CC RESOLUTION 3272RESOLUTION NO. 3272 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, AMENDING SECTIONS 1A5.010, 1A5.020, 1A5.023, 1A5.0251 1A5.033, 1A5.050, lA5.055, 1A5.150 AND 1A5.240 OF CHAP- TER 1A5 (POLICE SAFETY SERVICE SERIES), ADDING SECTIONS 1A5.031 AND 1A5.155 TO CHAPTER 1A5 (POLICE SAFETY SERVICE SERIES), AND AMENDING SECTIONS 1A6.080 AND 1A6.290 (GENERAL RULES) OF TITLE lA OF THE EL SEGUNDO ADMINISTRATIVE CODE. THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES RESOLVE AS FOLLOWS: SECTION 1. Sections 1A5.010, 1A5.020, 1A5.023, 1A5.025, 1A5.033, 1A5.0501 1A5.055, 1A5,150 and 1A5.240 of CHAPTER 1A5 (POLICE SAFETY SERVICE SERIES) of TITLE lA of the E1 Segundo Administrative Code are herewith amended in their entirety to read as per Exhibit "A" attached hereto and incorporated herein by reference as though set forth in full and at length. SECTION 2. Sections 1A5.031 and 1A5.155 of CHAPTER 1A5 (POLICE SAFETY SERVICE SERIES) of TITLE lA of the El Segundo Admini- strative Code are herewith added to read as per Exhibit "A" attached hereto and incorporated herein by reference as though set forth in full and at length. SECTION 3. Section 1A6.080 of CHAPTER 1A6 (GENERAL RULES) of TITLE lA of the El Segundo Administrative Code is herewith amended in its entirety to read as follows: "SECTION 1A6,080 TEMPORARY SERVICE IN HIGHER CLASSIFICATION. In any case where an employee is qualified for and is required for an appreciable period of time to serve temporarily in and have the responsibility for work in a higher class or position, when approved by the City Manager, such employee, while so assigned, shall receive the entrance salary rate of that class or whatever step thereof that is not less than five percent above his or her present rate, whichever is higher. For the purpose of this section, "appreciable period of time" is defined as thirty consecutive working days (twenty -four Page One ,a? s7 working days if on Four /Ten Plan) or longer for department and division heads and ten consecutive working days (eight working days if on Four /Ten Plan) or longer for all other classifications." SECTION 4. Section 1A6.290 of CHAPTER 1A6 (GENERAL RULES) of TITLE lA of the El Segundo Administrative Code is herewith amended in its entirety to read as follows: "SECTION 1A6.290 OVERTIME PAY -- COMPENSATORY TIME. Except as specifically provided in other Chapters of this Administrative Code, employees may substitute Compensatory Time for overtime pay if approved by the City Manager; provided, however, the accumulation does not exceed twenty - four hours; thirty hours for employees assigned to a four -day ten -hour working schedule; and does not exceed three working days at any one time. No more than eighty hours may be accumulated or used in any one calendar year. Compensatory Time may be used in conjunction with normal Vacation Leave with prior approval of the City Manager. No more than three consecutive days for Compensatory Time may be used at any one time." SECTION 5. All resolutions and orders of the City Council heretofore passed and adopted with reference to the same, or any of the matters and subjects hereinabove set forth or referred to, are hereby rescinded insofar as the same conflict with the provisions hereof. SECTION 6. The City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of original resolutions of said city; and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said city, in the minutes of the meeting at which the same is passed and adopted. All other calculations shall be based on this new amount. Other steps within the range shall be calculated by multiplying or dividing the nearest step to the one being calculated by 1.05, e.g. D = E : 1.05; = E x 1.05. Other ranges shall be calculated by multiplying or dividing E step in the known range by the percent separation from the range being calculated, e.g. range 685 E step = 685 D x 1.05, 685 D = 685 E : 1.05. No rounding shall be performed until all calculations are com- pleted; the amounts then shall be rounded to the nearest four decimal points. SECTION 1A5.033 POLICE OFFICER TRAINEE -- COMPENSATION Police Officer Trainees shall be compensated at eighty percent of the rate of pay of Police Officer Step "A" of the Basic Salary Schedule. Not- withstanding the above, a Police Service Officer who is appointed to the position of Police Officer Trainee shall continue to receive his /her former rate of pay as a fixed amount as long as it exceeds the salary to which he /she would otherwise be entitled based on job performance and length of service as a Police Officer Trainee. The affected employee's salary shall change to the appropriate salary range for his /her classification upon that salary being more than the aforementioned frozen (Y- rated) salary. (Reso. 3272) 8/84 SECTION 1A5.050 MOTORCYCLE HAZARD PAY. Effective July 11, 1981, members of the police service assigned to motorcycle duty shall, while serving in such capacity, be paid motorcycle hazard pay in the sum of $175.00 per month above the range and step of the Police Officer classification to which they are entitled by length of service and performance, except whenever any affected employee has been absent because of a disability resulting from an illness or injury occurring outside of the course and