CC RESOLUTION 31710 RESOLUTION NO. 3171 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, AUTHORIZING THE DESTRUCTION OF CERTAIN RECORDS IN THE POLICE DEPARTMENT. WHEREAS, there is presented to this Council the fol- lowing letter: • August 23 1982 Honorable Mayor and City Council City of E1 Segundo California Gentlemen: In accordance with the provisions of Section 34090 of the Government Code of the State of California, I request permission to destroy the following records: POLICE DEPARTMENT RECORDS Citizens complaints against Police Department personnel where the complaint was filed prior to December 31, 1975. POLICE RECORDS SECTION 1. Parking citation copies, 1979 and older 2. Marijuana citations (11357(b)) citations (mandated by State law), 1979 and older. 3. Moving citations, 1979 and older a) original retained by Inglewood Court. 4. Xerox copies of Humane citations,---1979 and older. a) original retained by Inglewood Court. 5. Field Interview cards, 1978 and older. 6. Traffic Incident reports, 1978 and older. 7. Non Injury Traffic Collision reports, 1977 and older. 8. Injury Traffic Collision reports, 1975 and older. 9. Fatal Traffic Collision Reports, 1973 and older. 10. Misdemeanor crime reports, 1976 and older. 11. Felony crime reports, 1974 and older. 12. Complaint reports (informational document), 1979 and older. 13. ICR cards, 1979 and older. 14. R.C.C. activity printouts, 1978 and older. 15. Other non - criminal reports (i.e., lost or found property, etc.), 1978 and older. 16' Non- criminal juvenile detention reports (truant, curfew, runaway, etc), if subject of record is 18 years old. 17. Booking and Identification forms, 1978 and older. a) copy in arrest jacket 18. Copy of warrant transmittals from Inglewood Court, 1977 and older. a) original at Inglewood Court i 19. Copies of cash receipts, 1979 and older. 22. DR (report) numbering logs, 1976 and older. 23. AR (arrest) numbering logs, 1976 and older. 24. Bicycle licenses with an expiration date of 1979 or sooner. 25. EAP receipts issued 1978 or sooner. a) Fire Department now retains EAP slips. 26. Parking default notices, 1979 or prior. a) Original filed at Inglewood Court. b) Parking violations are either adjudicated or dismissed at the end of 18 months. 27. Aircraft noise complaints, 1979 or prior a) Original at City Hall. 28. Bail Account transmittal copies, 1981 and prior. a) Original at City Hall. b) Copy in AR or DR jacket. 29. Monthly statistical reports and copies of arrest registers, 1970 and older. a) original of arrest register retained by the State. 30. Illegal alien, mental custody and misdemeanor violations issued prior to December 31, 1979. 31. Arrests of any kind rejected by the District Attorney or released by the Police Department pursuant to Section 849 of the Penal Code where the arrests rejected by the District Attorney when the rejection occurred prior to December 31, 1979, and where arrestees released pursuant to Section 849 of the Penal Code by the Police Department the release occurred prior to December 31, 1979. 32. Arrests prosecuted as a misdemeanor or the final disposition occurred prior to December 31, 1971. The foregoing records are no longer required for the operation of the Police Department, are not records affecting the title of real property or liens thereon, are not court records, are not required to be kept by statute, are not less than two years old, nor is any entry thereon less than two years old, are not minutes, ordinances or resolutions of the legislative body or of a city board or commission. -2- Respectively submitted, JiLe s o n n � of Poli ce e � Vd In accordance with the provisions of Section 34090 of the Government Code of the State of California, the City Attorney hereby gives his written consent to the destruction of the foregoing records. , 4-7."V Mark C. Allen, Jr. City Attorney WHEREAS, the City Council finds that the records here- inabove referred to are of no further value to the City of El Segundo, and that they occupy badly needed storage space; and WHEREAS, the City Attorney has, in accordance with the provisions of Section 34090 of the Government Code of the State of California, consented to the destruction of said records and documents; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES RESOLVE AS FOLLOWS: SECTION 1. That the Chief of Police is hereby authorized and granted authority to dispose of the hereinabove described and set forth records by causing the same to be destroyed in a lawful manner. SECTION 2. Upon destruction of the foregoing records, the Chief of Police shall make a certificate of complete destruc- tion of said records and file the original of the same in the office of the City Clerk and file a copy of said certificate together with a certified copy of this resolution in his /her office. SECTION 3. The City Clerk shall certify to the adoption of this resolution and thenceforth and thereafter, the same shall be in full force and effect.
