CC RESOLUTION 33360 I• I• RESOLUTION NO. 3336 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, AMENDING SECTIONS 1A2.0101 1A2.0401 1A2.070, 1A2.1001 1A2.1051 1A2.1151 1A2.1301 1A2.1321 AND 1A2.134; RENUMBERING SECTIONS 1A2.1061 1A2.1451 AND 1A2.146; AND ADDING NEW SECTIONS 1A2.1061 1A2.108, AND 1A2.145 OF CHAPTER 1A2 (MANAGEMENT - CONFIDENTIAL SERIES); AND AMENDING SECTIONS 1A6.1401 1A6.150, 1A6.210, AND 1A6.230; AND ADDING SECTION 1A6.141 OF CHAPTER 1A6 (GENERAL RULES) OF TITLE lA OF THE EL SEGUNDO ADMINISTRATIVE CODE. THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES RESOLVE AS FOLLOWS: SECTION 1. Sections 1A2.010, 1A2.0401 1A2.0701 1A2.1001 1A2.1051 1A2.115, 1A2.130, 1A2.132, AND 1A2.134 of CHAPTER 1A2 (MANAGEMENT- CONFIDENTIAL SERIES) of TITLE lA of the E1 Segundo Administrative Code are herewith amended in their entirety to read as per Exhibit "A" attached hereto and incorporated herein by reference as though set forth in full and at length. SECTION 2. Section 1A2.106 of CHAPTER 1A2 (MANAGEMENT- CONFI- DENTIAL SERIES) is hereby renumbered to be a new number 1A2.107. The entire text of old number 1A2.106 is hereby transferred to new number 1A2.107 and shall remain in full force and effect. SECTION 3. Sections 1A2.145 and 1A2.146 of CHAPTER 1A2 (MANAGEMENT- CONFIDENTIAL SERIES) are hereby renumbered to be new numbers 1A2.146 and 1A2.147, respectively. The entire text of old numbers 1A2.145 and 1A2.146 are hereby transferred to new numbers 1A2.146 and 1A2.147, respectively, and shall remain in full force and effect. SECTION 4. Sections 1A2.106, 1A2.108, and 1A2.145 of CHAPTER 1A2 (MANAGEMENT- CONFIDENTIAL SERIES) are hereby added to read as per Exhibit "A" attached hereto and incorporated herein by reference as though set forth in full and at length. SECTION 5. Sections 1A6.140, 1A6.1501 1A6.210, and 1A6.230' of CHAPTER 1A6 (GENERAL RULES) are herewith amended in their entirety to read as per Exhibit "A" attached hereto and incorpora- ted herein by reference as though set forth in full and at length. All resolutions and orders of the City Council heretofore passed and adopted with reference to the same, or any of the matters and subjects hereinabove set forth or referred to, are hereby rescinded insofar as the same conflict with the provisions hereof. SECTION 8. The City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of original resolutions of said city; and shall make a minute of the passage and adoption thereof in the record of the proceedings of the City Council of said city, in the minutes of the meeting at which the same is passed and adopted. MANAGER. The City Manager shall fix salaries of the persons enumerated in Section 1A2.040 of this Chapter. (Reso. 2620) 4/75 1A2 -5 11/85 SECTION 1A2.030 EXPLANATION OF SALARY SCHEDULE QUARTILE SYSTEM. Each salary range enumerated in Section 1A2.010 consists of a minimum and maximum salary that is divided into quartiles which the City Manager may use as practical guides for administrative purposes as follows: First Quartile. Newly hired or promoted employees shall be paid the minimum salary unless they clearly possess unusual qualifications and experience. Second Quartile. Employees meeting the average job requirements shall be paid within the second quartile. Third Quartile. Employees demonstrating above average job per- formance shall be paid within the third quartile. Fourth Quartile. Employees making an outstanding contribution to the City in their jobs shall be paid within the fourth quartile. The foregoing practical guides shall not be construed as restric- tions upon the discretion of the City Council or the City Manager, who in cases they consider appropriate may disregard such practical guides. The control point shall be used to compare salaries in the job market. A salary increase above the control point is recognition of above average service. The City Manager shall evaluate those employees who report directly to him. The remaining Management- Confidential employees shall be evaluated by their department heads. 1A2 -8 11/85 A --).=1 The City Manager shall approve all performance salary adjustments. Criteria for granting salary adjustments shall include but not be limited to: 1. Present salary. 2. Length of service. 3. Quality and quantity of work performed. 4. Increased competence in handling job responsibilities. 5. Attitude and loyalty to City duties. 6. Efforts toward self- improvement. 