RESOLUTION NO. 3329
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
EL SEGUNDO, CALIFORNIA, GRANTING AN APPEAL OF THE
PLANNING COMMISSION DECISION REGARDING CONDITIONAL
USE PERMIT NO. 85 -2 FOR RETAIL SALE OF BEER AND
WINE, WITH CERTAIN CONDITIONS.
WHEREAS, an application was received by the City of El
Segundo Planning Department for consideration by the Planning Commi-
ssion by Joe Q. Babb for a Conditional Use Permit to permit 24 -hour
retail sales, including beer and wine, at an existing service station
located at 101 S. Sepulveda Boulevard, a legal description of which
is on file in the Planning Department; and,
WHEREAS, on July 11, 1985, the Planning Commission did hold
a public hearing on such application; and,
WHEREAS, on July 25, 1985, the Planning Commission did adopt
its Resolution No. 2114, a copy of which is attached hereto as Exhibit
"A" and incorporated herein by reference as though set forth in full
and at length, which Resolution granted Conditional Use Permit No,
85 -2 but deleted beer and wine sales therefrom as a condition of approval;
and,
WHEREAS, on-August 2, 1985, applicant, Joe Q. Babb appealed
the decision of the Planning Commission in granting Conditional Use
Permit No. 85 -2 where said beer and wine sales were deleted as a
condition of approval of said Conditional Use Permit; and,
WHEREAS, on Spetember 17, 1985, the City Council did
hold, pursuant to law, a duly advertised public hearing on such
matter in the Council Chamber of the City Hall, 350 Main Street, in
the City of E1 Segundo, California, and opportunity was given to all
persons to present testimony or documentary evidence for or against
said Conditional Use Permit No. 85 -2 as adopted by the Planning
Commission through its Resolution No. 2114; and,
WHEREAS, at said public hearing the City Council considered
the findings of the Planning Commission as reflected in its Resolution
No. 2114;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SEGUNDO,
CALIFORNIA, DOES RESOLVE AS FOLLOWS:

SECTION 1. Condition number l of Conditional Use Permit
No. 85 -2 as enumerated in Planning Commission Resolution No. 2114 is
hereby stricken to allow for the sale of beer and wine.
SECTION 2. The City Council of the City of E1 Segundo
hereby imposes the following additional conditions to be added to
the Planning Commission condition and made a part of Conditional Use
Permit No. 85 -2 as modified and granted by the Planning Commission:
9. No beer or wine shall be sold after 11:00 p.m.
'• 10. No person under the age of 21 years shall be permitted
to sell beer or wine.
11. No loitering shall be permitted on the property at
any time by any person or persons.
12. The applicant and any or all successors -in- interest
shall enforce the conditions of this Conditional Use Permit No. 85 -2;
and a one year status review shall be held before the City Council
on or about October 1, 1986, for further consideration of the effect-
iveness of Conditional Use Permit No. 85 -2.
The remaining terms and provisions of Conditional Use Permit No. 85 -2
shall remain in full force and effect as specified in Planning Commi-
ssion Resolution No. 2114.
SECTION 3. The City Clerk shall certify to the passage
and adoption of this resolution; shall enter the same in the book of
original resolutions of said city; and shall make a minute of the
passage and adoption thereof in the records of the proceedings of
the City Council of said city, in the minutes of the meeting at which
the same is passed and adopted.
PASSED, APPROVED and ADOPTED this 1st day of October, 1985.
