THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES RESOLVE AS FOLLOWS: SECTION 1. Title lA of the "El Segundo Administrative Code" hereinafter set forth is hereby adopted. The salaries or compensation of the members of the City Council of the City of El Segundo, are fixed by law at the sum of One Hundred Fifty Dollars ($150. 00) per month each. SECTION 1A1. 030 RECREATION COMMISSION MEMBERS: Recreation Commissioners shall be compensated for his or her services at the rate of $10. 00 for each meeting attended, not to exceed -three meetings per calendar month. The City Manager shall fix the salaries of the persons enumerated in Section 1A2. 040 of this Chapter. I Me SECTION 1A2.030 EXPLANATION OF SALARY SCHEDULE QUARTILE SYSTEM. Each salary range enumerated in Section 1A1. consists of a minimum and maximum salary that is divided into quartiles which the City Manager may use as practical guides for administrative purposes, as follows: First Quartile. Newly hired or promoted employees shall be naid the minimum salary unless they clearly nossess unusual qualifications and experience. Second Quartile. Employees meeting the average job requirements shall be paid within the second quartile, Third Quartile. Employees demonstrating above average job per- formance shall be paid within the third quartile. Fourth Quartile. Employees making an outstanding contribution to the City in their jobs shall be na id within the fourth quartile. The foregoing practical guides shall not be construed as restrictions upon the discretion of the City Council or the City Manager who, in cases they consider appropriate, may disregard such practical guides. The control point. shall be used to compare salaries in the job market. A salary increase above the control point is recognition of above average service. SECTION IA2.040 SCHEDULE OF CLASSES BY SERIES. City Librarian Plan Check Engineer lie Street Maintenance Superintendent Recreation Superintendent Associate Planner Park Maintenance Superintendent F5 Water Supervisor Water Quality and Sanitation Supervisor Purchasing/Business License Officer As sistant City Librarian Garage Supervisor Administrative Assistant to City Manager Administrative Secretary Legal Aide Range No. (cont, ) XT X TX VITT VTI VT V TV TV IV III ITI IT I SECTION 1A2.050 EDUCATIONAL INCENTIVE PAY -- CONTINUATION, Police Captains and Fire Battalion Chiefs shall continue to receive the amount of educational incentive pay received as of June 30, 19740 however, such benefits shall not thereafter be increased, On and after July 1, 1974, employees appointed to said classifications shall continue to receive the amount of educati.onal incentive -oay they received at the time of appointment to said classifications, but such benefits shall not be increased thereafter, SECTION IA2.060 EVALUATION BY CITY MANAGER- -DEPARTMENT HEADS. The City Manager shall evaluate those employees who report directly to him. The remaining Management -- Confidential employees shall be evaluated by their department heads. The City Manager shall approve all performance salary adjustments. Criteria for granting salary adjustments shall include but not be limited to: 1, present salary. 2, length of service, 3, quality and quantity of work performed, 4, increased comi)etence in handling job resnonsibilities. 5, attitude and loyalty to City duties. 6e efforts toward self - improvement, 7. exceptional nerformance. TA_ SECTION IA2.070 SALARY INCREASES BASED ON PERFORMANCE. Salary increases shall be based on evaluation of an individual's performance; there shall be no automatic step progression and no longevity step increases. Salary increases shall normally be made once each year on or near July 1. Increases may be made at other times on the basis of superior job performance or unusual circumstances. Newly hired employees shall be eligible for growth salary increases six months after employment. Salary increases shall be granted in one percent in--remc:::nts in accordance with the salary sched-,ule shown in Section 1A2.010. The maximum increase that may be approved by the City Manager for each employee in any fiscal year is ten percent. Increases in excess of ten percent shall • be s,Ubmitted to the City Council for appr oval. A salary increase, when granted, shall continue for the entire fiscal year unless the City Manager recommends and the Council approves a decrease. SECTION IA2.080 OVERTIME PAY--EXCEPTION. Management- Confidential employees shall not be paid overtime pay. Fire Battalion Chiefs assigned -to Fire Suppression shall be paid straight time rates for time worked on platoon duty or scheduled or non-scheduled re -hires in excess of fifty-%ix hours per week; provided, however, should the Fair Labor Standards Act be ruled applicable, overtime payment shall be made in accordance with' rules established pursuant Thereto. SECTION IA2.090 RESIDENCE REOUTREMENTS. Within eighteen months following employment or promotion, the City Manager, Chiefs of Police and Fire Departments, City Librarian, Directors of the Finance Department, Building Safety Department, Planning Denartment, Public Works Department, and Recreation and Parks Department shall live within the El Segundo city limits, except that 'the City Council may consent to an extended period of residence outside the El Segundo city limits. SECTION 1A2.100 EXECIJ)TIVE LEAVE. On and after July 1, 1974, Management, - Confidential employees shall be granted three days executive leave with nay each calandar year which may be used for nersonal. business, att- endance at educational courses, or for additional Vacation. Such leave may not be accrued, • _ 9 • SECTION 1A2.110 ADDITIONAL EMPLOYMENT. A Department Head