scope of his /her employment for a period of thirty consecutive calendar days, the City may, commencing the thirty - first consecutive day of such absence, terminate any motorcycle hazard pay bonus to which the employee would have been entitled had he been pay bonus to which the employee would have been entitled had he been performing his regular duties. A Police Sergeant assigned to ride a motorcycle shall, while serving in such capacity, be paid motorcycle -5- 1 12,73 0 hazard duty pay at 50% of the amount paid a Police Officer serving in a similar capacity. All termms and conditions governing the receipt of such pay for Police Officers also shall apply to a Police Sergeant. (Reso.3272) 8/84 SECTION 1A5.055 FIELD TRAINING OFFICER PAY. Effective July 7, 1884, Police Officers who are assigned by the Police Chief as Field Training Officers to train probationary Police Officers shall, while assigned as a Field Officer or performing duties related to the Police Officer Trainee Program such as preparing or updating trainee program manuals as approved by the Chief of Police, be paid the sum of $104.50 per month above the range and step of the Police Officer classifica- tion to which they are entitled by length of service and performance; provided, however, that when such assignment continues during only part of a pay period, the special allowance provided by this section shall be prorated. (Reso.3272 ) 8/84 SECTION 1A5.150 OVERTIME PAY. Except as otherwise hereinafter provided, the members of the Police Department of said City shall work regularly scheduled shifts to be promulgated and established from time to time by the City Manager. It is provided, however, that where a member of the Police Department is required to render more than eight hours service, or ten hours service when assigned to a four -day ten - hour working schedule, in any one day or more than forty hours per week, such member shall be entitled to receive and there shall be paid to him additional compensation for such overtime at one and one -half time his or her regular rate of pay. Straight time only will be paid all police personnel entitled to overtime for the following duty assignments: 1. Approved departmental in- service training and specialized training schools, except that: a. Officers promoted in rank and who are required to attend in- service classes to gain the knowledge necessary to perform their new duties and responsibilities of said position, shall not be compensated in overtime pay for the hours spent in training over and above a normal eight - hour day, or a ten -hour day for employees assigned to a four -day ten -hour working schedule; and b. Overtime pay shall not be paid to police personnel who attend a basic recruit school learning the duties and responsibilities of their new career in law enforcement. 2. Staff meetings. U-M 3. Photography work. 4 4. Such other similar duty that may develop in the future. Police officers required to make presentations approved by the Chief of Police to community groups during scheduled off -duty hours will be paid at one and one -half times his or her regular rate of pay. Police officers required to appear in court during scheduled off- duty hours will be paid for a minimum of two hours duty. Police officers entitled to marksmanship compensation who are required to shoot in Manhattan Beach during off -duty hours in order to qualify for marksmanship compensation shall be entitled to be paid one hour at straight time salary rates for each time they are required to shoot, but not in excess of once each calendar month. (Reso. 3272) 8/84 SECTION 1A5.155 OVERTIME PAY -- COMPENSATORY TIME. Compensatory Time may be substituted for overtime pay if approved by the City Manager; provided, however, the accumulation and use of Compensatory Time does not exceed forty hours per employee at any one time. No more than eighty hours may be accumulated or used in any one calendar year. Compensatory Time may be used in conjunction with normal Vacation Leave with prior approval of the City Manager. (Reso. 3272) 8/84 SECTION 1A5.240 UNIFORM AND SAFETY EQUIPMENT ALLOWANCES. Police Department employees who are required to purchase and continuously maintain prescribed items of uniform clothing, personal equipment and safety equipment shall be compensated for a portion of the initial and maintenance costs thereof according to the following: 1. a. Police Officers and Police Sergeants assigned to motor- cycle duty - $565.00 per year or equivalent per month of active duty. b. Police Detectives and others who normally wear civilian clothes on duty, but are required to maintain uniforms - $300.00 per year or equivalent per month of active duty. C. All other Police Officers and Police Sergeants - $445.00 per year or equivalent per month of active duty. (Reso. 3272) 8/84 -7- 1 275 2. Newly appointed Police Officers entering the service of the Police Department under the Lateral Entry Program and newly appointed Police Officers who possess a P.O.S.T. Basic • Certificate shall be provided with uniform allowances at the time of appointment and thereafter as follows: a. At the time of appointment - 150°% of annual allowance. b. At first anniversary of appointment - 50% of annual allowance. C. After first anniversary - 100% of monthly allowance.
