CC RESOLUTION 28397-t C)3 �15' r RESOLUTION NO. 2839 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, ORDERING THE VACATION (SUBJECT TO THE RESERVATION AND EXCEPTION OF CERTAIN EASEMENTS AND RIGHTS -OF -WAY) OF CERTAIN PORTIONS OF FRANKLIN AVENUE AND ILLINOIS STREET WITHIN SAID CITY AS CONTEMPLATED BY RESOLUTION OF INTENTION NO. 2831 . ,4 2 Il The City Council of the City of El Segundo, California, pursuant to the provisions of the "Street Vacation Act of 1941," being Part 3 of Division 9 of the Streets and Highways Code of the State of California, does hereby resolve, declare, find, determine and order as follows: SECTION 1. Said City Council after public hearing duly and regularly called, noticed and held, finds and determines from all the evidence submitted, that those certain portions of Franklin Avenue and Illinois Street within said city described in Resolution of Intention No. 2831 of said Council adopted on the 7th day of February, 1978, are unnecessary for present or prospective public street purposes. SECTION 2. That the public interest and convenience require, and it is hereby ordered, subject to the reservations and exceptions hereinafter set forth, that the following portions of the following public streets within the city, to wit: The westerly 25.00 feet and the southerly 25.00 feet of Lot 345 except the westerly 25.00 feet of the southerly 25.00 feet thereof, in Block 123, Sheet 8 El Segundo, as filed in Map Book 22, Pages 106 and 107, in the office of the County Recorder, Los Angeles County, State of California, be, and the same, are hereby closed, vacated and abandoned for public street purposes, all as contemplated by Resolution of Intention No. 2831 of the City Council of the City of El Segundo, California, adopted on the 7th da:y of February, 1978. Reference is hereby made to said Resolution of Intention No. 2831 and to the map or plan entitled, "PORTIONS OF FRANKLIN AVENUE AND ILLINOIS STREET PROPOSED TO BE VACATED BY RESOLUTION 4 251 6 OF INTENTION NO. 2831 ," referred to therein, both of which are on file and open to public inspection in the office of the City Clerk in the City Hall of said City, and both of which, by this reference, are incorporated herein and made a part hereof for further particulars. SECTION 3. The City Council does hereby determine that the public convenience and necessity require the reservation of certain easements and rights -of -way for structures enumerated in Section 8330 of the Streets and Highways Code of the State of California, and these proceedings are taken, subject to such reservations and exceptions. The easements and rights -of -way hereby reserved and excepted from the vacation are the following, to wit: The permanent easement and right at any time, or from time -to time, to construct, maintain, operate, replace, remove, and renew sanitary sewers and storm drains and appurtenant structures in, upon, over and across any street or part thereof proposed to be vacated and pursu- ant to any existing franchises or renewals thereof, or otherwise, to construct, maintain, operate, replace, re- move, renew and enlarge lines of pipe, conduits, cables, wires, poles, and other convenient structures, equipment and fixtures for the operation of gas pipe lines, tele- graphic and telephone lines, and for the transportation or distribution of electric energy, water, and incidental purposes, including access and the right to keep the prop- erty free from inflammable materials, and wood growth, and otherwise protect the same from all hazards in, upon and over ithe street or part thereof proposed to be vacated. SECTION 4. That the City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of original resolutions of said city, shall make a minute of the passage and adoption thereof in the records and -2- � 0 I* LI LJ 42FI,GI proceedings of the City Council of said city in the minutes of the meeting at which the same is passed and adopted; and shall cause a certified copy thereof, attested by the City Clerk under the seal of said city, to be recorded in the office of the County Recorder of Los Angeles County, State of California.
