CC RESOLUTION 2831RESOLUTION OF INTENTION NO. 2831 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DECLARING I:TS INTENTION TO ORDER THE VACATION AND ABANDONMENT (SUBJECT TO THE RESERVATION AND EXCEPTION OF CERTAIN EASEMENTS AND RIGHTS -OF -WAY) OF CERTAIN PORTIONS OF FRANKLIN AVENUE AND ILLINOIS STREET WITHIN SAID CITY. The City Council of the City of El Segundo, California, pursuant to the provisions of the "Street Vacation Act of 1941," being Part 3 of Division 9 of the Streets and Highways Code of the State of California, does hereby resolve, declare, determine and order as follows: ;SECTION 1. That it is the intention of the City Council of the City of El Segundo, California, to order the vacation and abandonment: of certain portions of Franklin Avenue and Illinois Street, within said City, which are more particularly described as follows: The westerly 25.00 feet and the southerly 25.00 feet of Lot 345 except the westerly 25.00 feet of the southerly 25.00 feet thereof, in Block 123, Sheet 8 El Segundo, as filed in Map Book 22, Pages 106 and 107, in the office of the County Recorder, Los Angeles County, State of California. For further particulars as to the proposed vacation of said portions of Franklin Avenue and Illinois Street, reference is hereby made to map, entitled "PORTIONS OF FRANKLIN AVENUE AND ILLINOIS STREET PROPOSED TO BE VACATED BY RESOLUTION OF INTENTION NO. 2831 �" on file and open to public inspection in the office of the City Clerk of the City of El Segundo, California, in the City Hall of said City. SECTION 2. The City Council does hereby determine that the public convenience and necessity require the reservation of certain easements and rights -of -way for structures enumerated in Section 8330 of the Streets and Highways Code of the State of California, and these proceedings are taken, subject to such t reservations and exceptions. The easements and rights -of -way hereby reserved and excepted from the vacation are the following, to wit: The permanent easement and right at a: time to time, to construct, maintain, remove, and renew sanitary sewers and appurtenant structures in, upon, over street. or part thereof proposed to be zy time, or from operate, replace, storm drains and and across any vacated and pursuant to any existing franchises or renewals thereof, or other- wise, to construct, maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits, cables, wires, poles, and other convenient structures, equipment and fix- tures for the operation of gas pipe lines, telegraphic and telephone lines, and for the transportation or distri- bution of electric energy, water, and incidental purposes, including access and the right to keep the property free from inflammable materials, and wood growth, and otherwise protect the same from all hazards in, upon and over the street: or part thereof proposed to be vacated. SECTION 3. That the hour of 7:00 p.m. , on Monday, March 6, 1978, in the Council Chamber in the City Hall, 350 Main Street, in said city, be and the same is hereby fixed as the time and place when and where any and all persons interested in or objecting to the proposed vacation of said portions of said public streets may appear before said City Council and be heard and offer testimony and submit evidence in relation thereto. E.ECTION 4. That the Superintendent of Streets of the City of El Segundo, California, be and he is hereby directed to cause "NOTICE OF STREET VACATION AND OF PUBLIC HEARING THEREON," to be posted as required by the said Street Vacation Act of 1941, being Part 3 of Division 9 of the Streets and Highways Code of the State of California; and the City Council of said city hereby elects to proceed under the provisions of said Act. -2- SECTION 5. That the City Clerk shall certify to the passage and adoption of this resolution, and shall cause the same to be published once in the El Segundo Herald, a weekly newspaper of general circulation, published and circulated in said city and hereby designated for that purpose by the said City Council.
