CC RESOLUTION 3339RESOLUTION NO. 3339 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DENYING THE APPEAL OF CROCKER NATIONAL BANK FROM THE PLANNING COMMISSION DECISION TO DENY THE APPLICATION FOR UNCLASSIFIED USE PERMIT #84 -2 FOR A HELISTOP AT 2121 EAST PARK PLACE WITHIN SAID CITY. lie WHEREAS, an application was received from Crocker National Bank for an Unclassified Use Permit to establish and operate a rooftop helistop for transport of bank documents, to be located at 2121 East Park Place, a legal description of which is on file in the City Planning Department; and, WHEREAS, the Planning Commission held, pursuant to law, a duly advertised public hearing on such matter in the Council Chamber of the City Hall, 350 Main Street, in the City of El Segundo on August 8, 1985, and notice of said hearing was given in the time, form and manner prescribed by law; and WHEREAS, opportunity was given to all persons to present testimony or documentary evidence for or against proposed Unclass- ified Use Permit #84 -2; and, WHEREAS, the Planning Commission has reviewed a Draft Environmental Impact Report in accordance with the authority and criteria contained in the California Environmental Quality Act, State Guidelines and the City of E1 Segundo Guidelines for the implementation of the California Environmental Quality Act i (Resolution No. 3319); and, WHEREAS, by Planning Commission Resolution No. 2118, the Planning Commission denied Unclassified Use Permit #84 -2; and, WHEREAS, Crocker National Bank filed a timely appeal from the said decision of the Planning Commission; and, WHEREAS, the City Council held, pursuant to law, a duly advertised public hearing on such matter in the Council Chamber of the City Hall, 350 Main Street, in the City of E1 Segundo, on October 15, 1985, and notice of said hearing was given in the J:R- 111985.CB 1458 _ t time, form and manner prescribed by law; and, WHEREAS, opportunity was given to all persons to present testimony or documentary evidence for or against proposed Unclass- ified Use Permit #84 -2; and, WHEREAS, the City Council has reviewed the Draft Environmen- tal Impact Report pursuant to law; and, WHEREAS, at said hearing the following facts were estab- lished: 1. The subject site is zoned C -M, Commercial Manufacturing, and is occupied by a bank operations center; 2. The immediate surrounding property is zoned C -M and M -2, within 300 feet of the proposed helistop; 3. The immediate surrounding land use consists of a planned office park (low to mid - rise), railroad tracks and vacant land; 4. The proposed helistop would be located on top of the operations center building and would be used for rapid and secure transfer of bank documents between local airports and bank branches and the site; 5. The applicant requests approval of up to 15 landing /take- off cycles (flights) per weekday between 4:OO p.m. and 11:30 p.m., with 3 flights between 9:00 p.m. and 10:00 p.m., and one at 11:30 p.m., for a total of up to 600 flight cycles (or operations) per month; and, 6. The subject site is adjacent to and surrounded by residential areas in El Segundo, Lawndale and Manhattan Beach. Each of these areas would be directly affected by helicopter activity to and from the proposed location of the helistop. The use of the helistop would increase the potential for noise and nuisance in such areas, and would also increase safety hazards created by such new use of the subject property; NOW, THEREFORE, BE IT RESOLVED, that after considering the testimony and the facts and after a study of proposed Unclassified Use Permit #84 -2, the City Council finds as follows: 1. There are unique characteristics of the project which 3 :R- 111985.CB '• render the use incompatible with existing development at the subject location and in surrounding areas, in that the proposed helistop will change the nature of the primary use by introducing regularly scheduled air transport operations which would not be considered as accessory or incidental use; 2. The proposed use constitutes an unacceptable level of risk to the public safety and welfare by introducing 600 opera- tions a month into a densely populated commercial area surrounded by residential areas; 3. The proposed use would result in significant adverse noise impacts, on an individual and cumulative basis, given the volume of the proposed use, the potential for multi - jurisdictional impacts, and documented community concern about overall increased helicopter operations; and, 4. There are feasible alternatives available to the project, including landing sites at nearby airports which would be used to substantially meet the intent and purpose of the application. NOT, THEREFORE, BE IT RESOLVED that, in view of the above facts and findings, the City Council hereby denies the appeal of the Planning Commission's denial of Unclassified Use Permit #84 -2. The City Clerk shall certify to the passage and adoption of this resolution shall enter the same in the book of original resolutions of said city; and shall make a minute of the passage and adoption thereof in the record of the proceedings of the City Council of said city, in the minutes of the meeting at which the same is passed and adopted.
