CC RESOLUTION 3118a • RESOLUTION NO. 3118 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, ORDERING THE 17ACATION (SUBJECT TO THE RESERVATION AND EXCEPTION OF CERTAIN EASEMENTS AND RIGHTS- OF--WAY) OF CERTAIN PORTIONS OF SIERRA STREET WITHIN SAID CITY AS CONTEM- PLATED BY RESOLUTION OF IN'T'ENTION NO. 3114 , The City Council of the City of El Segundo, California, . pursuant to the provisions of Section 8230 et seq., Chapter 3 of the "Public Streets, Highways amd Service Easement Vacation Law ", being Part 3 of Division 9 of the Streets and Highways Code of the State of California, DOES HERBY RESOLVE, DECLAREf FIND, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. Said City Council after public hearing duly and regularly called, noticed and held, finds and deter- mines from all the evidence submitted, that that certain portion of Sierra Street within said city described in Resolution of Intention No. 3114 of said Council adopted on the - 15th day of TYRUMRRR , 1981_1 is unnecessary for present or prospective public street purposes. SECTION 2. That the proposed vacation is within an area for which a general plan has been adopted by the City Council and the City Council has considered the general plan prior to vacating the street. SECTION 3. That the public interest and convenience require, and it is hereby ordered, subject to the reservations and exceptions hereinafter set forth, that the following portion of the following public street within the city, to wit: All that portion of Sierra Street as shown on Map of • Sheet 7 El Segundo recorded in Book 22, Pages 54 and 55 of Maps, in the office of the County Recorder, County of Los Angeles, State of California, bounded on the East by the westerly line of Lot - 1,_Block 118, and bounded on the Northwest by the southeasterly line of Lot D. and bounded on the south by the projected northerly line of Pine Avenue (50.00 feet wide) all as shown on said Map of Sheet 7. 0 0 be, and the same, is hereby closed, vacated and abandoned for public street purposes, all as contemplated by Resolution of Intention No-3114 of the City Council of the City of E1 Segundo, California, adopted on the 15th day of r,FrFMRVR . 198 Reference is hereby made to said Resolution of Inten- tion No. and to the map or plan entitled, "PORTION OF SIERRA STREET PROPOSED TO BE VACATED BY RESOLUTION OF INTENTION NO. 3U.4__", referred to therein, both of which are on file and open to public inspection in the office of the City Clerk in the City Hall of said City, and both of which, by this refer- ence, are incorporated herein and made a part hereof for further particulars. SECTION 4. The City Council does hereby determine that the public convenience and necessity require the reser- vation of certain easements and rights -of -way for structures enumerated in Section 8340 of the Streets and Highways Code of the State of California, and these proceedings are taken, subject to such reservations and exceptions. The easements and rights -of -way hereby reserved and excepted from the vacation are the following, to wit: The permanent easement and right at any time, or from time to time, to construct, maintain, operate, replace, remove, and renew sanitary sewers and storm drains and appurtenant structures in, upon, over and across a street or highway proposed to be vacated and pursuant to any existing franchises or renewals thereof, or otherwise, to construct, maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits, cables, wires, poles, and other convenient structures, equipment and fixtures for the operation of gas pipe lines, telegraphic and telephone lines, railroad lines, and for the transportation or distribution of electric energy, petroleum and its products, ammonia, and water, and for incidental purposes, including access to protect such works from all hazards in, upon, and over the street or highway proposed to be vacated.. SECTION 5. That the City Clerk shall certify to the '• passage and adoption of this resolution; shall enter the same in the book of original resolutions of said city, shall make a minute of the passage and adoption thereof in the records and proceedings of the City Council of said city in the minutes of the meeting at which the same is passed and adopted; and shall cause a certified copy thereof, attested by the City Clerk under the seal of said city, to be recorded in the office of the County Recorder of Los Angeles County, State of California.
