CC RESOLUTION 2630RESOLUTION NO. 2630 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, AMENDING CHAPTER 1A5 OF TITLE 1A OF THE EL SEGUNDO ADMINISTRATIVE CODE. THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES RESOLVE AS FOLLOWS: SECTION 1. Chapter 1A5 of Title 1A of the "El Segundo Administrative Code" is hereby amended to read as follows: "CHAPTER 1A5 POLICE SAFETY SERVICE SERIES SECTION 1A5.010 BASIC SALARY SCHEDULE. That except as hereinafter specifically provided and subject to the other provisions of this resolution, each employee in the Police service enumerated in this Chapter other than those participating in the Educational Incentive Pay Program shall be entitled to receive for his or her services in his or her position the applicable rate of compensation shown in the following basic salary schedule prescribed for the class in which his or her position is allocated, to wit BASIC SALARY SCHEDULE SECTION 1A5.020 EDUCATIONAL INCENTIVE PAY SALARY SCHEDULES. The Chief of Police is authorized to conduct in his department, drills, practices or tests in the use and firing of sidearms and small arms by the members of his department in order to increase the efficiency of the members of his department in the use of such firearms. Such practices, tests or drills shall be held at such times and at such places as said Chief shall designate and shall be participated in by Such members of the department as the Chief may from time to time authorize so to do. Such tests, practices and drills shall be held under such conditions and at such times and subject to such rules as'to enable said Chief to properly make the certifications hereinafter referred to,, to the Personnel Officer. In addition to any compensation otherwise provided for any officer or member of said Police Department authorized to participate in any such drill, test or practice, there shall be paid a compensation in accordance with the following schedule to each'such'member of the department for his proficiency in the use and firing of such sidearms or small arms, and in the accuracy of such fire as indicated in the following schedule, to wit: Class 'S'core 'Out of P'os'slble- 4'80 Qualifying 350 Marksman. 375-400 Sharpshooter 401-440 Expert 441-473 Distinguished Expert 474-480 - 3 - Compensation for Proficiency per month $ 0.00 2.00 4.00 In addition to the above, each officer selected to serve on the pistol team,, not to exceed eight members of the department with the highest proficiency in firearms, under rules approved by the Chief of Police, shall receive an additional $5.00 per month during the time he serves on the team. Said additional compen- sation shall be payable only upon certification by the Chief of Police that the particular officer or member has qualified during the quarter preceding the certification with a score of 375 or better (indicating score), and that such person is entitled to the additional compensation for a class as set forth in such schedule. SECTION 1A5.050 MOTORCYCLE HAZARD PAY. All members of the Police Service assigned to motorcycle duty shall be compen- sated by an additional payment equal to seven percent of the "E" Step of the Police Officer classification while serving in such capacity. SECTION 1A5.060 EDUCATIONAL INCENTIVE PAY PROGRAM; OFFICERS ELIGIBLE. There is established an Educational Incentive Pay Program which shall apply to all sworn personnel of the Police Department, enumerated in this Chapter. 1. All sworn personnel first employed on or after September 1, 1970 who have qualified as hereinafter set forth; 2. All sworn personnel of the Police Department employed prior to September 1, 1970 who have elected to participate in the program and have filed a written election to do so with'the'Personnel Officer. Such written election shall be irrevocable. SECTION 1A5.070 EDUCATIONAL INCENTIVE PAY PROGRAM-- ADMINISTRATION. The program shall be administered in accordance with the revised "Educational Incentive Pay Program Rules, Regulations and Procedures" as revised to August 7, 1972, a copy of which is on file in the office of the City Clerk. - 4 - SECTION 1A5.080 EDUCATIONAL INCENTIVE PAY PROGRAM-- STEP ADVANCEMENT. All sworn personnel in the El Segundo Police Department employed prior to September 1, 1970 who have subscribed to and are entitled to the Educational Incentive Pay shall advance to Step B-1 or 2; C-1 or 2; D-1 or 2; or E-1 or 2 to whichever they are entitled by classification and length of service), in accordance with the Educational incentive Pay Program Salary Schedules for Intermediate or Advanced Certificates set forth in Section 1A5.020 of this Chapter. Educational incentive pay shall not be automatic. Each officer must continue to be proficient and is subject to annual examination and evaluation. Should a police officer receive an unsatisfactory