CC RESOLUTION 3286* 0 u RESOLUTION NO. 3286 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, AMENDING SECTIONS 1A2.010, 1A2.040, 1A2.105, AND 1A2.136 OF CHAPTER 1A2 (MANAGEMENT- CONFIDENTIAL SERIES) AND AMENDING SECTION 1A6.230 (GENERAL RULES) OF TITLE lA OF THE EL SEGUNDO ADMINISTRATIVE CODE. THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES RESOLVE AS FOLLOWS: SECTION 1. Sections 1A2.010, 1A2.040, 1A2.105, and 1A2.136 of CHAPTER 1A2 (MANAGEMENT- CONFIDENTIAL SERIES) of TITLE lA of the E1 Segundo Administrative Code are herewith amended in their entirety to read as per Exhibit "A" attached hereto and incorporated herein by reference as though set forth in full and at length. SECTION 2. Section 1A6.230 of CHAPTER 1A6 (GENERAL RULES) of TITLE lA of the E1 Segundo Administrative Code is herewith amended in its entirety to read as follows: "SECTION 1A6.230 JURY SERVICE. Except as provided below, employees absent for jury service with the approval of their Department Heads, shall be entitled to, and receive, full salary upon showing absence occur- ring by reason thereof, and paying to the City the amount of jury fees received by them for such absence. Officials and employees regulated by lAl and 1A2 Chapter of this Code shall not be entitled to jury duty leave pay unless and until State or Federal jury commissioners change, amend, alter, or otherwise rescind their present policy of granting exemptions from jury service to persons who do not receive jury duty pay from their employer. If the commissioners require jury service despite the absence of jury duty pay from such employer, then the City's practice of paying the City's full salary if jury pay is returned to the City shall be reinstated effective immediately upon the first imple- mentation of such changed exemption policy. In the event an employee is called to jury duty, and wishes to serve, accrued vacation leave time or a leave of absence without pay shall be granted subject to scheduling re- quirements by the City. In the event that the City's practice of paying the City's full salary'-if jury pay is returned to the City is reinstituted pursuant to the aforementioned provisions, the provision for unpaid jury duty leave shall be considered null and void." SECTION 3. All resolutions and orders of the City Council heretofore passed and adopted with reference to the same, or any of the matters and subjects hereinabove set forth or referred to, are hereby rescinded insofar as the same conflict with the provisions hereof. 14.x`? The City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of original resolutions of said city; and shall make a minute of the passage and adoption thereof in the records of the proceed- ings of the City Council of said city, in the minutes of the meeting at which the same is passed and adopted. Effective with the payroll deduction made for coverage for the month of December, 1984, upon approval of the City Manager, Management - Confidential employees shall be eligible to participate in a flexible benefit package. A monthly contribution by the City of $250 plus an amount equal to three percent (3 %) of each Manage- ment-Confidential employee's total pay may be used as follows: -2- 1. Payment of City group health /medical insurance premium; 2. Payment of City group life insurance premium; 3. Payment of City group dental insurance premium; 4. Payment of City group psychological insurance premium; 5. Payment of fitness center memberships, subject to federal and state tax laws; and 6. Taken as salary or other benefits which the employee may elect and which the City Manager approves. This section shall be limited to the requirements of the City's insurance agreements and to once a year unless the City Manager determines that circumstances necessitate otherwise. SECTION 1A2.136 PHYSICAL EXAMINATIONS. Notwithstanding Section 1A6.270 of the El Segundo Administrative Code, Management - Confidential employees shall receive at City expense comprehensive medical examinations and recommended further testing, including individual fitness consultation, periodic follow -up monitoring, and "wellness" lectures. Following the implementation year in which all Management - Confidential employees shall receive exami- nations, the frequency of testing shall be determined by the City doctor and approved by the City Manager.
