CC RESOLUTION 3006RESOLUTION NO. 3006 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, AMENDING CHAPTER 1A3, GENERAL GOVERNMENT SERIES, AND CHAPTER 1A6, GENERAL RULES OF TITLE 1A OF THE EL SEGUNDO ADMINISTRATIVE CODE. THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES RESOLVE AS FOLLOWS: SECTION 1. Sections 1A3.010, 1A3.075, 1A3.100 and 1A3.125 of Chapter 1A3 of Title 1A of the E1 Segundo Administrative Code, adopted by Resolution No. 2620, as amended, are amended to read as follows: SECTION 1A3.010 BASIC SALARY SCHEDULE. An employee who works a regularly assigned shift in which four or more hours fall between the hours of 5 :00 p.m. and 6:00 a.m. shall be paid an additional twenty -five cents per hour for each hour worked between 6:00 p.m. and 6:00 a.m. as part of a regularly assigned shift. SECTION 1A3.100 HOLIDAYS AND HOLIDAY PAY. Except as otherwise herein specifically provided, any employee who is required to work on any of the following days that occur on his regular day of employment, to wit: January 1st Thanksgiving Day and The third Monday in February Friday thereafter The last Monday in May December 24th July 4th December 25th and The first Monday in September December 31st November 11th shall be compensated therefor at the rate of one and one -half times his regular rate of pay in addition to straight time holiday pay; provided, however, (a) that in the event any of the hereinbefore mentioned holidays falls on the last day an employee is off on his regular days off period, the.following day shall be observed as a holiday for the purpose of this section, provided.further, however, (b) that in the event any of the herein- above mentioned holidays falls on the first day of an employee's regular days off period, the previous day shall be considered as a holiday for the purpose of this section. If library employees observe February 12th as a holiday instead of the Friday following Thanksgiving day, they shall not receive overtime pay on the Friday following Thanksgiving day. All. permanent employees who are entitled to receive overtime 7 • pay shall be entitled to be off for all City holidays; or, if they are required 'to work upon a City holiday, shall be entitled to time and one- half,for such work. SECTION 1A3-125 INSURANCE BENEFITS. A. Medical. Officers and employees to whom this Chapter applies shall receive a total Of $105-00 per month for health and medical insurance under the existing group plan for the employee and one dependent commencing with the payroll deduction made.for coverage.for the month of August, 1980. ;B. Dental. Officers and employees to whom this Chapter applies shall receive a total of $14-36 per month for dental insurance I for the employee Only effective with the payroll dedution made for coverage of the month of August, 1980. C. Dental/Medical. Should the employee only dental plan cost be less than $14-36 per month the difference between the actual employee only cost and $14-36 may be applied toward the payment Of the medical insur- ance premium. D. Medical,- 1981. Effective the first payroll on or after July 1, 1981 in which medical and dental inusrance premiums are deducted instead of the provisions of subparagraph "A" hereof, officers and employees to whom this Chapter applies shall receive a total Of $115.00 per month for health and medical insurance under the existing group plan for the Officer or employee and one dependent. SECTION 2. Sections 1A3.100-1 and 1A3.100.2 are added to Chapter 1A3 of the El Segundo Administrative Code to read as follows: SECTION 1A3.100.1 PERSONAL LEAVE/FLOATING HOLIDAY. In addition to the holidays enumerated in Section 1A.3-100, each employee who has completed six months of service shall be entitled to select one day per claendar year as a Personal Leave Day/Floating Holiday with the approval Of the employee's supervisor after a minimum Of seven days prior notice. SECTION 1A3.100.2 BEREAVEMENT LEAVE - PERSONAL EMERGENCIES - IMMEDIATE-FAMILY DEFINED. A. Bereavement Leave, Commencing June 28, 1980, in the case of a death in the "immediate family', of the employee 8 I or the employee's spouse, a maximum of three days Bereavement Leave with pay may be granted per incident. Proof of death may be required before charging an absence to Bereavement Leave. Bereavement Leave shall be distinct from all other leave benefits and may not be accumulated. B. Personal Emer encies- -Use of Eli gibleLeaves. For other types of personal emergencies, that is, a serious illness of an "immediate family" member of the employee or the employee's spouse and for cases of extreme and unusual hardship of an emergency nature, employees, upon request, shall be entitled to utilize accumulated vacation leave, compensatory time- off, or Personal Leave Day/Floating Holiday, for which Prior notification is