RESOLUTION NO. 2734
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF EL SEGUNDO, CALIFORNIA, ESTABLISH-
ING PROCEDURES FOR A SELF - INSURED PROGRAM.
THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA,
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. Self- insurance -- Construction -- Purpose.
This resolution shall not be construed to increase or enlarge
the liability of the City in any manner. The sole purpose of
this resolution is to establish regulations governing the com-
promise and settlement of claims and actions against the City.
SECTION 2. Self - insurance Fund. The City of E1 Segundo
shall be self - insured for such amounts as the City Council may
determine.
SECTION 3. Same -- Director of Finance. The Director
of Finance shall establish a liability self - insurance fund.
The money deposited in such fund may be expended only for the
following purposes:
(1) Purchase of liability insurance and excess
liability insurance.
(2) Payment of losses and expenses incident to the
self - insurance program.
(3) Transfer to budgets of departments rendering
services -to the self- insurance program.
(4) Payment for adjusting services, legal services,
and other services necessary to carry out the insurance program
by way of contract or wages for adjustment services.
(5) Purchase of primary coverage should the City
Council determine to abandon any self - insurance program.
SECTION 4. Same - -City Attorney -- Duties. The City
Attorney shall defend the City, and any excess carrier at its
request, for liability arising out of any risks.
SECTION 5. Same-- Authorit The City Manager or his
duly authorized representative is hereby authorized to settle

or compromise any liability of the City whether a claim has been
filed or not, in all cases where the amount necessary to be
expended in order to settle or compromise such claim does not
exceed $5,000.00 without the necessity of first receiving the
approval of the City Council and said City Manager in such event
is authorized to request the Director of Finance to draw a demand
directly upon the self-insurance fund for the payment of such sum.
The Director of Finance is authorized to draw such a demand upon
the request of the City Manager.
SECTION 6. Same--Authority of Adjusting Company. The
City Manager is authorized to delegate to an adjusting company
the authority set forth in the preceding section in an amount
not to exceed the amount approved by the City Council in the
service agent contract with the adjusting company.
SECTION 7. Same--Power. The City Manager is authorized,
without first obtaining the approval of the City Council to retain
medical doctors, appraisers, accountants, engineers or other
professional services in his opinion necessary to the defense
of any action and the City will be bound by any agreement entered
into by the City Manager provided that the amount involved in
any agreement does not exceed $1,500.00. In the event the amount
involved does exceed the $1,500.00, prior approval of the City
Council must be secured.
SECTION 8. Same--City Attorney--City Council -- Authority.
The City Attorney,, or his duly authorized assistant or deputy,,
is hereby authorized, with the approval of the City Council, by
motion approving the recommendation of the City Attorney, to
settle or compromise any liability of the City whether or not a
claim has been filed and in any case where the amount necessary
to be expended in order to settle or compromise such claim does
not exceed the amount of self-insurance, and the City Attorney
is authorized to request the Director of Finance to draw a demand,
0 directly upon the self-insurance fund for the payment of such
sum. The Director of Finance is authorized to draw such demand
upon the request of the City Attorney.
SECTION 9. Same--Accident Reports. Any employee or
official of the City who is involved in any accident while acting
in the scope of employment or while operating a city vehicle
shall immediately report the same to the City Manager or his
designated representative, together with a list of all witnesses
and other evidence or information concerning the accident.
SECTION 10. Same--Information Report. Any official or
employee of the City who receives information concerning any
accident, incident or injury in which it appears that the City
might be liable, shall make a report to the City Manager or his
designated representative, together with all pertinent information
known to 'him.
SECTION 11. The City Clerk shall certify to the passage
and adoption of this resolution; shall enter the same in the
book of original resolutions of said city; and shall make a
minute of the passage and adoption thereof in the records of
the proceedings of the City Council of said city, in the minutes
of the meeting at which the same is passed and adopted.
PASSED, APPROVED and ADOPTED this 7th day of