7. Exceptional performance. (Reso. 2620) 4/75 SECTION 1A2.070 SALARY INCREASES BASED ON PERFORMANCE. Salary increases shall be based on evaluation of an individual's performance and shall acknowledge and reflect the level of job proficiency indi- cated by the employee's performance evaluation; there shall be no automatic step progression and no longevity step increases. Salary increases shall normally be made once each year on or near October 1. Increases may be made at other times on the basis of superior job performance or unusual circumstances. Annual salary adjustments shall be granted predicated on merit and the criteria in Section 1A2.060 as follows: employees rated Satis- factory are eligible to an increase up to the annual across - the -board percent change to the salary ranges; employees rated Above Average and Outstanding are eligible to receive an additional 1 -5% merit increase; and employees rated Below Average or Unsatisfactory are not eligible to receive a pay increase; however, no salary shall fall below the minimum of the salary range assigned to the affected employee's corresponding classification or position. The maximum increase that may be approved by the City Manager for employees whose salaries are above the control point is ten percent in 1A2 -9 11/85 any fiscal year. Increases in excess of ten percent for employees whose salaries are above the control point shall be submitted to the City Council for approval. (Reso. ) 11/85 SECTION 1A2.080 OVERTIME PAY -- EXCEPTION. Management- Confidential employees shall not be paid overtime pay. Fire Battalion Chiefs assigned to Fire Suppression shall be paid straight time rates for time worked on platoon duty or scheduled or non - scheduled re -hires in excess of fifty -six hours per week. (Reso. 2705) 7/76 SECTION 1A2.085 OVERTIME PAY -- EXCEPTION. Notwithstanding Section 1A2.080 of the E1 Segundo Administrative Code, Police Lieutenants shall be paid time and one -half rates for time worked on shift basis in excess of eight hours, or ten hours when assigned to a four -day, ten -hour working schedule, in any one day or more than forty hours per week, excluding hours worked involving hold -over for non -shift work, or work due to staff meetings or training. (Reso. 3216) 7/83 SECTION 1A2.090 RESIDENCE REQUIREMENTS. Within eighteen months following employment or promotion, the City Manager, Chiefs of Police and Fire Departments, City Librarian, Directors of the Finance Department, Building Safety Department, Planning Department, Public Works Department, and Recreation and Parks Department shall live within the El Segundo city limits, except that the City Council may consent to an extended period of residence outside the E1 Segundo city limits. (Reso. 2620) 4/75 1A2 -10 11/85 E k I l e4 SECTION 1A2.100 EXECUTIVE LEAVE. On and after January 1, 1983? Management- Confidential employees shall be granted not less than three and not more than five days executive leave with pay per calendar year which may be used for personal business, attendance at educational courses, or for additional vacation. All Management- Confidential employees receive a minimum of three days per year. In addition, those employees in positions which require more than 40 hours' service (56 hours for Fire Suppression shifts) annually at times other than their normal duty hours shall be granted up to two additional execu- tive leave days with pay if not otherwise directly compensated. Department heads shall determine the number of authorized executive leave days (3, 4 or 5) for eligible employees in their respective departments. Notwithstanding the above department heads shall receive eight days of executive leave with pay per calendar year. Executive leave may not be accrued. Effective with the payroll deduction made for coverage for the month of December, 1985, upon approval of the City Manager, Management - Confidential employees shall be eligible to participate in a Flexible Benefit Plan. A monthly contribution by the City of $285 plus an amount equal to three percent (3%) of each Management - Confidential employee's total pay may be used as follows: 1. Payment of City group health /medical insurance premium; 2. Payment of City group life insurance premium; 3. Payment of City group dental insurance premium; 4. Payment of City group psychological insurance premium; 5. Payment of fitness center memberships, subject to federal and state tax laws; and 6. Taken as salary or other benefits which the employee may elect and which the City Manager approves. This section shall be limited to the requirements of the City's insurance agreements and to once a year unless the City Manager determines that circumstances necessitate otherwise. (Reso. ) 11/85 SECTION 1A2.106 INSURANCE BENEFITS -- SERVICE RETIREE MEDICAL - -CITY