required; however, in certain instances notification requirements may be waived. C. Immediate ediate Family Djfined. For the Purpose of this section "immediate family,, shall mean spouse, child, mother, father or sibling. SECTION 3. Sections 1A6.160 and 1A6.170 of Chapter 1A6 of Title IA of the El Segundo Administrative Code are amended to read as follows: SECTION 1A6.160 EMERGENCY LEAVE - FAMILY ILLNESS. Except for those employees regulated by Chapter 1A3 of this Code, accumulated sick leave may be used as emergency leave for short periods in case of serious illness in the immediate family of the employee or employee's spouse. A maximum of three days emergency leave may be granted incase of a death in the immediate family of the employee or employee's spouse. A doctor's certificate stating the nature of the illness of the immediate family of the employee or employee's spouse, or proof of death may be required before absence for these reasons shall be charged to emergency leave. Emergency leave of a maximum of three days may also be granted in c . ases of extreme and unusual hardship of an emergency nature. For the purpose of this sec- tion "immediate family" means spouse, child, mother, father or sibling. SECTION 1A6.170 WORKERS' COMPENSATION PROVISIONS. Permanent employees who are members of the Public Employees' Retirement System and who receive injuries that are compensable under the California Workers' Compensation Laws (other than those to whom the provisions of Section 4850 Z of the Labor Code apply) shall be entitled to receive: I. Seventy -five percent of the employee's regular salary for any so- called waiting period provided for in the Workers' Compensation Laws. . 2. Thereafter, the period of up to one year, until earlier retirement on disability pension or a finding of permanent and stationary disability by a medical doctor, the difference between seventy - five percent of the employee's regular monthly salary and the amount of any temporary disability payments under the California Workers' Compensation Laws. Such payments shall cease when the employee receives a permanent disability award or is physically able to return to work. SECTION 2. All resolutions and orders of the City Council heretofore passed and adopted with reference to the same, or any of the matters and subjects hereinabove set forth or referred to, are hereby rescinded insofar as the same conflict with the provisions hereof. SECTION 3. The City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of original resolutions of said city; and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said city, in the minutes of the meeting at which the same is passed and adopted. An employee who works a regularly assigned shift in which four or more hours fall between the hours of 15:00 p.m. and 6:00 a.m. shall be paid an additional twenty -five cents per hour.for each hour worked between 6:00 p.m. and 6:00 a.m. as part of a regularly assigned shift. SECTION 1A3.100 HOLIDAYS AND HOLIDAY PAY. Except as otherwise herein specifically provided, any employee who is required to work on any of the.following days that occur on his regular day of employment, to wit: January 1st Thanksgiving Day and The third Monday in February Friday thereafter The :Last Monday in May December 24th July 4th December 25th and The.first Monday in September December 31st November 11th shall be compensated therefor at the rate of one and one -half times his regular rate of pay in addition to straight time holiday pay; provided, however, (a) that in the event any of the hereinbefore mentioned holidays falls on the last day an employee is off on his regular days off period, the.following day shall be observed as a holiday for the purpose of this section, provided further, however, (b) that in the event any of the herein- above mentioned holidays.falls on the first day of an employee's regular 0 days off period, the previous day shall be considered as a holiday for the purpose of this section. If library employees observe February 12th as a holiday instead of the Friday.following Thanksgiving day, they shall not receive overtime pay on the Friday following Thanksgiving day. All permanent employees who are entitled to receive overtime 0 7 0 pay shall be entitled to be off for all City holidays; or, if they are required to work upon a City holiday, shall be entitled to time and one- half for such work. SECTION 1A3.125 INSURANCE BENEFITS. A. Medical. Officers and employees to whom this Chapter applies shall receive a total of $105.00 per month.for health and medical insurance under the existing group plan for the employee and one dependent commencing with the payroll deduction made for coverage.for the month of August, 1980. B. Dental. Officers and employees to whom this Chapter applies shall receive a total of $14.36 per month