CC RESOLUTION 3189I• '0 I!� 0 RESOLUTION NO. 3189 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, APPROVING, ADOPTING AND CERTIFYING THE ENVIRONMENTAL IMPACT REPORT PREPARED WITH RESPECT TO AN APPLICATION FOR AN AMENDMENT TO THE LAND USE ELEMENT OF THE GENERAL PLAN, AND WITH RESPECT TO AN APPLICATION FOR CHANGE OF ZONE, BOTH RELATING TO CERTAIN PROPERTY LOCATED AT THE NORTHWEST CORNER OF EL SEGUNDO AND SEPULVEDA BOULEVARDS WITHIN SAID CITY; AND DIRECTING CERTAIN CITY OFFICIALS TO MEET WITH THE OWNER OF SAID PROPERTY AND THEREAFTER SUBMIT TO THE CITY COUNCIL AN AGREEMENT, WHICH SAID AGREEMENT SHALL INCLUDE PROVISIONS WHICH MITIGATE THE ADVERSE ENVIRONMENTAL IMPACT REPORT FINDINGS. WHEREAS, the Planning Commission of the City of El Segundo has received an application from Mr. John Hessell for an Amendment to the Land Use Element of the General Plan and a Zone Change from M -1 to C -3, both involving property located on the northwest corner of E1 Segundo and Sepulveda Boulevards within said city, more particularly described as follows: Lot 350 except the westerly 25.00 feet and Lot 351 except the westerly 25,00 feet and the southerly 10,00 feet and Lots 352 through 356 except the southerly 10,00 feet; and Lot 357 and Lot 405 and Lots 406 through 408 except the southerly 10.00 feet, Block 123, Sheet 8, El Segundo as recorded in Book 22, Pages 106 and 107 of Maps in the Office of the County Recorder, County of Los Angeles, State of California; and Parcel 3 of Parcel Map No. 7707 as recorded in Book 100, Page 78 of Parcel Maps in the Office of the County Recorder, County of Los Angeles, State of California; and All that portion of vacated E1 Segundo Boulevard (formerly a portion of Lots 409 and 410, Block 123, Sheet 8, El Segundo as recorded in Book 22, Pages 106 and 107 of Maps in the Office of the County Recorder, County of Los Angeles, State of California) lying southwesterly of the northeasterly line of said Lot 410, vacated by Resolution No. 2932, adopted by the City Council of the City of El Segundo on July 3, 1979; and WHEREAS, the Planning Commission has reviewed a draft of the Environmental Impact Report prepared in accordance with said applications in accordance with the authority and criteria contained in the California Environmental Quality Act (CEQA) State Guidelines, and the City of E1 Segundo Guidelines for Implementation of the California Environmental Quality Act (CEQA); and 1 ` q.1A . N WHEREAS, the Planning Commission has, pursuant to law, head a public hearing on such matter; and WHEREAS, at the said public hearing by the Planning Commission, the following facts were established: 1. The site is currently developed with an automobile dealership and service area not in full operation. The existing buildings are one and two stories and in need of repair. 2. The original zoning of the site, adopted in 1947, was M -1 with the exception of the easterly 14,135 square feet fronting Sepulveda Boulevard. This piece was rezoned from Unclassified to C -3 in November, 1981 after the Southern Pacific Railroad abandoned a right -of -way. 3. The intent of the application is to provide commercial type development on the approximately 128,800 square foot site in accordance with the newly adopted standards of the C -3 Zone, Development of the entire 128,000 square foot site under the requested C -3 zoning could yield a maximum of 257,600 square feet of floor area with a height limit of 200 feet; reflecting the 2 to 1 FAR of the zone.. 4. A Draft Environmental Impact ,Report has been prepared assessing the impacts of the maximum potential development on the site under the requested C -3 zoning. 5. The Draft Environmental Impact Report identified significant adverse impacts that require the imposition of mitigation measures in the areas of traffic and circulation, light and glare, noise, and demand for public services; and WHEREAS, the Planning Commission of the City of El Segundo has recommended to the City Council that the General Plan for the City of El Segundo be amended to change the land use designation from Light Manufacturing to Special District Commercial, and to change the Zone from Light Manufacturing (M -1) to Special Commercial District (.0 -3) Zone; and WHEREAS, there has now been presented to the City Council of the City of El Segundo, for its consideration, a resolution changing the Land Use Element designation in the General Plan