rating, the educational incentive pay shall be terminated until such time as the employee receives a satisfactory rating. SECTION 1A5.090 STEP ADVANCEMENT--BASIC SALARY SCHEDULE. The advancement of a new employee from Step A shall be on the new employee's anniversary date which is established as the day immediately following satisfactory completion of his or her first six months' service; Steps B,C and D contemplate one year's service in each of such classification subject to the limitations of Section 1A5.130 and the advancements therefrom shall be on the anniversary date of the employee; Step E contemplates continued service in such classifications until further advancement is indicated by reason of longevity. SECTION 1A5.100 LONGEVITY ACHIEVEMENT. Steps X,Y and Z of the Basic Salary Schedule (or in the case of sworn personnel of the Police Department entitled to the Educational Incentive Pay, Steps X-1, Y-1 and Z-1. or Steps X-2, Y-2 and Z-2 of the Police Officers' Educational Incentive Pay Program Salary Schedules) are longevity provisions and are to be used in applying the following policy: Upon attaining seven years of continuous service with the City,, an employee shall be compensated at Step X - 5 - 118 "78 (or X-1 or X-2); upon attaining fourteen years of continuous service with the City, an employee shall be compensated at Step Y (Y-1 or Y-2); and upon attaining twenty-one years of continuous service with the City, an employee shall be compensated at Step Z (or Z-1 or Z-2) provided, however, that employees may be paid at a higher level than the foregoing schedule when necessary to comply with the requirements of Section 1A6.090 of the General Rules. SECTION 1A5.110 LONGEVITY EXCEPTIONS. The provisions of Step X, Y and Z of the Basic Salary Schedule shall not apply to any sworn member of the Police Department except sworn personnel of the Police Department employed before September 1, 1970 who have not elected to participate in the Educational Incentive Pay Program. SECTION 1A5.120 STEP ADVANCEMENT--ANNIVERSARY DATE. An employee! advanced from any range to another range of the Basic Salary Schedule shall receive a new anniversary date which is the date of the change. Other changes in salary, unless specifically directed by the Council or as provided in Section 1A5.130, shall not change the anniversary date, except for promotions made in accordance with the Personnel Merit System Ordinance of the Personnel Rules and Regulations. The City Council reserves the right at any time, and in its sole discretion, to change the range number assigned to any officer or employee and to determine the particular step in any range number which is to be thereafter assigned to any such officer or employee. SECTION 1A5.130 STEP INCREASES ON MERIT--BASIC SALARY SCHEDULE. An employee will be eligible for advancement to a higher.step on the basis of service time as described in Section 1A5.090 and satisfactory performance I of duties. An employee will be presumed to merit an increase unless his or her Department Head notifies the Personnel Officer in writing at least ten days in advance of the scheduled increase that the increase should be withheld, stating reasons. The reasons shall be provided to the employee in writing. If the employee's performance subsequently improves to a satisfactory level, the step increase will be granted and the date of increase will become the employee's anniversary date. SECTION 1A5.140 OVERTIME PAY--COMPENSATORY TIME. During Calendar Year 1975 compensatory time may be substituted for overtime payment for sworn Police Department employees if approved by the City Manager, provided that the accumulation may not exceed twenty-four hours, or thirty hours for employees assigned to a four-day ten-hour working schedule, or three working days at any one time, and no more than eighty hours may be accumulated or used in any one calendar year and compensatory time may not be substituted for.hours worked in excess of sixty hours in a seven day per . iod; compensatory time may be used in conjunction with normal vacation with prior approval of the City Manager. No more than three consecutive days for compensatory time may be used. SECTION 1A5.150 OVERTIME PAY. Except as otherwise hereinafter provided, the members of the Police Department of said City shall work regularly scheduled shifts to be promulgated and established from time to time by the City Manager. It is provided., however, that where a member of the Police Department is required. to render more than eight hours service, or ten hours service when assigned to a four-day ten-hour working schedule, in any onr day or more than forty hours per week, such member shall be entitled to receive, and there'shall be paid to him additional compensation for such over-time at one and one-half times his or her regular rate of