CC RESOLUTION 291711 • RESOLUTION NO. 2917 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DETERMINING THAT THE PUBLIC NECESSITY, HEALTH, SAFETY AND WELFARE REQUIRE THE FORMATION OF AN UNDERGROUND UTILITY DISTRICT ON ROSECRANS AVENUE BETWEEN THE NORTHERLY PROLONGATION OF THE EASTERLY LINE OF OAK AVENUE IN THE CITY OF MANHATTAN BEACH AND THE SOUTHEASTERLY LINE OF THE ATCHISON, TOPEKA AND SANTA FE RAILWAY COMPANY RIGHT -OF -WAY, APPROXIMATELY 1,046 FEET EASTERLY OF SEPULVEDA BOULEVARD, IN THE CITY OF EL SEGUNDO (UNDER- GROUND UTILITY DISTRICT NO. 2). WHEREAS, pursuant to Resolution No. 2903 adopted by the City Council on March 20, 1978, a public hearing was called for May 1, 1979, at the hour of 7:00 p.m. in the Council Chamber in the City Hall, El Segundo, California, to ascertain whPi -hPr i-ho r„k, — necessity, health, safety and welfare require the removal of poles, overhead wires and associated overhead structures and the under - ground installation of wires and facilities for supplying electric, communication, or similar or associated service on Rosecrans Avenue between the northerly prolongation of the easterly line of Oak Avenue in the City of Manhattan Beach and the southeasterly line of The Atchison, Topeka and Santa. Fe Railway Company right -of -way, approximately 1,046 feet easterly of Sepulveda Boulevard, in the City of El Segundo (Underground Utility District No. 2); and WHEREAS, notice of such hearing has been given to all affected property owners as shown on the last equalized assessment roll and all utilities concerned, in the manner and time required by law; and WHEREAS, such hearing has been duly and regularly held, and all interested persons have been given an opportunity to be I'• heard; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES HEREBY RESOLVE, FIND AND DETERMINE AS FOLLOWS: • SECTION 1. That the public necessity, health, safety and welfare require the removal of poles, overhead wires and associated overhead structures and the underground installation of wires and facilities for supplying electric, communication, or similar or associated service on Rosecrans Avenue between the northerly pro- longation of the easterly line of Oak Avenue in the City of Manhattan Beach and the southeasterly line of The Atchison, Topeka and Santa Fe Railway Company right -of -way, approximately 1,046 feet easterly of Sepulveda Boulevard, in the City of El Segundo, and such described area is hereby established as Underground Utility District No. 2. SECTION 2. That the following exceptions in said Under- ground Utility District No. 2, be, and they are hereby, authorized: (a) Any municipal facilities or equipment installed under the supervision and to the satisfaction of the City Engineer. (b) Poles or electroliers used exclusively for street lighting. (c) Overhead wires (exclusive of supporting structures) crossing any portion of the District within which overhead wires have been prohibited, or connecting to buildings on the perimeter of the District, when such wires originate in an area from which poles, overhead wires and associated overhead structures are not j prohibited. (d) Overhead wires attached to the exterior surface of a building by means of a bracket or other fixture and extending from one location on the building to another location on the same build - ing or to an adjacent building without crossing any public street. (e) Temporary poles, overhead wires and associated over- head structures used or to be used in conjunction with construction projects. SECTION 3. Inasmuch as no poles, overhead wires or asso- ciated overhead structures are located in the City of E1 Segundo - 2 - 0 I :- and all poles, overhead wires and associated overhead structures are located in the City of Manhattan Beach, such overhead struc- tures and underground installations shall be made in said utility district within such time as is established by the City of Manhattan Beach in its resolution establishing an underground utility district in the City of: Manhattan Beach. SECTION 4. That the City Clerk within ten days after the adoption of this resolution, shall mail a copy of this resolution to affected property owners as such are shown on the last equalized assessment roll, to the affected utilities, and to the City Council of the City of Manhattan Beach, attention: City Clerk. SECTION 5. The City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of original resolutions of said city; and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said city, in the minutes of the meeting at which the same is passed and adopted.