CONTRIBUTION. Effective with the insurance premiums drawn in Novem- ber, 1985, for coverage in the month of December, 1985, the City shall provide all Management- Confidential employees who, while in the City's employ, retire under the Public Employees' Retirement System, a I, contribution toward the retiree's and up to one dependent's medical insurance premiums in a sum up to $100 per month regardless of whether the medical coverage is a plan offered by the City. In the event the actual medical insurance premium is less than $100 per month, the City shall pay the actual premium cost. For retirees who continue their 1A2 -12 11/85 City medical coverage, the retiree will remit to the City the dif- ference between the premium cost of their coverage less the $100 per month. For retirees with medical coverage not offered through the City, the retiree shall furnish the City with proof of their medical insurance coverage anytime during the year and be remitted a City check up to $1,200 for a 12 consecutive month period; coverage for less than a full year shall be compensated on a prorated basis. (Reso. ) 11/85 SECTION 1A2.107 INSURANCE BENEFITS -- DISABILITY RETIREE PARTICI- PATION IN CITY'S GROUP MEDICAL INSURANCE PLAN AFTER TEN YEARS' CITY SERVICE. Management - Confidential employees who have been employed continuously by the City for ten years or more may, upon retirement for disability from City employment, participate in the City's group health insurance plan. Each such employee, if he or she elects to participate in the City's group health insurance plan, shall be responsible for and shall pay any premium required to maintain such insurance. Participation in the City's group health insurance program by employees who retire for disability shall be contingent upon acceptance of such employee in the group plan by the insurance carrier. This section shall not apply to any employee who retired prior to December 20, 1983. (Reso. ) 11/ - -85 SECTION 1A2.108 INSURANCE BENEFITS - -LONG TERM DISABILITY (Non -Job Related). Effective with the payroll deduction made for coverage for the month of December, 1985, civilian non -sworn Management- Confiden- tial employees, who do not receive the single highest year retirement calculation formula under PERS, shall be covered by the City under a long term disability insurance plan. (Reso. ) 11/85 1A2 -13 11/85 .6 14 SECTION 1A2.110 ADDITIONAL EMPLOYMENT. A Department Head who is employed full time by the City shall not accept other work or actively participate in the management of a private profit - producing activity outside of his or her employment with the City of E1 Segundo, without first obtaining approval of the City Council, and upon showing that such activity will not conflict with his or her discharge of duties of employment with the City. (Reso. 2620) 4/75 SECTION 1A2.115 EDUCATION EXPENSES -- REIMBURSEMENT. Management- Confidential employees shall, upon an approved application and agree- ment to the provisions of this section, be reimbursed eighty percent of the cost of tuition and books to a maximum of $1,000 per calendar year for work - related college courses; provided, however, such courses have been approved by the City Manager. Employees voluntarily ter- minating employment with the City within two months from completion of coursework shall have deducted from their final pay 100 percent of the amount reimbursed; thereafter, ten percent less than 100 percent shall be deducted from their final pay for each full month worked up to twelve months from the date of the completion of the course. (Reso. ) 11/85 SECTION 1A2.120 DEFERRED COMPENSATION PLAN. A deferred compensa- tion plan has been established as a benefit to Management - Confidential employees. Each Management- Confidential employee is eligible to participate in the plan. (Reso. 2620) 4/75 1A2 -14 11/85 t 0 SECTION 1A2.130 UNIFORM ALLOWANCES. Management- Confidential employees in the Police and Fire Departments who are required to purchase and continuously maintain prescribed items of uniform clothing and personal equipment shall be compensated for a portion of the initial and maintenance costs thereof according to the following: Classification /Position Fire and Police Chiefs Fire Battalion Chief, Police Captains, Non - Patrol Lieutenants Patrol Lieutenants Per Mo. of Active Duty $25.00 $30.00 $40.00 (Reso. ) 11/85 �a SECTION 1A2.131 SICK LEAVE ACCUMULATED FOR PHYSICAL EXAMINATION. The City will allow up to two days of accumulated sick leave each year to be used for purposes of physical examinations, subject to submis- sion of a doctor's verification. (Reso. 