CC RESOLUTION 3245RESOLUTION NO. 3245 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, GRANTING A CONDI- TIONAL USE PERMIT TO ESTABLISH AND OPERATE A TREE FARM ON A SOUTHERN CALIFORNIA EDISON COMPANY EASEMENT. WHEREAS, on September 2, 1983 , R. D. Roy ILfXr` filed an application for a Conditional Use Permit to establish and operate a tree farm on land which is part of an easement granted to the Southern California Edison Company; and WHEREAS, the Planning Commission did, pursuant to law, hold a duly advertised public hearing on such matter in the Council Chamber of City Hall, 350 Main Street, on November 10, 1983; and WHEREAS, at said hearing opportunity was given to all persons to present testimony or documentary evidence for or against the proposed Conditional Use Permit; and WHEREAS, at said public hearing the following facts were established: 1. The proposed tree farm would occupy two sites east of Washington Street; one between Walnut Avenue and Sycamore Avenue, and the other be- tween Pine Avenue and Holly Avenue. 2. Both sites are in the Open Space (O -S) Zone within an existing Southern California Edison Company easement. 3. The applicant proposes to plant about 1,500 trees per acre; a total of approximately 4,500 trees. The farm would be maintained by one employee. There would be no lights and a drip irrigation system would be in- stalled. 4. The Environmental Quality Board reviewed the proposed project at two meetings, on September 27, 1983, and on October 25, 1983, and recom- mended approval of a statement of Negative Declaration with conditions; and WHEREAS, at its regular meeting held December 8, 1983, the Planning Commission determined that the proposed use is consistent with the intent and purpose of the O-S Zone; and WHEREAS, at its regular meeting held December 8, 1983, the Planning Commission adopted its Resolution No. 2057, entitled: r OTtT A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF EL SEGUNDO, CALIFORNIA, ' RECOMMENDING TO THE CITY COUNCIL ADOPTION OF CONDITIONAL USE PERMIT NO. 82 -13, WITH CONDITIONS, FOR A PROPOSED TREE FARM GROWING OPERATION ON A SOUTHERN CALIFORNIA EDISON EASEMENT; and WHEREAS, on December 20, 1983 and January 24, 1984, the City Council duly and regularly conducted its public hearing on said application and gave all persons present in the Council Chamber an opportunity to be heard; I!� NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES RESOLVE AS FOLLOWS: SECTION 1. The City Council does hereby grant the application of R. D. Roy for a Conditional Use Permit to establish and operate a tree farm on two sites in the Open Space (O -S) Zone within an existing Sout hern California Edison easement, subject to the following conditions: 1. No sales, wholesale or retail, are to be conducted on the site. 2. No additional treatment of trees, such as "flocking," will be permitted on -site. 3. No power tools fueled by liquid fuel may be used on -site. 4. No signs of any kind shall be permitted on -site. 5. Garden hoses and fire extinguishers shall be provided as required by the E1 Segundo Fire Department. 6. One agricultural equipment storage shed, not exceeding 200 square feet in floor area and 8 feet in height, shall be permitted on each site. 7. Applicant will assume responsibility for overall security of the two sites, totaling three acres. 8. Applicant will assume responsibility for general property maintenance of the two I• sites, totaling three acres, including repair and maintenance of existing fences. 9. Applicant will file, between January 1, 1988 and February 1, 1988, for City review of compliance with the conditions set forth. 10. All fertilizers and chemicals shall be stored in a Fire Department - approved hazardous materials cabinet facility. i� -2- '111 ) 11. The 20 -foot roadway for the northern site • (between Walnut and Sycamore Avenues) shall be provided with a hammerhead or cul -de -sac so that vehicles may turn around. 12. All activity shall be conducted on the site between the hours of 8:00 a.m. and 4:30 p.m. No activity shall be permitted which creates a noise level in excess of current code estab- lished noise levels in effect at the time of operation. 13. One off - street parking space shall be provided on each site; and this space shall not obstruct passage of the existing dirt roads. 14. No outside lighting is to be installed in conjunction with the tree growing operation., 15. The roadway shall be paved or graveled in accordance with the directives of the Director of Public Works within 50 feet of all property lines. 16. Both sites shall be fenced. Both sites shall be secured when no personnel are on -site. SECTION 2. The City Council has received and considered the Negative Declaration of Environmental Impact, which indicates that there will be no significant environmental impact which will result from the granting of the within Conditional Use Permit; and, further, this Council, after considering the Negative Declaration, hereby finds that the within Conditional Use Permit will have no significant adverse impact on the environment, and hereby approves, adopts and certifies the said Negative Declaration. SECTION 3. The City Clerk of the City of El Segundo is hereby authorized and instructed, pursuant to the requirements of Section 20.74.160 of the "E1 Segundo Municipal Code," to cause a copy of this resolution to be mailed to the applicant and to any other parties requesting notice of the action, and to attach a copy thereof to the Planning Commission's file of said case and to return said file to said Commission for permanent filing. SECTION 4. This resolution shall take effect immediately. SECTION 5. The City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book -3- .14.1 6 1 of original resolutions of said city; and shall make a minute of the passage and adoption thereof in the records of the pro- ceedings of the meeting at which the same is passed and adopted.
