CC RESOLUTION 2993• RESOLUTION OF INTENTION NO. 2993 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DECLARING ITS INTEN- TION TO ORDER THE VACATION AND ABANDONMENT (SUBJECT TO THE RESERVATION AND EXCEPTION OF CERTAIN EASEMENTS AND RIGHTS -OF -WAY) OF A CER- TAIN PORTION OF PINE AVENUE WITHIN SAID CITY. The City Council of the City of El Segundo, California, • pursuant to the provisions of the "Street Vacation Act of 1941," being Part 3 of Division 9 of the Streets and Highways Code of the State of California, does hereby resolve, declare, determine and order as follows: SECTION 1. That it is the intention of the City Council of the City of E1 Segundo, California, to order the vacation and abandonment of a certain portion of Pine Avenue, within said City, which is more particularly described as follows: That portion of Pine Avenue in the City of El Segundo, County of Los Angeles, State of California, being a por- tion of Lot 3 and a portion of Lot 434, in Block 123, El Segundo as said Lot 3 and Lot 434 are shown per map recorded in Book 22, Pages 106 and 107 of Maps in the office of the County Recorder of said County, described as follows: BEGINNING at the northeasterly corner of the intersection of Center Street, 60.00 feet wide, and Pine Avenue, 50.00 feet wide, said corner being a point on the westerly line of above said Lot 434, distant South 0 02 °36" East, 51.58 feet along said westerly line from the northwesterly corner of said Lot 434; THENCE along the northerly line of Pine Avenue, North 89 52150" East, 71.16 feet to a point on the northeasterly line of said Lot 434 and the southwesterly line of said Lot 3, said point being distant South 54 °09'12" East, 87.83 feet along said northeasterly line of Lot 434 from the northwesterly corner of said Lot 434; THENCE continuing along said northerly line of Pine Avenue, North 89 52150" East, 15.45 feet; THENCE South 0 °07'10" East, 11.21 feet to the above said northeasterly line of Lot 434; THENCE along last said northeasterly line South 54 09112" East, 66.05 feet to the southerly line of said Pine Avenue; THENCE along last said southerly line South 89 52150" West, 136.22 feet to the southwesterly line of above said Lot 434; THENCE along last said south- westerly line North 54 °09'12" West, 4.83 feet to the easterly line of the above said Center Street; THENCE along last said easterly line, North 0 °02 "36" West, 47.16 feet to the point of beginning. 0 f • For further particulars as to the proposed vacation of said portion of Pine Avenue, reference is hereby made to map, entitled "PORTION OF PINE AVENUE PROPOSED TO BE VACATED BY RESOLU- TION OF INTENTION NO. 2993 " on file and open to public inspec- tion in the office of the City Clerk of the City of El Segundo, California, in the City Hall of said City. SECTION 2. The City Council does hereby determine that the public convenience and necessity require the reservation of certain easements and rights-of-way for structures enumerated in Section 8330 of the Streets and Highways Code of the State of California, and these proceedings are taken, subject to such reser- vations and exceptions. The easements and rights-of-way hereby reserved and excepted from the vacation are the following, to wit: The permanent easement and right at any time, or from time to time, to construct, maintain, operate, replace, remove, and renew sanitary sewers and storm drains and appurtenant structures in, upon, over and across any street or part thereof proposed to be vacated and pur- suant to any existing franchises or renewals thereof, or otherwise, to construct, maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits, cables, wires, poles, and other convenient structures, equipment and fixtures for the operation of gas pipe lines, telegraphic and telephone lines, and for the transportation or distribution of electric energy, water, and incidental purposes, including access and the right to keep the property free from inflammable materials, and • wood growth, and otherwise protect the same from all hazards in, upon and over the street or part thereof pro- posed to be vacated. SECTION 3. That the hour of 7:00 p.m., on Tuesday, JUNE 3 J 1980, in the Council Chamber in the City Hall, 350 Main Street, in said city, be and the same is hereby fixed as the time and place when and where any and all persons interested in or objecting to the proposed vacation of said portion of said public street may appear before said City Council and be heard and offer testimony and submit evidence in relation thereto. SECTION 4. That the Superintendent of Streets of the City of E1 Segundo, California, be and he is hereby directed to cause "NOTICE OF STREET VACATION AND OF PUBLIC HEARING THEREON," to be posted as required by the said Street Vacation Act of 1941, being Part 3 of Division 9 of the Streets and Highways Code of the State of California; and the City Council of said city hereby elects to proceed under the provisions of said Act. SECTION 5. That the City Clerk shall certify to the passage and adoption of this resolution, and shall cause the same to be published once in the El Segundo Herald, a weekly newspaper of general circulation, published and circulated in said city and hereby designated for that purpose by the said City Council.
