CC RESOLUTION 27850 RESOLUTION NO. 2785 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, ESTABLISH- ING PENALTIES AND CHARGES FOR WATER CON- SUMED IN EXCESS OF NINETY PERCENT OF BASE YEAR AND STATING THE REASONS THEREFOR. THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES RESOLVE AS FOLLOWS: 0 SECTION 1. FINDINGS AND DETERMINATIONS. The City II• 0 Council of the City of E1 Segundo hereby finds and determines that: 1. A water shortage emergency condition prevails within its water service area. 2. The Metropolitan Water District of Southern California has requested that all resale customers, including the City of El Segundo, immediately institute a water conservation program designed to effect a ten percent reduction in water usage. 3. The Metropolitan Water District of Southern California has established surcharges to its resale customers on purchases of water above the ninety percent level of the base period. 4. The rules, regulations and charges set forth in this resolution are intended to conserve the water supply of the City of El Segundo for the greatest public benefit with particular regard to domestic use, sanitation and fire protection, and to offset surcharges established by the Metropolitan Water District of Southern California which are, or may be, incurred by the City of El Segundo. SECTION 2. DEFINITIONS. For the purposes of this resolution, the following terms, phrases, words, and their deriva- tions shall have the meaning given herein; when not inconsistent with the context, words used in the present tense include the future, words in the plural number include the singular number, and words in the singular number include the plural number. The word "shall" is always mandatory and not merely directory: ,/ I 0 �0 1. "City" is the "City" of El Segundo. 2. "Person" is any individual, firm, partnership, association, company, organization of any kind. 3. "Water" is water supplied by the City of El Segundo Water Department. 4. "Base Period" is defined as that period of time over which the base is computed. 5. "Base" is defined as the amount of water used on a customer's premises during the corresponding billing period in 1976. 6. "Billing Unit" equals one hundred cubic feet of water (74 8 gallons), or its metric equivalent. 7. "Minimum" equals one thousand cubic feet of water on bi- monthly water billings, and five hundred cubic feet for monthly billings. SECTION 3. SURCHARGE. Surcharges shall be based upon water consumed in excess of ninety percent of the base. Persons using the minimum specified amount of water or less per billing period shall not be subject to the charges defined in this resolution. Persons exceeding the base shall be surcharged sixteen cents per billing unit or its metric equivalent, whichever is applicable, on all consumption in excess of ninety percent of the base in addition to the rates fixed and established pursuant to Section 14.04.060 of the "El Segundo Municipal Code." A minimum surcharge of $1.00 shall be charged whenever a surcharge is applied. SECTION 4. BASE ADJUSTMENT -- APPLICATION REQUEST. Persons requesting a base adjustment shall file an application in writing, therefor, with the Director of Finance on a form to be provided by the City. SECTION 5. BASE ADJUSTMENT CRITERIA. Persons applying for a base adjustment shall provide all relevant information affecting water consumption on their premises. The Water and Sanitation Superintendent, at his discretion, may adjust the base assigned to any customer if that customer establishes to the satisfaction of the Water and Sanitation Superintendent that the base is not representative of existing conditions.. SECTION 6. BASE ADJUSTMENT -- DETERMINATION. In deter- mining whether an adjustment shall be granted, the Water and Sanitation Superintendent shall take into consideration all • relevant factors including, but not limited to: 1. Whether additional members have been added to the household. water. 2. Changes in vacancy factors in multi - family dwellings. 3. Increased production requiring increased process 4. Whether additional landscaping has been added. 5. Water consumed during new construction. 6. Water consumption necessary for reasons related to family illness or health. The Water and Sanitation Superintendent may require as a condition of adjustment, proof of installation of water conservation devices or water conservation planning. The Water and Sanitation Superintendent may establish the base for new residents or new facilities. The Water and Sanitation Superintendent retains the discretion to adjust the bases in those situations where during the base period, 1) the meter failed to register, or 2) where high water consumption was attained due to leaks on the premises. SECTION 7. This resolution shall be in effect until water shortage conditions no longer prevail in the City of E1 • Segundo service area and surcharges established by the Metropolitan Water District of Southern California are discontinued. The City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of original resolutions of said city; and shall make a minute of the passage and adoption thereof in the records of the proceed- ings of the City Council of said city, in the minutes of the meeting at which the same is passed and adopted.
