CC RESOLUTION 2942')9 7 I - 0 RESOLUTION NO. 2942 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, CONCURRING WITH AMEND - MENT NO. 2 TO THE LOS ANGELES COUNTY SOLID WASTE MANAGEMENT PLAN. WHEREAS, the State Solid Waste Management Board approved the Los Angeles County Solid Waste Management Plan on December 16, • 1977 as meeting the requirements of Section 66780, Title 7.3 of the Government Code; and WHEREAS, during approximately one year of implementation of the Plan, a number of changes have occurred and requests for revisions have been received which resulted in the preparation of Amendment No. 2 to the County Solid Waste Management Plan; and WHEREAS, the Amendment No. 2 is subject to the approval by the majority of the cities within incorporated area of the County; and WHEREAS, the Amendment No. 2 was submitted to the City of E1 Segundo for approval; NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of El Segundo approves Amendment No. 2. Delete the third and fourth paragraphs on Pate 5 (begi�^nI "In consideration of the complex interrelationships . . ,: ) • and the first and second paragraphs on page 6 and replace them %..ith the following: "PROCEDURE FOR INCORPORATING I'EW FACILITIES INTO CoS :•IP:' To adequately assess the need for ne%r waste dis -oos`J_ ca:-,d handling facilities and major expansion of existing facilities, the State Solid Waste, Itilanaoenent Board and i :,e Chairperson of the CoS101P Committee have agreed that areas 0 ( wastesheds) from which solid wastes in Los Angeles County. The procedure these wastesheds is described below. are generated would be established that has been developed to employ a. Wasteshed boundaries for Los Angeles County are as shown on the following map. The initial quantity of solid waste generated in each wasteshed area is based on the 1980 waste projections in Appendix D of the Plan, except that sewage sludge and a portion of demolition wastes are not included in the calculations. The 1985 data will be estimated for use in initial near - future projec- tions. b. Capacity of each existing facility will be as shown in the permit required by Government Code Section 66796.30 et seq. C. The Committee will determine the waste quantity in each wasteshed which is available to new or expanded facilities by comparing the amount of waste generated with the amount of processing capacity permitted for existing facilities. d. if there is a quantity of waste available for new facilities within a wasteshed, the Committee will inform each local jurisdiction and known proponents within the wasteshed area about the need for addi- tional facilities. The Committee will also inform the public and others, by a public notice in a newspaper of general circulation in the area, of the need for additional facilities. e. Within 15 working days of the first date of publication of the notice, proponents are to submit information on tentative proposals for their facilities to the Committee with exact location specified. This submittal of information shall not be construed to be a "Notification of Proposed Facility" as required under Section 17936 of Title 14 of the California Administrative Code. The Committee, during its initial evaluation process, will request the local government to comment regarding the probability of the establishment of the proposed facility within its jurisdiction. f. The Committee will determine whether there is need for a new facility in a wasteshed with available capacity by considering the comments from local jurisdictions, the goals and policies of the Plan, the need for effective, efficient, and economical service to the P ublic limitations in the iaumber of necessary facilities, and the projected increase of wastes :requiring handling. Once the need for the new facility is established, the Committee will then establish a reasonable time . P schedule for its implementation. The Committee will forward its finding to the appropriate local permitting agency and to the State Solid Waste Management Board. g. Upon the receipt of the Committee's finding, the State Board staff will indicate either: (1) its concurrence in the finding and recommend approval to the Board; or (2) its nonconeurrenee and ask for additional information or modifications or recommend disapproval o t a t h� Board. The State Solid Waste Management Board, after receiving notice from the local jurisdiction that the proposal is acceptable and that a land use permit has been issued, will review the need for the facility and shall either concur or not concur with the Committee's finding of conformance with the Plan. i, The finding of conformance is effective only upon the completion of a Final EIR or negative declaration, approval by the State Solid Waste Management Board and compliance with the time schedule set forth in the finding. j. Based upon the exercise of its police powers, the affected local jurisdiction may choose to approve or disapprove the new facility within its jurisdiction. k. If an existing waste disposal or handling facility terminates opera- tion or a proponent fails to meet the time schedule specified in Step f, a replacement facility will be processed following Steps f through i of these.proceedings. 1. If, upon future review of the County Solid Waste Management Plan, the need for additional facilities is demonstrated by waste generation increases, the above procedures can be employed. This will not constitute a revision or amendment as long as the above procedures are followed. M. Each time the County Solid -Waste Management Plan is revised or amended, it will reflect the facilities approved through the above procedure. A finding of conformance pursuant to this procedure will not by itself trigger the amendment process. New facilities previously approved in accordance with the above procedure will be included as informational items in the circulated amendment not requiring approval by the cities or the county. 2. The first sentence of the second paragraph under the Section titled Existing and Planned Facilities on page 77 is amended to read: "The City of Los Angeles has twe eleven transfer facilities planned for the future." • 2, The following is added to the end of the same paragraph: "Other transfer facilities proposed by Street Maintenance are the Central Transfer Station, north side of Ol lipic, east of Santa Fe Avenue; Sun Valley Transfer Station, li Sheldon Street and Arleta Avenue; and the Central Valley Transfer Station, Balboa Place south of Roscoe Boulevard.
