CC RESOLUTION 29011'S 1 RESOLUTION NO. 2901 A RESOLUTION OF THE CITY OF EL SEGUNDO (HEREIN- AFTER CALLED CITY), CALIFORNIA, RECOMMENDING LEGISLATIVE REFORM IN THE AREAS OF WORKERS' COMPENSATION AND DISABILITY RETIREMENT. WHEREAS, City recognizes the public purpose served by an equitable workers' compensation and retirement system; and WHEREAS, the costs associated with workers' compensation and disability retirement have been rising at an ever- increasing rate; and WHEREAS, in many instances this cost increase is attrib- utable to benefits which go far beyond the original purpose and intent of` workers' compensation and disability retirement; and WHEREAS, this is particularly critical in view of Propo- sition lei; and WHEREAS, employers both public and private have expressed concern over the spiraling workers' compensation costs; and WHEREAS, the increasing costs of workers' compensation and disability retirement are adequately documented in numerous resources including text published by the Institute for Local Self- government entitled "THROUGH THE ROOF - A REPORT ON ESCALATING COM- PENSATION COSTS," which-,report is on file in the office of the City Manager; and WHEREAS, City desires to seek a remedy for the current crisis and desires to encourage that other employers seek a similar remedy; and WHEREAS, the basic problem causing the abuse is with the current State legislative scheme pertaining to workers' compensa- tion and disability retirement; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES RESOLVE AS FOLLOWS: SECTION 1. That the California State Legislature give serious consideration to the numerous substantive revisions now � i�* E2,F)_t being proposed throughout California with reference to creating a fair and equitable workers' compensation system, and eliminating the current excessive liberal construction mandates and presump- tions which exist in State law. SECTION 2. That disability retirement benefits under the Public Employee Retirement System for safety employees be amended to address the following problems and recommendations: (a) The abuses attendant to the so- called psychiatric - emotional stress cases. (b) The lack of crediting for any outside income earned after a safety employee has been retired on disability. (c) That workers' compensation determinations as to job - relatedness should not necessarily be binding with regard to dis- ability retirement applications. SECTION 3. That this resolution be transmitted to the members of the State Legislature representing the City area and to all other legislators who participate on relevant committees dealing with the subject matter herein. SECTION 4. That a copy of this resolution be transmitted to all other cities in the South Bay region, the City and County of Los Angeles and other entities of local government recommending their passage and transmittal to their respective legislators. SECTION 5. That copies of this resolution be forwarded to the League of California Cities and any other organizations or persons seeking legislative reform as regards the subject matter discussed herein. SECTION 6. That this resolution shall take effect imme- diately. SECTION 7. That the City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of original resolutions of said city; and shall make a minute of the passage and adoption thereof in the records of the - 2 - Iti# (S 19 • proceedings of the City Council of said city, in the minutes of the meeting at which the same is passed and adopted.
