CC RESOLUTION 3173• RESOLUTION NO. 3173 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, AMENDING CHAPTERS lAl (ELECTIVE AND APPOINTIVE OFFICERS) AND 1A2 (MANAGEMENT- CONFIDENTIAL SERIES) OF TITLE lA OF THE EL SEGUNDO ADMINISTRATIVE CODE. THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES RESOLVE AS FOLLOWS: • SECTION 1. On and after October 3, 1981, Sections 1A1.025 and 1A1.050 of Chapter lAl (Elective and Appointive Officers) of Title lA of the "E1 Segundo Administrative Code" adopted by Resolution No. 2620, as amended, are amended to read as follows: SECTION 1A1.025 RATES -- APPOINTIVE OFFICERS /EMPLOYEES. On and after October 3, 1981, each of the officers or employees in the following offices or positions in the service of the City of El Segundo shall be entitled to receive for his or her ser- vice, in his or her office or position, the rate or rates of compensation hereinafter set forth: (A) CITY MANAGER (B) CITY ATTORNEY Regular Pay Deferred Pay Total Pay Regular Pay Deferred Pay Total Pay $4,195.00 per month 305.00 $4,500.00 $2,180.00 per month 153.00 $2,333.00 and, in addition thereto, he shall receive such reasonable additional fees or compensation as the City Council may allow for suits, appearances or proceedings before any court, board, officer or commission in, or before which he has been directed to act or appear, and also when allowed by the Council, extra compensation for bond issues of all kinds and for any service which the Council may deem extra- ordinary: SECTION 1A1.050 BENEFITS APPLICABLE. Except where expressly stated to the contrary, the City Manager and the City Attorney shall receive the employment benefits extended by this title to the Management- Confidential employees. SECTION 2. On and after October 3, 1981, Sections • 1A2.010, 1A2.040, 1A2.105, 1A2.135 and 1A2.150 of Chapter 1A2 of Title lA of the "El Segundo Administrative Code ", adopted by Resolution No. 2620, as amended, are amended to read as follows: SECTION 1A2.010 BASIC SALARY SCHEDULE. Upon ap- proval of the City Manager, Management - Confidential employees shall be eligible to participate in a flexible benefit package. A monthly contibution by the City of $145 plus an amount equal to three percent of each Management - Confidential employee's total pay may be used as follows: -4- 1. Payment of City group health /medical insurance premium; 2. Payment of City group life insurance premium; 3. Payment of City group dental insurance premium; 4. Taken as salary or other benefits which the employee may elect and which the City Manager approves. This section shall be limited to the requirements of . the City's insurance agreements and to once a year unless the City Manager determines that special circumstances necessitate otherwise. Should the employee only dental plan cost increase after October 3, 1981 the monthly contribution made by the City as noted herein should be decreased by the amount of the employee only dental plan cost increase. SECTION 1A2.135 SICK LEAVE; LEAVE WITH PAY DUE TO ILLNESS; ACCUMULATION OF SAME. Sick leave with pay may be granted for an absence from duty because of personal illness, injury, or legal quarantine not compensable under the provisions of the Workers' Compensation Laws of the State of California. Permanent employees shall accumulate sick leave at the rate of one eight - hour day accumulation for each month's service not to exceed a maximum of 1056 hours (for Fire Shift personnel - -1584 hours.) Hours worked in addition to a regular work week shall not entitle an employee to additional sick leave accumulation. Sick leave taken by an employee shall be deducted from his accumulated credit. SECTION 1A2.150 SALARIES AND BENEFITS APPLICABLE. The provisions of this chapter are applicable to Management - Confidential employees enumerated in Section 1A2.040 of this Chapter. SECTION 3. On and after October 3, 1981, Sections 1A2.115, 1A2.131, 1A2.132, 1A2.133, 1A2.137, 1A2.144, 1A2.146, 1A2.147 and 1A2.148 are added to Chapter 1A2 of Title lA of the "El Segundo Administrative Code" to read as follows: SECTION 1A2.115 EDUCATION EXPENSES -- REIMBURSEMENT. Management- Confidential employees shall, upon an approved appli- cation and agreement to the provisions of this section, be reim- bursed eighty percent of the cost of tuition and books to a maximum of $400 per year for work - related college courses; pro - vided, however, such courses have been approved by the City Manager. Employees voluntarily terminating employment with the City within two months from completion of coursework shall have • deducted from their final pay 100 percent of the amount reim- bursed; thereafter, ten percent less than 100 percent shall be deducted from their final pay for each full month worked up to twelve months from the date of the completion of the course. SECTION 1A2.131 SICK LEAVE ACCUMULATED FOR