CC RESOLUTION 328914 e3 R 9 RESOLUTION NO. 3289 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, CONCURRING IN THE FINDINGS AND DETERMINATIONS OF THE CITY PLANNING COMMISSION AS SET FORTH IN ITS RESOLUTION NO. 2090, GRANTING THE APPEAL FOR A VARIANCE AT 617 AND 621 VIRGINIA STREET, EL SEGUNDO, CALIFORNIA, AND ACCORDINGLY GRANTING APPROVAL OF VARIANCE NO. 84 -2 THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA DOES RESOLVE AS FOLLOWS: WHEREAS, an application was received for a variance to increase the permitted lot coverage by 16% on residential lots at 617 and 621 Virginia Street, El Seaundo, California; a legal description of which is on file in the Planning Department; and, WHEREAS, said application for a variance was thereupon and thereafter duly, regularly and lawfully processed and heard by the Planning Commission on two occasions, July 12, 1984 and again on September 13, 1984; and, WHEREAS, after such processing and hearings, the Planning Commission did duly and regularly, at its meeting held September 27, 1984, adopt its Resolution No. 2086, denying approval of Variance No. 84 -2; and, WHEREAS, an appeal in writing from the decision of the Planning Commission was duly and regularly filed with the City Council within the time required by law; and, WHEREAS, the City Council did, thereafter, regularly, and lawfully process and hear the matter of said application at a public hearing held October 16, 1984, on the action of said Commission in denying the approval of Variance No. 84 -2, and the appeal thereon; and, WHEREAS, the City Council, at said public hearing, referred the matter back to the City Planning Commission for its recon- sideration; and, 14340) WHEREAS, on November 8, 1984, the City Planning Commission held a public hearing on the matter, and, on November 29, 1984, adopted its Resolution No. 2090, recommending to the City Council that said Variance No. 84 -2 be granted, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the City Council does hereby adopt the findings and determination with reference to said Variance No. 84 -2 that were made by the Planning Commission and as set forth in its Resolution No. 2090. SECTION 2. That the City Council does hereby sustain the determination and action of the Planning Commission with reference to the application of the Applicant and grants the appeal of the Applicant. SECTION 3. That the City Council does hereby grant said request for Variance No. 84 -2, subject to all of the following conditions as enumerated in Planning Commission Resolution No. 2090: 1. Guest parking to be marked and fully accessible from Virginia Street at all times; 2. Overhead, secure storage areas for each unit be provided over each parking stall; 3. All entrances and exits of each unit must be solely through the central courtyard; 4. The side yards of the building running east /west be increased to 7 feet, which will be fenced to provide private open space to each ground floor unit; - 2 - 14341 5. No access to the side yards of the east /west buildings shall be permitted except through the individual units; 6. Balconies shall not be constructed on exterior perimeter walls.. Balconies which face interior courtyard shall not extend beyond exterior walls; 7. All common areas are to be fully landscaped and main- tained at all times; 8. All mechanical operations in common areas, including the water fountain, are to be clean, maintained and fully operational at all times; 9. A landscaping plan of the site shall be submitted and approved by the Director of Planning and the Director of Parks and Recreation; 10. All west facing windows or glass openings above the first floor level must be designed or constructed of materials so as to prevent the observation of the yards in an R -1 Zone; and 11. The applicant shall comply with all Fire Life Safety conditions as required by the Fire Chief. FURTHER that according to the E1 Segundo Municipal Code, any permit or variance granted by the Planning Commission becomes null and void if not exercised within the time specified in the permit or variance or, if no date is specified, within one year from the date of approval of the permit or variance. SECTION 4. That one copy of this Resolution shall be for- warded to the Applicant at the address shown upon the applica- tion, and one copy shall be attached to the file in the case and returned to the Planning Commission for permanent filing. - 3 - SECTION 5. That the City Clerk shall certify to the passage and adoption of this Resolution; shall enter the same in the book of original resolutions of said City, and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said City, in the minutes of the meeting at which the same is passed and adopted.