3173) 10/82 SECTION 1A2.132 SICK LEAVE AFTER EIGHT YEARS -- PAYMENT OF ONE -HALF ON TERMINATION. In the event an employee to whom this section applies has completed eight or more years of service with the City and resigns or is terminated for any reason other than those enumerated in Section 1A2.134 and 1A6.141 of this title, and has unused sick leave to his or her credit at the time of termination of his or her services, such employee shall be compensated in an amount equal to one -half the value of his or her sick leave based upon his or her current salary at the time of such termination without the inclusion of overtime pay or additional compensation. Employees employed on and after July 6, 1975 shall not be eligible to receive compensation in an amount equal to the value of one -half of their sick leave. Employees who terminate prior to the first day of December while maintaining a balance of more than 1056 hours of sick leave shall also be paid for one -half of their unused accrued sick leave accumulated since the preceding December 1. (Reso. 3173) 10/82 SECTION 1A2.134 SICK LEAVE -- PAYMENT UPON DEATH OR SERVICE RETIRE- MENT. In the event a Management- Confidential employee, while in the City's employ, dies or service retires under the Public Employees' Retirement System with unused Sick Leave to his or her credit, he or 3 she shall be compensated in an amount equal to eighty percent (80 %) of the value of such Sick Leave based upon his or her salary at the time of death or retirement, without the inclusion of overtime pay or addi- tional compensation. The provisions of Sections 1A6.140 and 1A6.150 of the E1 Segundo Administrative Code, as they apply to death or service retirement shall not be applicable to Management- Confidential employees. The provisions of Section 1A6.141 related to disability retirement shall apply to Management- Confidential employees. (Reso. } 11/85 SECTION 1A2.135 SICK LEAVE - -LEAVE WITH PAY DUE TO ILLNESS- -ACCU- MULATION OF SAME. Sick Leave with pay may be granted for an absence from duty because of personal illness, injury, or legal quarantine not compensable under the provisions of the Workers' Compensation Laws of the State of California. Permanent employees shall accumulate Sick Leave at the rate of one eight -hour day accumulation for each month's 1A2 -16 11/85 14ii i service not to exceed a maximum of 1056 hours (for Fire Shift person- nel- -1584 hours). Hours worked in addition to a regular work week shall not entitle an employee to additional Sick Leave accumulation. Sick Leave taken by an employee shall be deducted from his or her accumulated credit. (Reso. 3173) 10/82 SECTION 1A2.136 PHYSICAL EXAMINATIONS. Notwithstanding Section 1A6.270 of the E1 Segundo Administrative Code, Management - Confidential employees shall receive at City expense comprehensive medical exami- nations and recommended further testing, including individual fitness consultation, periodic follow -up monitoring, and "wellness" lectures. Following the implementation year in which all Management- Confidential employees shall receive examinations, the frequency of testing shall be determined by the City doctor and approved by the City Manager. Employees who supply test results from similar timely medical examinations may be waived from the examination provided for herein. (Reso. 3286) 11/84 SECTION 1A2.137 HOLIDAYS AND HOLIDAY PAY. Except as otherwise herein specifically provided, employees shall be entitled to the following holidays: January 1st The third Monday in February The last Monday in May July 4th The first Monday in September November 11th Thanksgiving Day and the Friday thereafter December 24th December 25th December 31st provided, however, (a) that in the event any of the hereinbefore mentioned holidays falls on the last day an employee is off on his or her regular days off period, the following day shall be observed as a 1A2 -17 11/85 A 1' Y 3 holiday for the purpose of this section; provided, further, however, (b) that in the event any of the hereinbefore mentioned holidays falls on the first day of an employee's regular days off period, the pre- vious day shall be considered as a holiday for the purpose of this section. (Reso. 3173) 10/82 SECTION 1A2.137.1 PERSONAL LEAVE /FLOATING HOLIDAY. In addition to the holidays enumerated in Section 1A3.100, each employee who has completed six (6) months of service shall be entitled to select one (1) day per calendar year as a Personal Leave /Floating Holiday with the approval of the employee's supervisor after a minimum of seven (7) days prior notice. (Reso. 3290) 12/84 SECTION 1A2.140 