are 2. incorporated herein by reference. It is hereby deemed impractical to determine the actual damage which will be sustained by reason of such delay, but the stated amount is a reasonable amount for liquidated damages and is not being imposed as a penalty. SECTION 9. The City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book • of original resolutions of said city; and shall make a minute of the passage and adoption thereof in the record of the proceedings of the City Council of said city, in the minutes of the meeting at which the same is passed and adopted.
