CC RESOLUTION 3205I2gfit RESOLUTION NO, 3205 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, CERTIFYING A NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT, AND ORDERING THE VACATION (SUBJECT TO THE RESERVATION AND EXCEPTION OF CERTAIN EASEMENTS AND RIGHTS -OF -WAY) OF A CERTAIN PORTION OF PINE AVENUE WITHIN SAID CITY AS CONTEMPLATED BY RESOLUTION OF INTENTION NO, 3203. WHEREAS, the Environmental Quality Board of the City of El Segundo, California, on March 8, 1983, conducted an environmental assessment on the proposed vacation of a portion of Pine Avenue within said city; and WHEREAS, the Planning Commission of the City of E1 Segundo, California, on April 14, 1983, held a duly adver- tised public hearing on the proposed vacation of said portion of Pine Avenue; and WHEREAS, at its meeting on April 14, 1983, the Planning Commission of the City of El Segundo, California, adopted its Resolution No. 2020, adopting the Environmental Quality Board's finding that the proposed vacation will not have a significant effect on the environment, and recommending that the City Council certify a Negative Declaration of En- vironmental Impact; and WHEREAS, the City Council of the City of E1 Segundo, California, at its meeting held May 3, 1983, adopted its Resolution of Intention No, 3203, declaring its intention to order the vacation (subject to the reservation and exception of certain easements and rights -of -way) of a certain portion of Pine Avenue within said city; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, pursuant to the provisions of Section 8320 et seq., Chapter 3 of the "Public Streets, Highways and Service Easement Vacation Law ", being Part 3 of Division 9 of the Streets and Highways Code of the State of California, DOES HEREBY RESOLVE, DECLARE, FIND, DETERMINE AND ORDER AS FOLLOWS: U Ic is SECTION 1. That said City Council, after public hearing duly and regularly called, noticed and held, finds and determines from all the evidence submitted, that that certain portion of Pine Avenue within said city described in Resolution of Intention No, 3203 of said Council adopted on the 3rd day of May, 1983, is unnecessary for present or prospective public street purposes. SECTION 2. That the Negative Declaration of En- vironmental Impact referred to in Planning Commission Reso- lution No. 2020, adopted April 14, 1983, is hereby approved, adopted and certified. SECTION 3. That the proposed vacation is within an area for which a general plan has been adopted by the City Council and the City Council has considered the general plan prior to vacating the street. SECTION 4. That the public interest and convenience require, and it is hereby ordered, subject to the reservations and exceptions hereinafter set forth, that the following portion of the following public street within the city, to wit; All those portions of Lots 277, 278, 32.3 and.324, in Block 123, as shown on map of sheet 8, El Segundo, recorded in Book 22, pages 106 and 107 of maps in the office of the County Recorder, County of Los Angeles, State of California, described as follows: The southerly 139.25 feet the northerly 139.25 feet the northerly 139.25 feet the southerly 139.25 feet 25.00 feet of the easterly of said Lot 277, and 25.00 feet of the easterly of said Lot 278, and 25.00 feet of the westerly of said Lot 323, and 25.00 feet of the westerly of said Lot 324 be, and the same is, hereby closed, vacated and abandoned for public street purposes, all as contemplated by Resolution of Intention No. 3203 of the City Council of the City of El Segundo, California, adopted on the 3rd day of May, 1983. Reference is hereby made to said Resolution of Intention No. 3203 and to the map or plan entitled "PORTION OF PINE AVENUE BEING THOSE PORTIONS OF LOTS 277, 278, 323, and 324 PROPOSED TO BE VACATED BY RESOLUTION OF INTENTION NO, 3203"r dM referred to therein, both of which are on file and open to public inspection in the office of the City Clerk in the City Hall of said City, and both of which, by this reference, are incorporated herein and made a part hereof for further par- ticulars. SECTION 5, The City Council does hereby determine that the public convenience and necessity require the reser- vation of certain easements and rights -of -way for structures enumerated in Section 8340 of the Streets and Highways Code of the State of California, and these proceedings are taken subject to such reservations and exceptions, The easements and rights -,of -way hereby reserved and excepted from the vacation are the following, to wit: The permanent easement and right at any time, or from time to time, to construct, maintain, operate, replace, remove, and renew sanitary sewers and storm drains and appurtenant structures in, upon, over and across a street or highway proposed to be vacated and, pursuant to any existing franchise or renewals thereof, or otherwise, to construct, maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits, cables, wires, poles and other convenient structures, equipment, and fixtures for the operation of gas pipelines, telegraphic and telephone lines, railroad lines, and for the transportation or distribution of electric energy, petroleum and its products, ammonia, and water, and for incidental purposes, including access to protect such works from all hazards in, upon, and over the street or highway proposed to be vacated. SECTION 6. That the City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of original resolutions of said city; shall make -3- a minute of the passage and adoption thereof in the records and proceedings of the City Council of said city in the minutes of the meeting at which the same is passed and adopted; and shall cause a certified copy thereof, attested by the City Clerk under the seal of said city, to be recorded in the office of the County Recorder of Los Angeles County, State of California.
