CC RESOLUTION 32771.4296 RESOLUTION NO. 3277 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, PROVIDING FOR INCREASED COMPENSATION AND BENEFITS FOR CERTAIN EMPLOYEES OF THE FIRE SERVICE. WHEREAS, representatives of the City Manager of the City of El Segundo, California, met and conferred in good faith with representatives of the E1 Segundo Fire Fighters Association; and WHEREAS, when said representatives of the parties were unable to reach agreement on a Memorandum of Understanding in negotiations, they endeavored to resolve their impasse through mediation; and WHEREAS, the parties were unable to resolve the nego- ,.nation impasse through mediation; and WHEREAS, the City, at the conclusion of mediation, submitted alternative last, best and final proposals to the El Segundo Fire Fighters Association; and WHEREAS, the E1 Segundo Fire Fighters Association has rejected said alternative last, best and final proposals for a Memorandum of Understanding; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES HEREBY FIND AND RESOLVE that the representatives of the City have exhausted good faith efforts to reach an agreement with representatives of the E1 Segundo Fire Fighters Association on a proposed Memorandum of Understanding; and that the following increases in wages and benefits for employees in the fire fighting unit are fair, equitable and in the best interests of the City: SECTION 1. Notwithstanding the provisions of the El Segundo Administrative Code, upon and after August 18, 1984, persons assigned to the positions of: Fire Captain Fire Engineer Fire Fighter II Fire Fighter I Fire Trainee shall be compensated above the monthly rates established in the E1 Segundo Administrative Code for those positions at a rate equal to four and three - fourths percent (4 -3/4 %) above the sum -1- fixed in the E1 Segundo Administrative Code, computed so as to continue to provide the existing percentage of City payment of the employees' share to PERS. SECTION 2. Notwithstanding the provisions of the E1 Segundo Administrative Code, effective for the month of August, 1984, fire fighting employees who are required to purchase and continuously maintain prescribed items of uniform clothing, personal equipment, and safety equipment, including, but not limited to, a minimum of three uniforms with shoulder patches and one pair of shoes, shall receive the uniform and safety equipment allowance referred to in Paragraph 1 of Section 1A4.190 of the E1 Segundo Administrative Code at the rate of $235 per year (an additional $55). SECTION 3. Notwithstanding Section 1A6.020.3 of the E1 Segundo Administrative Code, effective August 18, 1984, positions enumerated in Section 1A4.030 shall be paid based on fifty -six hour work week while working a fifty -six hour per work week schedule; and shall be paid based on a forty hour work week while working a forty hour per work week schedule. In compensation for this change, monthly pay shall be increased by five and one -half percent (5.5 %), which shall be in addition to, but not compounded on to, the adjustment provided for in Section 1 herein. SECTION 4. Effective August 18, 1984, persons in positions enumerated in Section 1A4.030 of the E1 Segundo Administrative Code who are unable for any reason to work a trade of shift shall be required to compensate the City for the same number of hours as the City paid to provide coverage for the missed shift, i.e. either straight time or time and one -half. SECTION 5. All resolutions and orders of the City Council heretofore passed and adopted with reference to the same, or any of the matters and subjects hereinabove set forth or referred to, are hereby rescinded insofar as the same conflict with the provisions hereof. SECTION 6. The City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of original resolutions of said City; and shall make a minute of -2- 1_29 the passage and adoption thereof in the records of the proceed- ings of the City Council of said City, in the minutes of the meeting at which the same is passed and adopted.
