A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL

DELETING SECTION 1A4.038; AND ADDING SECTIONS

1A4 (FIRE SAFETY SERIES); AND AMENDING SECTIONS
1A6.140 AND 1A6.230 OF CHAPTER 1A6 (GENERAL RULES)
OF TITLE lA OF THE EL SEGUNDO ADMINISTRATIVE CODE.
THE CITY COUNCIL OF THE CITY OF EL SEGUNDO,
CALIFORNIA, DOES RESOLVE AS FOLLOWS:
SECTION 1. Sections 1A4.010, 1A4.0201 1A4.0251 1A4.030,
1A4.032, 1A4.0351 1A4.0361 1A4.0801 1A4.1301 1A4.1451 and
1A4.150.1 of CHAPTER 1A4 (FIRE SAFETY SERIES) of TITLE lA of the
E1 Segundo Administrative Code are herewith amended in their
entirety to read as per Exhibit "A" attached hereto and incorpor-
ated herein by reference as though set forth in full and at
length.
SECTION 2. Section 1A4.038, "Firefighter Trainee Compensa-
tion" is herewith deleted in its entirety.
SECTION 3. Sections 1A4.085, 1A4.1351 1A4.148, and 1A4.155
of CHAPTER 1A4 (FIRE SAFETY SERIES) are hereby added to read as
per Exhibit "A" attached hereto and incorporated herein by
reference as though set forth in full and at length.
SECTION 4. All resolutions and orders of the City Council
heretofore passed and adopted with reference to the same, or any
of the matters and subjects hereinabove set forth or referred
to, are hereby rescinded insofar as the same conflict with the
provisions hereof.
SECTION 5. The City Clerk shall certify to the passage and
adoption of this resolution; shall enter the same in the book of
original resolutions of said city; and shall make a minute of
the passage and adoption thereof in the record of the proceedings
of the City Council of said city, in the minutes of the meeting
at which the same is passed and adopted.

FIRE SAFETY SERVICE SERIES
SECTION 1A4.010 BASIC SALARY SCHEDULE - -PEAS 20 AT 50. Except as
hereinafter specifically provided and subject to the other provisions
of this resolution, each employee in the fire service enumerated in
this Chapter, other than those participating in the Educational In-
centive Pay Program who was employed before April 3, 1982, shall be
entitled to receive for his or her services in his or her position the
applicable rate of compensation shown in the following basic salary
48 schedule prescribed for the class in which his or her position is
allocated, for the period commencing July 6, 1985, to wit:

SECTION 1A4.020 EDUCATIONAL INCENTIVE PAY SALARY SCHEDULES - -PERS
2% AT 50. (A) Commencing July 6. 1985, uniformed members of the
fire service enumerated in this Chapter, who have obtained a Fire
Science Certificate or successfully completed 20 units of college
level courses in Fire Science who were employed before April 3, 1982,
shall upon completion of the initial probationary period be compen-
sated for their services at the grade and step to which they are
entitled by classification and length of service, in accordance with
the following salary schedule:

SECTION 1A4.032 SPECIAL ASSIGNMENT. Firefighters temporarily
assigned as Inspector or to other special assignments which may be
approved by the City Manager from time to time, shall be compensated
at a range and step equal to thirteen percent above the range and step
of the classification to which they are entitled by length of service
and performance.

SECTION 1A4.035 SPECIAL ASSIGNMENT -- PARAMEDIC. Firefighters
assigned to paramedic training level or paramedic service shall
receive an additional salary over and above their current range and
step in the classification to which they are entitled by length of
service and performance as follows:
1. While assigned to the trainee level, five percent;
2. During their first year of paramedic service, eight percent;
3. During their second year of paramedic service, ten percent;
4. After two years of paramedic service, thirteen percent.

SECTION 1A4.036 FIREFIGHTER COMPENSATION /PROBATIONARY PERIOD.
_ Fire service employees shall be appointed to the position of Fire -
fighter, compensated at Step A of the range assigned to Firefighter in
the Basic Salary Schedule for the first six months from their date of
hire, and be on probation during the first eighteen months from their
date of hire.

SECTION 1A4.070 EDUCATIONAL INCENTIVE PAY -- MAXIMUM LONGEVITY.
The combined total of the educational incentive pay and longevity pay
for uniformed members of the Fire Department may not exceed seventeen
percent (17 ranges) of Step E of the salary range set forth in Section
1A4.010 of this Chapter.