pay. - 7 - 1 Arl- J I rs 3 0 Straight time only will be paid all police personnel entitled', to overtime for the following duty assignments: 1. Approved departmental in-service training and specialized training schools, except that: a. officers promoted in rank and who are required to attend in-service classes to gain the knowledge necessary to perform their new duties and responsibilities of said position, shall not be compensated in overtime pay for the hours spent in training over and above a normal eight-hour day, or a ten-hour day for employees assigned to a four-day ten-hour working schedule; and b. Overtime pay shall not be paid to police personnel who attend a basic recruit school learning the duties and responsibilities of their new career in law enforcement. 2. Staff meetings. 3. Public relations appearances (speeches, etc.) 4. Photography work. 5. Such other similar duty that may develop in the future. Police officers required to appear in court during scheduled off-duty hours will be paid for a minimum of two hours duty. Police officers entitled to marksmanship compensation who are required to shoot in Manhattan Beach during off-duty hours in order to qualify for marksmanship compensation shall be entitled to be paid one hour at straight time salary rates for each time they are required to shoot but not in excess of once each calendar month. SECTION 1A5.160 HOLIDAYS--PAYMENT IN LIEU. Police Department personnel who are regularly required to work on holidays, notwithstanding any provision herein to the contrary, shall be paid for eighty-eight hours in lieu of holidays once a year on or about the 10th day of December. Employees who terminate shall be paid holiday pay on a pro rata basis. • 0 SECTION 1A5.220 VACATIONS. The members of the Police Department in the positions enumerated in Section 1A5.030 of this Chapter shall accumulate vacation time in accordance with the following Schedule. 1. Ninety-six hours per year with full salary for the first seven years of continuous service with the City. 2. One hundred thirty six hours per year with full salary after seven years and until the completion of fourteen years of continuous service. 3. One hundred seventy six hours per year with full salary after fourteen years of continuous service. SECTION 1A5.230 VACATIONS--GOVERNMENT CODE PROVISIONS. Annual vacations or leaves of absence for the sworn personnel of the Police Department shall be not less than as required by Section 38634 of the Government Code. SECTION 1A5.240 UNIFORM AND SAFETY EQUIPMENT ALLOWANCES. Following the effective date of this resolution, Police Department employees who are required to purchase and continuously maintain prescribed items of uniform clothing, personal equipment and safety equipment shall be compensated for a portion of the initial and maintainance costs thereof according to the following: 1. a. Police officers assigned to motorcycle duty - $21.00 per month of active duty. b. Police detectives and others who normally wear civilian clothes on duty, but are required to maintain uniforms - $12.50 per month of active duty. C. Police dispatcher clerks, police cadetes and police desk clerks - $9.00 per month of active duty. d. All other police officers - $15.00 per month of active duty. - 10 - 2. Newly appointed police officers shall be provided with uniform allowances at the time of appointment and thereafter as follows: a. At the time of appointment - 1500 of annual allowance. b. At first anniversary of appointment - 500 of annual allowance. C. After first anniversary - 100% of monthly allowance. 3. Newly appointed dispatcher clerks and police desk clerks at the time of appointment - $110.00 SECTION 1A5.250 POLICE RESERVES. Reserve police officers shall be peace officers within the meaning of Section 830.6 of the Penal'Code of the State of California. Reserve police officers shall be provided Worker's Compensation benefits as if they were paid the minimum wage required to qualify for such benefits. Reserve police officers shall receive no compensation. SECTION 1A5.260 CONSULTANT SPECIALISTS. Consultant specialists shall be provided Worker's Compensation benefits as if they were paid the minimum wage required to qualify for such benefits, Consultant Specialists shall receive no compensation. SECTION 1A5.270 PROVISIONS OF CHAPTER LIMITED. The provisions of this Chapter are applicable to members of the police service enumerated in Section 1A5.030 of this Chapter. SECTION 2. Chapter 1A5 of Title 1A of the "El Segundo Administrative Code" is rescinded. SECTION 3. The City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of original resolutions of said City; and shall make a minute of the passage and adoption thereof in the records of the - 11 - proceedings of the City Council of said City in the minutes at which the same is passed and adopted.