for dental insurance for the employee only effective with the payroll dedution made for coverage of the month of August, 1980. C. Dental /Medical. Should the employee only dental plan cost be less than $114.36 per month the difference between the actual employee only cost and $14.36 may be applied toward the payment of the medical insur- ance premium. D. Medical - 1981. Effective the first payroll on or after July 1, 1!981 in which medical and dental inuurance premiums are deducted instead of the provisions of subparagraph "A" hereof, officers and employees to whom this Chapter applies shall receive a total of $115.00 per month for health and medical insurance under the existing group plan for the officer or employee and one dependent. SECTION 2. Sections 1A3.100.1 and 1A3.100.2 are added to Chapter 1A3 of this E1 Segundo Administrative Code to read as follows: SECTION 1A3.100.1 PERSONAL LEAVE /FLOATING HOLIDAY. In addition to the holidays enumerated in Section 1A3.100, each employee who has completed six months of service shall be entitled to select one day per claendar iyear as a Personal Leave Day /Floating Holiday with the approval of the employee's supervisor after a minimum of seven days prior notice. SECTION 1A3.100.2 BEREAVEMENT LEAVE - PERSONAL EMERGENCIES - IMMEDIATE_FAMILY DEFINED. A. Bereavement Leave. Commencing June 28, 1980, in the case of a death in the "immediate family" of the employee 10 8 ior the employee's spouse, a maximum of three days Bereavement Leave with pay may be granted per incident. Proof of death may be required before charging an absence to Bereavement Leave. Bereavement Leave shall be distinct from all other leave benefits and may not be accumulated. B. Personal Emergencies--Use of Eligible Leaves. For other types of personal emergencies, that is, a serious illness of an "immediate • family" member of the employee or the employee's spouse and for cases of extreme and unusual hardship of an emergency nature, employees, upon request, shall be entitled to utilize accumulated vacation leave, compensatory time- off, or Personal Leave Day/Floating Holiday, for which prior notification is required; however, in certain instances notification requirements may be waived. C. Immediate Family Defined. For the purpose of this section "immediate family" shall mean spouse, child, mother, father or sibling. SECTION 3. Sections 1A6.160 and 1A6.170 of Chapter 1A6 of Title IA of the El Segundo Administrative Code are amended to read as follows: SECTION 1A6.160 EMERGENCY LEAVE - FAMILY ILLNESS. Except for those employees regulated by Chapter 1A3 of this Code, accumulated sick leave may be used as emergency leave for short periods in case of serious illness in the immediate family of the employee or employee's spouse. A maximum of three days emergency leave may be granted incase of a death in the immediate family of the employee or employee's spouse. A doctor's certificate stating the nature of the illness of the immediate family of the employee or employee's spouse, or proof of death may be required before absence for these reasons shall be charged to emergency leave. Emergency leave of a maximum of three days may also be granted in cases of extreme and unusual hardship of an emergency nature. For the purpose of this sec- tion "immediate family" means spouse, child, mother, father or sibling. SECTION 1A6.170 WORKERS' COMPENSATION PROVISIONS. Permanent employees who are members of the Public Employees' Retirement System and who receive injuries that are compensable under the California Workers' Compensation Laws (other than those to whom the provisions of Section 4850 • 9 I4 of the Labor Code apply) shall be entitled to receive: 1. Seventy -five percent of the employee's regular salary for any so- called waiting period provided for in the Workers' Compensation Laws. 2. Thereafter, the period of up to one year, until earlier retirement on disability pension or a finding of permanent and stationary disability by a medical doctor, the difference between seventy - five percent of the employee's regular monthly salary and the amount of any temporary disability payments under the California Workers' Compensation Laws. Such payments shall cease when the employee receives a permanent disability award or is physically able to return to work. SECTION 2. All resolutions and orders of the City Council heretofore passed and adopted with reference to the same, or any of the matters and subjects h.ereinabove set.forth or referred to, are hereby rescinded insofar as the same conflict with the provisions hereof. SECTION 3. The City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of original resolutions of said city; and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said city, in the minutes of the meeting at which the same is passed and adopted.
