CC RESOLUTION 3217RESOLUTION NO. 3217 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA AMENDING SECTIONS 1A3.025, 1A3.030, 1A3.100, 1A3.125, 1A5.027, and 1A5.028 OF THE EL SEGUNDO ADMINISTRATIVE CODE RELATING TO THE INCLUSION`OF POLICE SERVICE OFFICER AND POLICE CADET IN THE GENERAL GOVERNMENT REPRESENTATION UNIT AND DELE- TION FROM THE POLICE REPRESENTATION UNIT. WHEREAS, the City Council of the City of El Segundo, California, on June 7, 1983, enacted Resolution No. 3208 establishing procedures governing Employer- Employee Organiza- tion Relations; and WHEREAS, in enacting said Resolution No. 3208, pursuant to public hearing, the City Council determined that it was in the public interest to preclude peace officers from being repre- sented by an employee organization which represents employees other than peace officers, and accordingly included an appropri- ate provision in said Resolution No. 3208 to that effect as authorized by state law; and WHEREAS, the employees serving in the classifications of Police Service Officer and Police Cadet, who are not peace officers, as defined, but who were formerly represented by the E1 Segundo Police Officers Association, the organization repre- senting certain of the City's peace officer employees, have requested that their classifications be added to the General Government representation unit, represented by the California League of City Employee Associations, Inc. (CLOCEA), and said request is attached hereto and incorporated herein as Exhibit "A"; and WHEREAS, the City Council has determined that it is in the best interest of the City's employer- employee relations in implementing said Resolution No. 3208 to act favorably on said request; 1 4 w -` !) NOW, THEREFORE THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES RESOLVE AS FOLLOWS: SECTION 1. That regular permanent employees serving in the classifications of Police Service Officer and Police Cadet are hereby included in the General Government Employees' repre- sentation unit. SECTION 2. Section 1A5.027 -- SALARY SCHEDULE -- NON- SWORN POLICE SERVICE OFFICERS of the El Segundo Administrative Code is hereby deleted. SECTION 3. Subsection (B) -- OPERATIONS SERIES -- of Section 1A3.030 of Chapter lA3 of Title lA of the El Segundo Administrative Code is hereby amended to include the position of Police Service Officer, as follows: CLASSIFICATION RANGE NO. Police Service Officer 65 SECTION 4. Notwithstanding any other provisions of the El Segundo Administrative Code, persons employed in the classification of Police Service Officer on July 20, 1983, and thereafter, shall be compensated at Range 65 of the General Government Series effective June 11, 1983. SECTION 5. Section 1A5.028 -- SALARY SCHEDULE -- POLICE CADETS of the El Segundo Administrative Code is hereby deleted. SECTION 6. Section 1A3.025 -- PART -TIME PERMANENT PERSONNEL -- POLICE CADETS is hereby added to the El Segundo Administrative Code, to read as follows: Persons employed in the classification of Police Cadet on July 20, 1983, and thereafter, shall be compensated at the hourly rates of pay for services performed in that capacity, effective June 11,1983, as follows: CLASSIFICATION Police Cadet WAGE RATES STEP I STEP II $5.10 $6.24 0 -2- STEP III $7.29 I /1(11 r) . SECTION 7. Section 1A3.100 -- HOLIDAYS AND HOLIDAY PAY is hereby amended to read as follows: Except as otherwise herein specifically provided, any employee who is required to work on any of the following days that occur on his regular day of employment to wit: January 1st; Thanksgiving Day and The third Monday in February Friday thereafter. The last Monday in May; December 24th July 4th; December 25th and The first Monday in September December 31st November 11th; shall be compensated therefor at the rate of one and one -half times his regular rate of pay in addition to straight time holiday pay; provided, however, (a) that in the event any of the hereinbefore mentioned holidays falls on the last day an 1* employee is off on his regular days off period, the following day shall be observed as a holiday for the purpose of this section, provided further, however, (b) that in the event any of the hereinabove mentioned holidays falls on the first day of an em- ployee's regular days off period, the previous day shall be considered as a holiday for the purpose of this section. All permanent employees who are entitled to receive overtime pay shall be entitled to be off for all City holidays; or, if they are required to work upon a City holiday, shall be entitled to time and one -half for such work. Notwithstanding the above, Police Service Officers who regularly are required to work on holidays, shall be paid for 96 hours in lieu of holidays once a year on or about the 10th day of December. The City may at any time and at its own motion include pay for holidays in the bi- weekly paycheck in which the holiday or holidays fall, and not issue a separate check for holiday pay on or about the 10th day of December for Police Service Officers hired on and after June 11, 1983. -3- 1 4041 SECTION 8. Section 1A3.125 -- INSURANCE BENEFITS is hereby amended to read as follows: Dental /Health /Medical -- July, 1983. Commencing with the insurance premiums drawn for coverage for the month of July 1983, officers and employees to whom this Chapter applies shall receive a total sum of $159.36 per month for the premium cost of employee only dental insurance coverage and health and medical insurance coverage. The difference between the actual cost of the employee only dental insurance coverage and the $159.36 shall be applied toward the payment of the health and medical insurance coverage. Notwithstanding the above, persons employed in the classification of Police Service Officer on June 11, 1983 who received a City contribution toward medical insurance in an amount in excess of that provided to employees in the General Government representation unit shall continue to receive that flat dollar amount until such time as the City's contribution toward medical insurance for other employees in the General Government representation unit at least equals that flat dollar amount. Police Service Officers shall not receive any additional increases in City contributions toward their health insurance coverage until the other employees in the General Government representation unit are eligible to receive a like or greater amount from the City toward their medical insurance premiums. In the event the City's medical insurance premiums are reduced, the City's flat dollar contribution to Police Service Officers for said insurance shall be reduced in proportion to the premium rate reduction. Any increases to the current employee only dental insurance premium shall be deducted from the City's flat dollar contribution to Police Service Officers for medical insurance premiums. -4- 14(,142 SECTION 9. The City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of original resolutions of said city; and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said city, in the minutes of the meetings at which the same is passed and adopted.