SECTION 1A4.080 EDUCATIONAL INCENTIVE PAY BASIC SALARY SCHEDULE-
STEP ADVANCEMENT. The advancement of a new employee from Step A shall
be on the new employee's anniversary date which is established as the
day immediately following satisfactory completion of his first six
months' service; Steps B. C. and D (E for Firefighters only) or in the
case of uniformed members of the Fire Department entitled to the
Educational Incentive Pay, Steps B -6, C -6, and D -6 (E -6 for Fire-
fighters only); B -7. C -7, and D -7 (E -7 for Firefighters only); or B -8,
C -8, and D -8 (E -8 for Firefighters only) of the Educational Incentive
Pay Program Salary Schedules) contemplate one year's service in each
of such classification subject to the limitations of Section 1A4.120
of this Chapter and the advancements therefrom shall be on the anni-
versary date of the employee; Step F (or F -6, F -7, and F -8) for
Firefighters and E (or E -6, E -7, and E -8) for Fire Engineers and Fire
Captains contemplates continued service in such classification until
further advancement is indicated by reason of longevity. Members of
the Fire Department employed on and after July 1, 1974 shall not be
eligible to receive longevity benefits.

SECTION 1A4.085 EDUCATION REIMBURSEMENT. Fire safety service
series employees hired on and after July 1, 1974, shall receive $250
for each job related course (3 -unit semester or 4 -unit quarter system)
completed at an accredited college, university, or California State
Fire Academy accredited state or regional class taken during the
employee's non -work hours in which a minimum "C" grade is received in
the course. The employee is required to obtain the prior written
approval of the Fire Chief for the course. The maximum reimbursement
an employee can receive in any calendar year period is $1,000.

SECTION 1A4.090 LONGEVITY ACHIEVEMENT. Steps X, Y and Z of the
Basic. Salary Schedule (in the case of uniformed members of the Fire
Department entitled to the Educational Incentive Pay, Steps X -6, Y -6
and Z -6; Steps X -7, Y -7 and Z -7; or Steps X -8, Y -8 and Z -8 of the
Firefighters Educational Incentive Pay Program Salary Schedules) are
longevity provisions and are to be used in applying the following
policy: Upon attaining seven years of continuous service with the
City, an employee shall be compensated at Step X (or X -6, X -7 or X -8);
upon attaining fourteen years of continuous service with the City, an
employee shall be compensated at Step Y (or Y -6, Y -7 or Y -8); and upon
attaining twenty -one years of continuous service with the City, an
employee shall be compensated at Step Z (or Z -6, Z -7 or Z -8); pro-
vided, however, that employees may be paid at a higher level than the
foregoing schedule when necessary to comply with the requirements of
Section 1A6.090 of this Title and provided that the uniformed members
of the Fire Department shall be subject to the further limitations

SECTION 1A4.120 STEP INCREASES ON MERIT- -BASIC SALARY SCHEDULE.
An employee will be eligible for advancement to a higher step on the
basis of service time as described in Section 1A4.080 and satisfactory
performance of duties. An employee will be presumed to merit an
increase unless his Department Head notifies the Personnel Officer in
writing at least ten days in advance of the scheduled increase that
the increase should be withheld, stating reasons. The reasons shall
be provided to the employee in writing. If the employee's performance
subsequently improves to a satisfactory level, the step increase will
3 be granted and the date of increase will become the employee's anni-
versary date.

SECTION 1A4.130 OVERTIME PAY. Except as otherwise herein pro-
vided, the members of the Fire Department shall work on a fifty -six
hour per week schedule in shifts to be promulgated and established
from time to time by the City Manager. It is provided, however, that
where members of the Department are required to work overtime, such
members shall be entitled to additional compensation at straight time
rates, based on forty hours per week for special details and assign-
ments other than fire and rescue calls, and when required to work
overtime on a regular fire fighting company assignment, shall be paid
straight time based on the regular fifty -six hour week; Fire Depart-
ment Members who are recalled to work at a time other than their
scheduled work day shall receive a minimum compensation of $5.00 per
call. Firefighters must successfully complete a drill tower approved
by the Fire Chief before they are eligible to be rehired to work
overtime.

SECTION 1A4.131 OVERTIME PAY -- RECALL /HOLDOVERS. Effective
December 12, 1981, the uniformed members of the fire service enumer-
ated in this Chapter shall receive time and one -half pay for overtime
due to the following: All emergency recall, all emergency holdovers,
and platoon holdovers and nonscheduled force hires for the first 150
shifts per fiscal year. A partial year shall be prorated.

