CC RESOLUTION 2760RESOLUTION OF INTENTION NO, 2760 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DECLARING ITS INTENTION TO ORDER THE VACATION AND ABANDONMENT (SUBJECT TO THE RESERVATION AND EXCEPTION OF CERTAIN EASEMENTS AND RIGHTS -OF -WAY) OF A CERTAIN PORTION OF SHELDON STREET WITHIN SAID CITY. The City Council of the City of El Segundo, California, pursuant to the provisions of the "Street Vacation Act of 1941," being Part 3 of Division 9 of the Streets and Highways Code of the State of California, does hereby resolve, declare, determine and order as follows: SECTION 1. That it is the intention of the City Council of the City of El Segundo, California, to order the vacation and abandonment of a certain portion of Sheldon Street, within said City, which is more particularly described as follows: All that portion of Sheldon Street (50.00 feet wide) lying southerly of the southerly line of Pine Avenue (50.00 feet wide) as shown on map of Tract No. 2801, recorded in Book 28, Page 3 of Maps, in the office' of the County Recorder, County of Los Angeles, State of California. For further particulars as to the proposed vacation of said portion of Sheldon Street, reference is hereby made to map, entitled "PORTION OF SHELDON STREET PROPOSED TO BE VACATED BY RESOLUTION OF INTENTION NO. 2760 ," on file and open to public inspection in the office of the City Clerk of the City of El Segundo, California, in the City Hall of said City. SECTION 2. The City Council does hereby determine that the public convenience and necessity require the reservation of certain easements and rights -of -way for structures enumerated in Section 8330 of the Streets and Highways Code of the State of 40 California, and these proceedings are taken, subject to such reservations and exceptions. The easements and rights -of -way hereby reserved and excepted from the vacation are the following, to wit: The permanent easement and right at any time, or from time to time, to construct, maintain, operate, replace, remove, and renew sanitary sewers and storm drains and appurtenant structures in, upon, over and across any street or part thereof proposed to be vacated and pursuant to any existing franchises or renewals thereof, or other- wise, to construct, maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits, cables, wires, poles, and other convenient structures, equipment and fix- tures for the operation of gas pipe lines, telegraphic and telephone lines, and for the transportation or distribution of electric energy, water, and incidental purposes, includ- ing access and the right to keep the property free from inflammable materials, and wood growth, and otherwise protect the same from all hazards in, upon and over the street or part thereof proposed to be vacated. SECTION 3. That the hour of 7:00 p.m., on Tuesday, April 5, 1977, in the Council Chamber in the City Hall, 350 Main Street, in said city, - be and the same is hereby fixed as the time and place when and where any and all persons interested in or objecting to the proposed vacation of said portion of said public street may appear before said City Council and be heard and offer testimony and submit evidence in relation thereto. SECTION 4. That the Superintendent of Streets of the City of El Segundo, California, be and he is hereby directed to cause "NOTICE OF STREET VACATION AND OF PUBLIC HEARING THEREON." to be posted as required by the said Street Vacation Act of 1941, being Part 3 of Division 9 of the Streets and Highways Code of the State of California; and the City Council of said city hereby elects to proceed under the provisions of said Act. SECTION '5. That the City Clerk shall certify to the passage and adoption of this resolution, and shall cause the same om to be pu paper of c i ty and Counc i 1.