HOLIDAYS AND HOLIDAY PAY -- BATTALION CHIEFS. Battalion Chiefs assigned to fire suppression duty shall be paid for 144 hours in lieu of holidays once a year on or about the 10th day of December. Such Battalion Chiefs who serve in that capacity less than a full year shall be paid holiday pay on a pro rata basis. (Reso. 3178) 12/82 SECTION 1A2.143 HOLIDAYS AND HOLIDAY PAY -- POLICE LIEUTENANTS. Police Lieutenants shall be paid for 96 hours in lieu of holidays once a year on or about the 10th day of December. Employees serving as Lieutenants less than a year shall be paid holiday pay on a pro rata basis. Employees regularly employed shall accumulate vacation time in accordance with the following schedule: 1. Twelve working days per year with full salary for the first seven years of continuous service with the City. 2. Seventeen working days per year with full salary after seven years and until the completion of fourteen years of continuous service. 3. Twenty -two working days per year with full salary after four- teen years of continuous service. (Reso. 3173) 10/82 SECTION 1A2.145 VACATION TIME USE. Management- Confidential employees regularly employed shall accrue vacation time on a monthly basis. Vacation Leaves may be taken only after the employee has completed six months of continuous service with the City. (Reso. ) 11/85 SECTION 1A2.146 VACATION TIME ACCRUAL -- PAYMENT IN LIEU OF. Man- agement-Confidential employees who have completed one year of service may receive cash payment in lieu of accrued vacation time up to a maximum of one -half the annual accrual to which they are entitled by length of service. Notwithstanding the provisions of Section 1A6.220, employees on temporary industrial disability may accrue vacation time for longer than two years. (Reso. ) 11/85 SECTION 1A2.148 BEREAVEMENT LEAVE -- PERSONAL EMERGENCIES--IMME- DIATE FAMILY DEFINED. A. Bereavement Leave. Commencing June 28, 1980, in the case of death in the "immediate family" of the employee 1A2 -19 11/85 l.f ;43 3 or the employee's spouse, a maximum of three days Bereavement Leave with pay may be granted per incident. Proof of death may be required before charging an absence to Bereavement Leave. Bereavement Leave shall be distinct from all other leave benefits and may not be accumulated. B. Personal Emergencies - -Use of Eligible Leaves. For other types of personal emergencies, that is, a serious illness of an "immediate family" member of the employee or the employee's spouse and for cases of extreme and unusual hardship of an emergency nature, employees, upon request, shall be entitled to utilize accumulated vacation leave,Z_ compensatory time -off, or Personal Leave Day /Floating Holiday, for A which prior notification is required; however, in certain instances notification requirements may be waived. C. Immediate Family Defined. For the purpose of this section, "immediate family" shall mean spouse, child, mother, father, or sibling. (Reso. ) 11/85 SECTION 1A6.150 SICK LEAVE ACCRUED -- PAYMENT OF ON DEATH. In the event an employee regulated by lAl, 1A3, 1A4 and 1A5, while in the - City's employ, dies with unused Sick Leave to his or her credit, his or her estate shall be compensated in an amount equal to one -half the value of such Sick Leave based upon his or her current salary at the time of his or her death without the inclusion of overtime pay or additional compensation. (Reso. ) 11/85 1A6 -7 11/85 14570 SECTION 1A6.170 WORKERS' COMPENSATION PROVISIONS. Permanent employees who are members of the Public Employees' Retirement System and who receive injuries that are compensable under the California Workers' Compensation Laws (other than those to whom the provisions of Section 4850 of the Labor Code apply) shall be entitled to receive: 1. Seventy -five percent of the employee's regular salary for any so- called waiting period provided for in the Workers' Compen- sation Laws. 2. Thereafter, for a period of up to one year, until earlier retirement on disability pension or a finding of permanent and stationary disability by a medical doctor, the difference' between seventy -five percent of the employee's regular monthly A, salary and the amount of any temporary disability payments under the Californiia Workers' Compensation Laws. Such pay- ments shall cease when the employee receives a permanent disability award or is physically able to return to work. (Reso. 3006) 7/80 SECTION 1A6.180 WORKERS' COMPENSATION PAYMENTS RECEIVED. The City manager in preparing demands for compensation under the provisions of the Workers' Compensation Laws of the State of California may require the employee