SECTION 1A4.135 DEFERRED COMPENSATION PLAN (ICMA). Fire safety
service series personnel are eligible to participate in the City's
deferred compensation plan in which the contributions shall be wholly
by the employees (i.e. no City contribution).

SECTION 1A4.140 HOLIDAY PAY - -SHIFT WORK. Fire Department per-
sonnel who work shifts and are regularly required to work on holidays
notwithstanding any provisions herein to the contrary, shall be paid
for one hundred thirty -two hours in lieu of holidays once a year on or
about the 10th day of December. Employees who terminate shall be paid
holiday pay on a pro rata basis.

SECTION 1A4.142 HOLIDAY PAY - -SHIFT WORK -- DECEMBER 1982. Effec-
tive December, 19821 Fire Department personnel who work shifts and are
regularly required to work on holidays notwithstanding any provision
herein to the contrary, shall accumulate and be paid for one hundred
forty -four hours in lieu of holidays once a year on or about the 10th
of December. Employees who terminate shall be paid holiday pay on a
pro rata basis.

• SECTION 1A4.145 INSURANCE BENEFITS -- EMPLOYEE DENTAL /MEDICAL.
(A) Medical. Effective with the payroll deduction made in November,
1985, for coverage in the month of December, 1985, the City shall
provide all sworn personnel of the fire service enumerated in Section
1A4.030, a contribution toward the employees' and dependents' medical
premiums in a sum up to 90% of the indemnity medical insurance premium
for an employee and two or more dependents, not to exceed $202.00 per
month; provided, however, that employees who have single employee
coverage or employees who have employee and one dependent coverage
shall be provided with payment of medical premiums in full or a
maximum of $202.00 per month, whichever is less.
-k' (B) Dental. Effective with the payroll deduction made in Novem-
ber, 1985, for coverage in the month of December, 1985, the City shall
provide all sworn personnel of the fire service enumerated in Section
1A4.030, a contribution toward the employees' and dependents' dental
premiums in a sum up to 90% of the dental insurance premium for an
employee and two or more dependents, not to exceed $33.49 per month;
provided, however, that employees who have single employee coverage or
employees who have employee and one dependent coverage shall be
provided with payment of dental premiums in full or a maximum of
• $33.49 per month, whichever is less.

SECTION 1A4.148 INSURANCE BENEFITS -- SERVICE RETIREE MEDICAL.
Effective with the insurance premiums drawn in November, 1985, for
coverage in the month of December, 1985, the City shall provide all
sworn personnel of the fire service enumerated in Section 1A4.030 who,
• while in the City's employ, retire under the Public Employees' Retire-
ment System, a contribution toward the retiree's and up to one de-
pendent's medical insurance premiums in a sum up to $50 per month

regardless of whether the medical coverage is a plan offered by the
City. In the event the actual medical insurance premium is less than
$50 per month, the City shall pay the actual premium cost. For
retirees who continue their City medical coverage, the retiree will
remit to the City the difference between the premium cost of their
coverage less the $50 per month. For retirees with medical coverage
not offered through the City, the retiree shall furnish the City with
proof of their medical insurance coverage anytime during the year and
be remitted a City check up to $600 for a 12 consecutive month period;
coverage for less than a full year shall be compensated on a prorated
basis.

SECTION 1A4.150 SICK LEAVE; LEAVE WITH PAY DUE TO ILLNESS;
ACCUMULATION OF SAME; SHIFT WORK. Sick Leave with pay may be granted
for an absence from duty because of personal illness, injury, or legal
quarantine not compensable under the provisions of the Workers' Com-
pensation Law of the State of California. Permanent employees shall
accumulate sick leave at the rate of one eight -hour day accumulation
for each month's service not to exceed a maximum of 1056 hours.
. Members of the Fire Service in the positions enumerated in Section
1A4.030 of this Chapter who work shifts shall accumulate sick leave at
the rate of one twelve -hour day accumulation for each month's service,
not to exceed a maximum of 1584 hours. Hours worked in addition to a
regular work week shall not entitle an employee to additional sick
leave accumulation. `Sick leave taken by an employee shall be deducted
from his accumulated credit.

