A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF EL SEGUNDO, CALIFORNIA, APPROVING THAT
CERTAIN AGREEMENT BY AND BETWEEN THE CITY OF
EL SEGUNDO AND THE OWNERS OF CERTAIN PROPERTY
LOCATED ON THE NORTHWEST CORNER OF THE INTER -
SECTION OF EL SEGUNDO AND SEPULVEDA BOULEVARDS,
AND MAKING CERTAIN FINDINGS REQUIRED BY THE
CALIFORNIA ENVIRONMENTAL QUALITY ACT.
WHEREAS, the City Council of the City of E1 Segundo,
California, has adopted Resolution No, 3189 which said Reso-
lution No. 3189 is attached hereto and incorporated herein
by reference, and
WHEREAS, said Resolution No. 3189 required the City
staff to meet with the owners of that certain real property
located on the Northwest corner of Sepulveda and E1 Segundo
Boulevards in the city of El Segundo, and
WHEREAS, as a result of such meetings, an "Agreement
to be Recorded Affecting Real PropertytP has been prepared and
signed by the owners, and is herewith presented to the City
Council for its consideration, and
WHEREAS, the said � "Agreement to be Recorded Affecting
Real Property" contains those provisions required by Resolution
No. 3189, and
WHEREAS, the City Council of the City of-E1 Segundo,
California, indicated in said Resolution No. 3189 that it would
not adopt either a Zone Change ordinance or a resolution amend-
ing the Land Use Element of the General Plan unless the City
Council approved an "Agreement to be Recorded Affecting Real
Property" between the City and the owners and could make the
findings required by the California Environmental Quality Act
relating to the implementation of mitigation measures as a
condition of the approval of the project, and
WHEREAS, the "Agreement to be Recorded Affecting Real
Property" between the owners and the City provides that the
said "Agreement to be Recorded Affecting Real Property" shall
not be effective until such time as the City Council adopts
an ordinance changing the zone and a resolution amending the
Land Use Element of the General Plan, and
WHEREAS, the said "Agreement to be Recorded Affecting
Real Property" requires by its terms that it shall be recorded
with the County Recorder of Los Angeles County, and
WHEREAS, it is now the desire of the City Council to
approve the "Agreement to be Recorded Affecting Real Property ";
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL
SEGUNDO DOES RESOLVE AS FOLLOWS,
SECTION 1. The City Council hereby approves the
"Agreement to be Recorded Affecting Real Property" with the
owners as attached hereto.
SECTION 2. The City Council of the City of El Segundo
hereby finds and determines, pursuant to Section 15088 of Title
14 of the California Administrative Code, and pursuant to the
California Environmental Quality Act that, as to each signifi-
cant environmental impact identified in the Environmental
Impact Report, changes and alternatives have been required and
incorporated into the project by virtue of the "Agreement to
be Recorded Affecting Real Property" between the City and the
owners (approved by this resolution) which mitigate and avoid
the significant environmental effects identified in the
Environmental Impact Report.,
SECTION 3. The City Council also hereby finds pursuant
to said Section 15088 that each of the changes or alterations in
the project agreed to in the "Agreement to be Recorded Affecting
Real Property" between the City and the owners have reduced to
an acceptable level the significant environmental effects des-
cribed in the Environmental Impact Report.
SECTION 4. The City Council hereby directs that,
pursuant to its terms, the "Agreement to be Recorded Affecting
Real Property" between the City and the owners shall not be
effective unless and until the City Council approves the ordin-
ance changing the zone (.82 -2) and the resolution amending the
Land Use Element of the General Plan (82 -3).

SECTION 5, The City Council further directs that
the "Amendment to be Recorded Affecting Real Property ",
should it become effective, shall be recorded in the Office
of the County Recorder of Los Angeles County.
SECTION 6, The Mayor is hereby authorized to execute
and the City Clerk to attest the "Agreement to be Recorded
Affecting Real, Property" on behalf of the City.
SECTION 7, The City Clerk shall certify to the
passage and adoption of this resolution; shall enter the same
in the book of original resolutions of said city; and shall
make a minute of the passage and adoption thereof in the records
of the proceedings of the City Council of said city, in the
minutes of the meeting at which the same is passed and adopted,