concerned to submit to said City Manager evidence satis- factory to such City Manager showing the amount of Workers' Compensa- tion payments received by such employee (exclusive of medical, surgical, hospitalization, appliances, or similar items of costs). In many instances it may be impossible prior to the time payrolls are regularly approved, to determine various amounts which may here- after become payable under the provisions of the Workers' Compensation Laws of the State of California to various employees due to a variety of reasons and causes; such, for example, as delays which may occur in the fixing of compensation amounts in Industrial Accident cases, or the failure of the employee to monthly or promptly receive his Workers' 1A6 -8 11/85 145 71 Compensation allowances, etc. In all such cases, the City shall be under no obligation to make to the employee the payments provided for in said workers' Compensation Laws until such time as such matters can be properly determined. The City Manager may present to the City Council any and all problems which may arise in the administration of the provisions hereof, and the City Council reserves the right to consider such problems and to determine the same and make such adjust- ments and orders as may be necessary and proper in the premises. (Reso. 2620) 4/75 SECTION 1A6.190 PHYSICAL EXAMINATIONS. The City Council reserves the right, to be exercised in its discretion, at any time and from time to time at the expense of said City, to require any employee to appear before any duly licensed physician or surgeon selected by the City Manager and submit to a medical and physical examination with respect to his or her illness, injury or disability. The failure or refusal of any such employee to submit himself to any such examination may, in the discretion of the said Council, forfeit any further rights to receive Sick Leave disability benefits or compensation under the provisions of this resolution. (Reso. 2620) 4/75 SECTION 1A6.200 PHYSICAL EXAMINATIONS -- WRITTEN REPORT. The written report of any such physician or surgeon to said Council may be examined by said Council, the City Manager, and City Attorney of said City but shall otherwise be confidential; provided, however, that the same may be introduced in evidence in any action or proceeding relative to the subject of illness, injury or disability of the patient or 1A6 -9 11/85 1 f.�-) 7 2 person referred to therein and such physician or surgeon may give testimony respecting the subject of such examination and the physical condition of the employee therein referred to, and each employee of said City accepting employment, by accepting such employment and rendering service thereunder, does hereby automatically and accordingly so agree. (Res. 2620) 4/75 SECTION 1A6.210 VACATION TIME ACCRUAL -- VACATION LEAVE AFTER ONE YEAR'S SERVICE. Employees regularly employed and regulated by Chapters 1A3, 1A4 and 1A5 shall accrue Vacation Time on a monthly basis. Vaca -=# tion Leaves may be taken only after an employee has completed one T year's continuous service with the City. (Reso. ) 11/85 SECTION 1A6.220 VACATION TIME ACCUMULATED. Vacation Time shall be accumulated from date of last continuous permanent employment. All vacations shall be taken at such times as are agreeable to the head of the department and approved by the City Manager. Earned vacations shall not be accumulated for a longer period than for two years' service. (Reso. 2620) 4/75 SECTION 1A6.230 JURY SERVICE. Officials and employees regulated by Chapters lAl, 1A2, IA3 and 1A4 of this Code shall not be entitled to jury duty leave pay unless and until State or Federal jury commis- sioners change, amend, alter, or otherwise rescind their present policy of granting exemptions from jury service to persons who do not receive 1A6 -10 11/85 0 M� l jury duty pay from their employer. 14n773 If the commissioners require jury service despite the absence of jury duty pay from such employer, then the City's practice of paying the City's full salary if jury pay is returned to the City shall be reinstated effective immediately upon the first implementation of such changed exemption policy. In the event an employee is called to jury duty, and wishes to serve, accrued vacation leave time or a leave of absence without pay shall be granted subject to scheduling requirements by the City. In the event that the City's practice of paying the City's full salary if jury pay is returned to the City is reinstituted pursuant to the aforementioned provisions, the provision for unpaid jury duty leave shall be considered null and void.