SECTION 1A4.150.1 BEREAVEMENT LEAVE -- PERSONAL EMERGENCIES --
IMMEDIATE FAMILY DEFINED. A. Bereavement Leave. Commencing
November 5, 1985, in the case of death in the "immediate family" of
the employee or the employee's spouse, a maximum of three days
Bereavement Leave with pay may be granted per incident. Proof of
death may be required before charging an absence to Bereavement
Leave. Bereavement Leave shall be distinct from all other leave
benefits and may not be accumulated.
B. Personal Emergencies - -Use of Eligible Leaves. For other types
of personal emergencies, that is, a serious illness of an "immediate
family" member of the employee or the employee's spouse and for cases
of extreme and unusual hardship of an emergency nature, employees,
upon request, shall be entitled to utilize accumulated vacation leave
or compensatory time -off, for which prior notification is required,
however, in certain instances notification requirements may be
waived.
C. Immediate Family Defined. For the purpose of this section,
"immediate family" shall mean spouse, child, mother, father, or
sibling.

SECTION 1A4.155 SICK LEAVE -- PAYMENT UPON SERVICE RETIREMENT. In
the event an employee regulated by this chapter, while in the City's
employ, service retires under the Public Employees' Retirement System
with unused Sick Leave to his or her credit, he or she shall be com-

SECTION 1A4.169 VACATIONS - -FORTY HOUR WEEK. The members of the
Fire Department in the positions enumerated in Section 1A4.030 of this
Chapter who work forty hours a week shall accumulate vacation time in
accordance with the following schedule:
1. Twelve working days per year with full salary for the first
seven years of continuous service with the City.
2. Seventeen working days per year with full salary after seven
years and until the completion of fourteen years of continuous
service.
3. Twenty -two working days per year with full salary after four -
teen years of continuous service.

unused Sick Leave to his or her credit he or she shall be compensated
in an amount equal to one -half the value of such Sick Leave based upon
his or her current salary at the time of retirement without the
inclusion of overtime pay or additional compensation.

SECTION 1A6.150 SICK LEAVE ACCRUED -- PAYMENT OF ON DEATH. In the
event an employee, while in the City's employ, dies with unused Sick
Leave to his or her credit, his or her estate shall be compensated in

or her current salary at the time of his or her death without the
inclusion of overtime pay or additional compensation.

SECTION 1A6.170 WORKERS' COMPENSATION PROVISIONS. Permanent
employees who are members of the Public Employees' Retirement System

and who receive injuries that are compensable under the California
Workers' Compensation Laws (other than those to whom the provisions of
Section 4850 of the Labor Code apply) shall be entitled to
receive:
1. Seventy -five percent of the employee's regular salary for any
so- called waiting period provided for in the Workers' Compen-
sation Laws.

SECTION 1A6.210 VACATION TIME ACCRUAL -- VACATION LEAVE AFTER ONE
YEAR'S SERVICE. Each officer and employee regularly employed shall
accrue Vacation Time on a monthly basis. Vacation Leaves may be taken
only after an employee has completed one year's continuous service with
the City.

SECTION 1A6.220 VACATION TIME ACCUMULATED. Vacation Time shall be
accumulated from date of last continuous permanent employment. All
vacations shall be taken at such times as are agreeable to the head of
the department and approved by the City Manager. Earned vacations
shall not be accumulated for a longer period than for two years'
service.

SECTION 1A6.230 JURY SERVICE. Officials and employees regulated
by Chapters lAl, 1A2, 1A3 and 1A4 of this Code shall not be entitled to
jury duty leave pay unless and until State or Federal jury commis-
sioners change, amend, alter, or otherwise rescind their present policy
of granting exemptions from jury service to persons who do not receive

jury duty pay from their employer. If the commissioners require jury
service despite the absence of jury duty pay from such employer, then
the City's practice of paying the City's full salary if jury pay is
returned to the City shall be reinstated effective immediately upon the
first implementation of such changed exemption policy. In the event an
employee is called to jury duty, and wishes to serve, accrued vacation
leave time or a leave of absence without pay shall be granted subject
to scheduling requirements by the City. In the event that the City's
practice of paying the City's full salary if jury pay is returned to
the City is reinstituted pursuant to the aforementioned provisions, the
provision for unpaid jury duty leave shall be considered null and
void.

SECTION 1A6.240 ACCEPTANCE OF GRATUITIES. Officers and employees
of the City are enjoined against accepting any form of gratuity from
any person with whom they are transacting or have transacted City
business on behalf -of the City of E1 Segundo. By this, all personnel
are admonished not to accept anything of value where such transfer of
value can be construed as a favor or an inducement in any manner
affecting their decisions in the discharging of City business.
