CC RESOLUTION 267112036, RESOLUTION NO. 2671 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, REQUEST- ING THE BOARD OF SUPERVISORS OF LOS ANGELES COUNTY TO INSTITUTE COUNTY SERVICE AREAS. WHEREAS, it has been contended for many years the citizens of cities, particularly the citizens of the City of El Segundo, have been unfairly burdened by the general property tax levied upon them by the County of Los Angeles to finance to a substantial degree certain municipal-type services only provided to unincorporated areas of the County, and from which City citizens receive no benefit; and WHEREAS, the State Legislature under the County Service Area Law has provided a possible remedy to this financing system whereby county service areas would supply and finance County services which are only extended to unincorporated areas and not countywide; and WHEREAS, it became necessary for the City of Los Angeles and individual councilpersons to file a lawsuit against the County of Los Angeles and others challenging the aforementioned financing system and the validity of California Government Code Section :25210.11 (b) because the Section prohibited city councils in Los Angeles County from initiating county service areas in unincorporated territories; and WHEREAS, the Legislature has recently amended said Section (AB 1249) effective January 1. 1976, to permit city councils in Los Angeles County to initiate proceedings through the Board of Supervisorst-after approval by the Local Agency Formation Commission, to establish a county service area in the unincorporated territory so that persons residing in such area can be charged for receiving services not extended countywide: NOW THEREFORE BE IT RESOLVED, by the City Council of the City of El Segundo, that by the adoption of this resolution this Council requests the Board of Supervisors of the County of Los Angeles': 0 20 eq 1. To institute proceedings pursuant to Chapter 2.2 commencing with Section 25210.1 of Part 2, Division 2, Title 3 of the Government Code relative to county service areas; 2. The boundaries of the territory which shall be included in the area shall include all the unincorporated areas of the County of Los Angeles; 3. The types of extended county services already provided which shall in the future be provided by the county service area are: A. Police protection by the Patrol and Detective Divisions of the Sheriff's Office, including retirement and worker's compensation costs: B. Local park, recreation and parkway facilities and services provided by the Department of Parks and Recreation, including retirement and worker's compensation costs; C. County Engineer services; D. Forester and Fire Warden services; E. Fire apparatus and Motor Vehicles; F. Public Librarian services; G. Miscellaneous services for area planning, ambulance service, sewer service and animal control; H. Any other governmental service which the County is authorized by law to perform and which the County does not perform to the same extent on a countywide basis both within and without cities. NOW THEREFORE BE IT FURTHER RESOLVED, by the City Council of the City of El Segundo, that by the adoption of this resolution this Council determines to take whatever action may be proper and appropriate to remove from the people of the City of. El Segundo the burden of County taxes for services not received from the County; and directs the City Manager with the -2- cooperation of any other City agencies needed to obtain the approval of the Local Agency Formation Commission of this request and then file it with the Board of Supervisors; it is further directed that the City Manager may cooperate and join with other cities in a combined effort to obtain the approval of the Local Agency Formation Commission and in requesting the Board of Supervisors to institute proceedings under the County Service Area Law; and should the Local Agency Formation Commission by not approving this request or the Board of Supervisors abuse their discretion by failing to find the above-described services are extended services to the full costs of such, declares it is the City's intent to authorize the filing of a lawsuit or amending of a pending lawsuit to challenge such abuse of discretion, pro- vided the City Manager reports to the City Council with his recommendation for the Council's determination prior to permitting any such lawsuit action by the City or City Attorney.