on the said property from Light Manufacturing to Special District Commercial; and WHEREAS, the City Council of the City of El Segundo has also received, for its consideration, an ordinance changing -2- 1 7`t the Zone from Light Manufacturing (M -1) to Special Commercial District (C -3); and WHEREAS, the Draft Environmental Impact Report identifies significant adverse impacts that require the imposition of miti- gation measures in the areas of traffic and circulation, light and glare, noise, and demand for public services; and WHEREAS, the Draft Environmental Impact Report for the proposed General Plan Amendment and Zone Change is an adequate and complete document which will serve as a basis for conditions upon which final approval of the change of Zone shall be condi- tioned by a Development Agreement between the owner of the property and the City of El Segundo; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES RESOLVE AS FOLLOWS: SECTION 1. The City Council of the City of El Segundo, California, hereby approves, adopts and certifies the Environ- mental Impact Report entitled "Final Environmental Impact Report, Zone Change 82 -2 - General Plan Amendment 82,3" dated January, 1983, SECTION 2. The City Council of the City of El Segundo, California,, hereby finds that the said Environmental Impact Report contains information which requires that the said Zone Change 82 -2 and General Plan Amendment 82 -3 must be conditioned upon certain mitigation measures all as recommended in Resolu- tion 2011 of the Planning Commission of the City of E1 Segundo, California, SECTION 3, The City Council of the City of El Segundo, California, hereby directs the City, its Planning Director and its City Attorney to meet with the applicant and owner(s) of the property for the said Zone Change and General Plan Amendment and develop an agreement with the said owner of the property in which the owner agrees to take such actions as are necessary to mitigate the adverse environmental impacts described in the Environmental Impact Report, _3_. .'� SECTION 4. The agreement shall contain, among other things, language which provides that the mitigation measures shall be applicable to any subsequent owner or lessee of the said property. The agreement shall also require periodic review, and shall contain the conditions recommended to the City Council of the City of E1 Segundo by the Planning Commission in Planning Commission Resolution 2011. The agreement shall also contain such other provisions as shall allow the City of El Segundo to enforce the terms of the agreement. SECTION 5. The City Council of the City of E1 Segundo hereby indicates that it will not adopt the resolution mentioned herein amending the Land Use Element of the General Plan, and will not adopt the ordinance mentioned herein changing the zoning on the subject property from Light Manufacturing (M -1) to Special Commercial District (C -3) until such time as a satis factory Development Agreement is presented to the City Council, which contains such measures as are required to reduce the adverse environmental impacts identified in the Environmental Impact Report. SECTION 6. It is the intention of the City Council to consider the aforementioned Development Agreement and to approve the project by second reading of the Ordinance amending the zone from M -1 to C -3 and by adoption of the Resolution approving an amendment to the Land Use Element and the Land Use Element Map at a future meeting after the Development Agreement is submitted to the City Council, Such approvals shall be considered only after the City Council, by resolution, adopts and approves the Development Agreement mentioned herein, and by the same resolution finds that the approval of the Zone Change and General Plan Amendment are authorized by law under the California Environ- mental Quality Act (.CEQA) and the resolutions of the City of El Segundo implementing the California Environmental Quality Act (CEQA). The said resolution shall contain such findings as are required with respect to the implementation of mitigation measures required by this resolution to be included in the Development Agreement, I - :91.5 SECTION 7. The City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of original resolutions of said city; and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said city, in the minutes of the meeting at which the same is passed and adopted.
