RESOLUTION NO, 3300
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
EL SEGUNDO, CALIFORNIA, AUTHORIZING THE DESTRUCTION
OF CERTAIN RECORDS IN THE EL SEGUNDO POLICE DEPART-
MENT
WHEREAS, there is presented to the City Attorney the
following Inter- Departmental Correspondence for approval and
forwarding to the City Council:
"February 15, 1985
TO: Leland C. Dolley, City Attorney
FROM: J. Clark Devilbiss, Chief of Police
SUBJECT: Destruction of Records
In accordance with the provisions of Section 34090 of the
California Government Code and the record retention schedule
as outlined in the Police Department Records Destruction Manual,
we are requesting that a resolution be prepared for Council
approval for the destruction of the following records:
1. Citizen complaints against police department personnel
where the complaint was filed prior to January 1, 1980.
Destruction of these complaints is not in conflict with
California Penal Code Sec. 832.5(b), as all complaints and
any reports or findings relating thereto do not fall
within the 5 -year retention period.
2. Peace Officer Standards & Training reimbursement requests
for the period 1962 through June, 1982. The retention
period for these records as required by the Commission
on P.O.S.T. is three fiscal years (Current plus two prior).
3. C -Files C -3351 through C -3750
These files contain police clearance letters, enter-
tainment permit investigations, escort statement, parade
permits, and other miscellaneous correspondence from 1974
through 1979.
4. Petty cash records from 1973 through 1982.
5. Reports of witness fees in civil cases from 1972 through
1982.
6. Traffic accident sales receipts from 1971 through 1975.
All of the foregoing records are not required for the operation
of the Polic%/Department.

In accordance with the provisions of Section 34090 of the
Government Code of the State of California, the City Attorney

WHEREAS, the City Council finds that the records herein-
above referred to are of no further value to the City of E1
Segundo, and that they occupy badly needed storage space; and,
WHEREAS, the City Attorney has, in accordance with the
provisions of Section 34090 of the Government Code of the State
of California, consented to the destruction of said records
and documents;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL
SEGUNDO, CALIFORNIA, DOES RESOLVE AS FOLLOWS:
SECTION 1. The Chief of Police is hereby authorized
and granted authority to dispose of the hereinabove described
and set forth records by causing the same to be destroyed in
a lawful. manner.
SECTION 2. Upon destruction of the foregoing records,
the Chief of Police shall make a certificate of complete destruc-
tion of said records and file the original of the same in the
office of the City Clerk and file a copy of said certificate
together with a certified copy of this resolution in his /her
office.
SECTION 3. The City Clerk shall certify to the adoption
of this resolution and thenceforth and thereafter, the same shall
be in full force and effect.
PASSED, APPROVED and ADOPTED this 5th day of March, 1985.