PHYSICAL EXAMINATION. The City will allow up to two days of accumulated sick leave each year to be used for purposes of physical exam- inations, subject to submission of a doctor's verification. -5- SECTION 1A2.132 SICK LEAVE AFTER EIGHT YEARS - PAYMENT OF ONE -HALF ON TERMINATION. In the event an employee to whom this section applies has completed eight or more years of service with the City and resigns or is terminated for any reason other than those enumerated in Sections 1A6.140 and 1A6.150 of this title, and has unused sick leave to his credit at the time of termination of his service, such employee shall be compensated in an amount equal to one -half the value of his sick leave based upon his current salary at the time of such termination without the inclusion of overtime pay or additional compensation. Em- ployees employed on and after July 6, 1975 shall not be eligible to receive compensation in an amount equal to one -half the value of their sick leave. SECTION 1A2.133 SICK LEAVE ACCRUED - PAYMENT ON TER- MINATION PRIOR TO DECEMBER 1. Employees who terminate prior to the first day of December while maintaining a balance of more than 1056 hours of sick leave shall also be paid for one -half of their unused accrued sick leave accumulated since the pre- ceding December 1. SECTION 1A2.137 HOLIDAYS AND HOLIDAY PAY. Except as otherwise herein specifically provided, employees shall be entitled to the following holidays: January 1st Third Monday in February The last Monday in May July 4th The first Monday in September November 11th Thanksgiving Day and the Friday thereafter December 24th December 25th and December 31st provided, however, (a) that in the event any of the hereinbefore mentioned holidays falls on the last day an employee is off on his regular days off period, the following day shall be observed as a holiday for the purpose of this section, provided further, however, (b) that in the event any of the hereinabove mentioned holidays falls on the first day of an employee's regular days off period, the previous day shall be considered as a holiday for the purpose of this section. SECTION 1A2.144 VACATIONS. Employees regularly em- ployed shall accumulate vacation time in accordance with the following schedule: 1. Twelve working days per year with full salary for the first seven years of continuous service with the City. 2. Seventeen working days per year with full salary after seven years and until the completion of fourteen years of continuous service; 3. Twenty -two working days per year with full salary after fourteen years of continuous service. SECTION 1A2.146 VACATION TIME ACCRUAL - -FOR TEMPORARY INDUSTRIAL DISABILITY. Notwithstanding the provisions of Section 1A6.220 employees on temporary industrial disability may accrue vacation time for longer than two years. SECTION 1A2.147 PERSONAL LEAVE /FLOATING HOLIDAY. In addition to the holidays enumerated in Section 1A3.100, each employee who has completed six months of service shall be en- titled to select one day per calendar year as a Personal Leave Day /Floating Holiday with the approval of the employee's super- visor after a minimum of seven days prior notice. ^m I• SECTION 1A2.148 BEREAVEMENT LEAVE - PERSONAL EMER- GENCIES - IMMEDIATE FAMILY DEFINED. A. Bereavement Leave. Commencing June 28, 1980, in the case of a death in the "imme- diate family" of the employee or the employee's spouse, a maximum of three days Bereavement Leave with pay may be granted per incident. Proof of death may be required before charging an absence to Bereavement Leave. Bereavement Leave shall be distinct from all other leave benefits and may not be accumulated. B. Personal Emergencies - -Use of Eligible Leaves For other types of personal emergencies, that is, a serious illness of an "immediate family" member of the employee or the employee's spouse and for cases of extreme and unusual hardship of an emergency nature, employees, upon request, shall be en- titled to utilize accumulated vacation leave, compensatory time - off, or Personal Leave Day /Floating Holiday, for which prior notification is required; however, in certain instances notifi- cation requirements may be waived. C. Immediate Family Defined. For the purpose of this section "immediate family" shall mean spouse, child, mother, father or sibling. SECTION 4. All resolutions and orders of the City Council heretofore passed and adopted with reference to the same, or any of the matters and subjects hereinabove set forth or referred to, are hereby rescinded insofar as the same conflict with the provisions hereof. SECTION 5. That the City Clerk certify to the passage and adoption of this Resolution; shall enter the same in the book of original Resolutions of said City; and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said City, in the minutes of the meeting at which the same is passed and adopted.
