CC RESOLUTION 3354148148 RESOLUTION NO. 3354 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA MAKING PRELIMINARY DETERMINATIONS CONCERNING THE PROPOSED IMPROVEMENT, THE BOUNDARIES OF THE DISTRICT TO BE SPECIALLY ASSESSED AND CERTAIN OTHER MATTERS AND ORDERING THE PREPARATION OF A REPORT ON THE IMPROVEMENTS IN A SPECIAL ASSESSMENT DISTRICT WHEREAS, the City Council of the City of E1 Segundo, • California (the "City "), pursuant to the provisions of the "Special Assessment Investigation, Limitation and Majority Protest Act of 193111, being Division 4 (commencing with Section 2800) of the California Streets and Highways Code (the "Code "), Improvement Act of 191311, being Division 12 (commencing with Section 10000) of the Code, for the construction and /or acquisition of certain public improvements, the nature, location and extent of which are generally described as follows: The construction of certain sewerage collection system improvements within the Assessment District and the acquisition of sewerage capacity rights together with rights to service and use from the County Sanitation Districts of Los Angeles County to serve those properties within the Assessment District, including appurtenances and appurtenant work. Specific improvements to be constructed include a force main, gravity sewer and wet well resurfacing /coating in easements and public streets. (hereinafter referred to as the "Improvements "); and WHEREAS, the City desires to generally define the boundaries or extent of the district or lands to be specially assessed to pay all or any part of the cost of the Improvements, such district to be designated ASSESSMENT DISTRICT NO. 73 • (SEWER IMPROVEMENTS) (hereinafter referred to as the "Assessment District "); and WHEREAS, the City desires to determine the amount or percentage proposed to be paid toward the cost of the Improvements from any source other than special assessments upon benefited property; and WHEREAS, the City desires to cause a written report upon the Improvements to be prepared and to designate the desires to initiate proceedings for the formation of an assessment district within the City under the "Municipal Improvement Act of 191311, being Division 12 (commencing with Section 10000) of the Code, for the construction and /or acquisition of certain public improvements, the nature, location and extent of which are generally described as follows: The construction of certain sewerage collection system improvements within the Assessment District and the acquisition of sewerage capacity rights together with rights to service and use from the County Sanitation Districts of Los Angeles County to serve those properties within the Assessment District, including appurtenances and appurtenant work. (hereinafter referred to as the "Improvements "); and WHEREAS, the City desires to generally define the boundaries or extent of the district or lands to be specially assessed to pay all or any part of the cost of the Improvements, such district to be designated ASSESSMENT DISTRICT NO. 73 • (SEWER IMPROVEMENTS) (hereinafter referred to as the "Assessment District "); and WHEREAS, the City desires to determine the amount or percentage proposed to be paid toward the cost of the Improvements from any source other than special assessments upon benefited property; and WHEREAS, the City desires to cause a written report upon the Improvements to be prepared and to designate the 14 C)z 407 Superintendent of Streets to employ competent persons to procure such information and prepare the report, which shall contain the information specified under Section 2825 of the Code; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES RESOLVE AS FOLLOWS: SECTION 1. The above recitals and each of them are true • and correct. SECTION 2. Proceedings shall be conducted in compliance with provisions of the "Special Assessment Investigation, Limitation and Majority Protest Act of 1931 ", to initiate proceedings for the construction and /or acquisition of the Improvements, as herein generally described, under the "Municipal Improvement Act of 191311, with the cost of the Improvements to be assessed to the parcels of land within the boundaries of the Assessment District according to the benefit to be received by the respective parcels. SECTION 3. The amount proposed to be paid toward the cost of the Improvements from any source other than special assessments upon benefited property is approximately $274,500, which will be a contribution by the City toward the cost of the Improvements, such contribution to be used to pay a portion of the cost of a force main, gravity sewer and wet well resurfacing /coating. SECTION 4. The preparation of a written report is hereby ordered, such report to contain the information specified in Section 2825 of the Code; a copy of this resolution shall be attached to such report. SECTION 5. The boundaries of the Assessment District shall be as shown on the map or diagram included as part of the report referred to herein. SECTION 6. This resolution shall become effective immediately upon its adoption. SECTION 7. The City Clerk shall certify to the passage and • adoption of this resolution; shall enter the same in the book 2. 0o LJ of original resolutions of said city; and shall make a minute of the passage and adoption thereof in the record of the proceedings of the City Council of said city, in the minutes of the meeting at which the same is passed and adopted.
