CC RESOLUTION 2903� 0 RESOLUTION NO. 2903 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, CALLING A PUBLIC HEAR- ING TO DETERMINE WHETHER PUBLIC NECESSITY, HEALTH, SAFETY AND: WELFARE REQUIRE THE FORMA- TION OF AN UNDERGROUND UTILITY DISTRICT ON ROSECRANS AVENUE BETWEEN THE NORTHERLY PRO- LONGATION OF THE EASTERLY LINE OF OAK AVENUE IN THE CITY OF MANHATTAN BEACH AND THE SOUTH- EASTERLY LINE OF THE ATCHISON, TOPEKA AND SANTA FE RAILWAY COMPANY RIGHT -OF -WAY, APPROXIMATELY 1,046 FEET EASTERLY OF SEPULVEDA BOULEVARD, IN THE CITY OF EL SEGUNDO (UNDERGROUND UTILITY DISTRICT NO. 2). WHEREAS, Chapter 14.08 of the El Segundo Municipal Code establishes a procedure for the creation of undergound utility dis- tricts and requires as the initial step in such procedure the holding of a public hearing to ascertain whether public necessity, health, safety and welfare require the removal of poles, overhead wires and associated overhead structures and the underground installation of wires and facilities for supplying electric, commu- nication, or similar or associated service in any such district; and WHEREAS, it has been recommended that such an underground utility district, hereinafter called District, be formed on Rose - crans Avenue between the northerly prolongation of the easterly line of Oak Avenue in the City of Manhattan Beach and the south- easterly line of The Atchison, Topeka and Santa Fe Railway Company right -of- -way, approximately 1,046 feet easterly of Sepulveda Boulevard, in the City of E1 Segundo (Underground Utility District No. 2) ; and WHEREAS, while there are no overhead structures within the portion of Rosecrans Avenue located in the City of El Segundo, there are such facilities within the portion of Rosecrans Avenue located in the City of Manhattan Beach and Southern California Edison Company is unable, under the rules and regulations of the Public Utilities Commission, to grant the facilities in Manhattan C7 Beach unless the entire street is located within an underground utility district; and WHEREAS, the City Council of the City of El Segundo desires to accommodate Southern California Edison Company and the City of Manhattan Beach in the elimination of overhead utility facilities in Rosecrans Avenue immediately adjacent to the City of El Segundo; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES RESOLVE AS FOLLOWS: SECTION 1. NOTICE IS HEREBY GIVEN that a public hearing will be held by the City Council, of the City of E1 Segundo on May 1, 1979, at the hour of 7:00 p.m. in the Council Chamber of the City Hall, El Segundo, California, to ascertain whether the public necessity, health, safety and welfare require the removal of poles, overhead wires and associated overhead structures and the under - ground installation of wires and facilities for supplying electric, communication or similar associated service in the District herein - above described. SECTION 2. That at such hearing all persons interested shall be given an opportunity to be heard. Said hearing may be continued from time to time as may be determined by the City Council. SECTION 3. That the City Clerk shall notify all affected property owners as shown on the last equalized assessment roll and utilities concerned of the time and place of such hearing by mailing a copy of this resolution to such property owners and utilities concerned at least ten days prior to the date thereof. • The City Clerk shall also forward a copy of this resolution to the City Council of Manhattan Beach, attention: City Clerk. SECTION 4. That the area proposed to be included in the District is shown upon that certain map entitled "Underground Utility District No. 2 ", dated December 15, 1978, which is on file - 2 - . in the office of the City Clerk of the City of E1 Segundo.
