CC RESOLUTION 33069 • I43RS RESOLUTION NO. 3306 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA., APPROVING THE INCLUSION OF THE UNITED STATES DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT (HUD) REGULATIONS FOR AFFIRMATIVE ACTION PLANS (SECTION 135.70; 24 CFR 135) IN THE CITY OF EL SEGUNDO COMMUNITY DEVELOP- MENT BLOCK GRANT CONSTRUCTION BIDS AND CONTRACTS AND ADOPTING SAID AFFIRMATIVE ACTION PLAN FOR COMMUNITY DEVELOPMENT BLOCK GRANT CONSTRUCTION BIDS AND CONTRACT USE. WHEREAS, the City of El Segundo is a recipient of funds allocated to cities from the Community Development Block Grant (CDBG) program; and, WHEREAS, in order to utilize said funds, compliance with the United States Department of Housing and Urban Development (HUD) regulations for Affirmative Action Plans as found in Section 135.70 . (24 Code of Federal Regulations 135) is necessary; and, WHEREAS, in order to comply with said HUD Affirmative Action Plan requirements, cities must agree to include the HUD regu- lations in all construction bids and contracts utilizing CDBG funds; and in addition, cities must adopt said regulations for use in all construction bids and contracts utilizing CDBG funds; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SEGUNDO DOES RESOLVE AS FOLLOWS; SECTION 1. The City of E1 Segundo does hereby approve for inclusion in all CDBG construction bids and contracts the Affirma- tive Action Plan attached hereto as Exhibit "A" and incorporated herein by reference; and does hereby adopt said Affirmative Action Plan for such construction bids and contract uses. SECTION 2. The City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of original resolutions of said city; and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said City in the minutes of the meeting at which the same is passed and adopted. This Section 3 Affirmative Action Plan for emplovment and business opportun- ities has been prepared by the City of El Secaundo pursuant to Section 135.70 of the, U.S. Department of Housing_ ana Groan Development (HUD) regu- lations set forth in �4 CFP. 135. 2. PURPOSE_ The purpose of this plan is to comply with HUD's Section 3 requirements so that to the greatest extent feasible. opportunities for employment and training shall be given to lower income residents of Community Development Block Grant (CDBG) project areas, and that contracts for work in connection with such projects be awarded to businesses located in or are owned in sub- stantial part by project area re_idents. 3. AFFIRMATIVE AC71ON STEPS. a. To facilitate compliance with Section 3 requirements for CDBG funded construction con- tracts, the Citv shall initiate the following actions to insure utilization of lower income project area residents as employees or trainees. (1) The Citv shall require prospective bidders for each construction contract to submit with their bid= an affirmative action plan which, at a minimum: (a) Establishes goals for utilizing project area residents and businesses. The City shall require the bidder to provide a preliminary statement of work force needs together with the affirmative action plan. • (b) Delineates steps taken or to be taken to accomplish goals. (c) Delineates steps which have been taken or will be taken to secure the cooperation of subcontractors and unions in meeting the goals. (2) The City shall develop and maintain a directory of service organizations, job referral agencies, and manpower training programs operating within the city or servicing project area residents. The City shall provide a copy of this directory to the contractor for use in recruiting needed labor. (3) The Citv shall require the prime contractor and every subcontractor associated with a CDBG funded project to: (a) Make a good faith effort to employ or train lower income project area residents through use of local advertising media, signs placed at the project site, and notification of emoloy- ment opportunities to labor unions, community and service organizations, schools, and public or private institutions. (b) Maintain a file of lower income project area residents who applied for emplovment • or training on their own or on referral from anv source, and the action taken. (c) In order for a contra ctor /subcontr actor to establish that he has made a good faith " effort to employ or train lower income project area residents, he shall, as a minimum, provide. evidence that he has: I EXHIBIT "A" - -Page 1 of 2 =- D 14391 1. Attempted to recruit from the project area through use of local advertising media, signs placed at the project site, and notification to labor unions, community and service organizations, schools, and public or private institutions operating within or serving the project area. 2. Maintained a list of lower income project area residents who applied for employ - ment or training, and the action taken. • b. To increase the utilization of businesses located in or owned in substantial part by persons residing in the project area, the City shall initiate the following actions. (1) At the beginning of each CDBG program year, the City shall set forth the approximate number and dollar value of contracts proposed to be awarded to all businesses within each category, (type of profession) over the duration of the project. (2) The City shall develop a list of business concerns within the project area doing business in professions or occupations identified as needed, and shall provide a copy of the list to contract - tors upon contract award. (3) The City shall advertise for bids in news media sources serving the project area. (4) The City shall send invitations to bid to appropriate project area businesses identified in paragraph 3 b (2), above. (5) The city shall require contractors to contact project area contractor organizations or organizations likely to yield project area contractors for referral of prospective contractors. (o) The City shall require each contractor /subcontractor to make a goad faith effort to award contracts to businesses located in or are owned in substantial part by project area residents. or provide evidence that a good faith effort has been made. (i) The City shall require each contractor/ subcontractor to maintain a file of all business concerns located in the city who submitted a bid for work on the project, and the action taken with respect to each bid. C. The City shall require each contractor /subcontractor to send a notice of the contractor's Section 3 commitment to labor organizations and representative of workers. d. The City shall require each contractor /subcontractor to incorporate the Section 3 Clause provisions in all subcontracts, and require subcontractors to submit a Section 3 Affirmative Action Plan. e. The City shall require the prime contractor, upon completion of the project, to submit a report to the city identifying lower income project area residents who were employed or trained at the project, and project area business concerns utilized on the project. f. The City shall make a good faith effort to award a fair share of contracts to minority business enterprises and to women's business enterprises by including such firms on solicitation • lists.