who is employed full-time by the City shall not accept other work or actively participate in the management of a private profit- producing activity outside of his employment with the City of El Segundo, without first obtaining approval of the City Council, and upon showing that such activity will not conflict with his discharge of duties of employment with the City. SECTION 1A2.120 DEFERRED COMPENSATION PLAN. A deferred compensation plan has been established as a benefit to management- confidential employees. Each management- confidential employee is eligible to participate in the plan, SECTION 1A.2.130 UNIFORM ALLOWANCES.: Management- confidential employees in the Police and Fire Departments who are required to purchase and continuously maintain prescribed items of uniform clothing and personal equipment shall be compensated for a portion of the initial and maintainance costs thereof according to the following; 1. Police Chief and Police Captains - $12. 50 per month of active duty.. 2. Fire Chief and Fire Battalion Chiefs - $120. 00 per year. SECTION 1A2.140 . HOLIDAYS AND HOLIDAY PAY- BATTALION CHIEFS, Battalion Chiefs assigned to fire suppression duty shall be paid for one hundred thirty-two hours in lieu of holidays once a year on or about the 10th day of December. Battalion Chiefs who terminate shall be paid holiday pay on a pro rata basis. SECTION 1A2,150 SALARIES AND BENEFITS APPLICABLE. The provisions of this Chapter are applicable to Management- Confidential. employees enumerated in Section 1A2. 040 of this Chapter. Management- Confidential employees shall receive the employment benefits extended by this Title to general government employees except as provided herein or as provided by law. - 10 - CHAPTER 1A3 GENERAL GOVERNMENT SERIES SECTION 1A3.010 BASIC SALARY SCHEDTJLE. Employees employed on and after July 16, 1974 shall not be eligible to receive longevity benefits. - 1.5 - SECTION 1A3.050 LONGEVITY ACHIEVEMENT. Steps X, Y and Z of the Basic Salary Schedule are longevity -provisions and are to be used in applying the following policy: Upon attaining seven years of continuous service with the City, an employee shall be compensated at Step X; upon attaining fourteen years of continuous service with the City, an employee shall be compensated at Step Y; and upon attaining twenty-one years of continuous service with the City, an employee shall be compensated at Step Z provided, however, that employees may be paid at a higher level than the foregoing schedule when necessary to comply with the requirements of Section 1A6.090 of this Title. Employees employed on and after July 16, 1974 shall not be eligible to receive longevity benefits. SECTION 1A3.060 STEP ADVANCEMENT -- ANNIVERSARY DATE. An employee advanced from any range to another range of the Basic Salary schedule shall receive a new anniversary date which is the date of the change. Other changes in salary, unless specifically directed by the Council or as provided in Section 1A3. 070 shall not change the anniversary date, except for promotions made in accordance with the Personnel Merit System ordinance of the Personnel Rules and Regulations. The City Council reserves the right at any -time, and in its sole discretion, to change the range number assigned to any officer or employee and to determine the particular step in any range number which is to be thereafter assigned to any such officer or employee. SECTION 1A3.070 INCREASES ON MERIT - -BASIC SALARY SCHEDULE. An employee shall be eligible for advancement to a higher step on the basis of service 'time as described in Section IA3. 04P and satisfactory Derformance of duties. An employee will be presumed to merit an increase unless his Department Head notifies the Personnel Office in writing at least ten days in advance of the schedules increase that the increase should be withheld, stating reasons. The reasons shall be -provided to the employee in writing. If the employee's performance subsequently improves to a satisfactory level, the step increase will be granted and the date of increase will become the employee's anniversary date. SECTION IA3.080 OVERTIME PAY. Except as otherwise herein specifically provided, an employee subject to the rule of eight hours per day and forty hours per week, required to put in. more time on his or her class - ification for routine or administrative reasons, shall be com-nensated at the rate of one and one-half time his regular rate of pay. - 16 - SECTION IA3.090 OVERTIME PAY -- RECALL MINIMUM HOURS.' Employees who are required to return to work at a time other than their scheduled work day shall be comoensated for a minimum of two hours of work. SECTION IA3,100 HOLIDAYS AND HOLIDAY PAY. If library employees observe February 12th as a holiday instead of the Friday following Thanksgiving day, they shall not receive overtime pay on the Friday following Thanksgiving day. All permanent employees who are entitled to receive overtime pay shall be entitled to be off for all City holidays; or, if they are required to work unon a City holiday, shall be entitled to time and one-half for such work. SECTION 1A3.110 SICK LEAVE AFTER EIGHT YEARS - -- PA.YMENT OF ONE-HALF ON TERMINATION. In the event an employee to whom this section applies has completed eight or mDre years of service with the City and resigns or is -terminated for any reason other than those enumerated in Sections 1A6. 140 and IA6. 150 of this Title and has unused sick leave to his credit at the time of termination of his service, such employee shall be compensated in an amount equal to one-half the value of his sick leave based upon his current salary at the time of such termination without the inclusion of overtime pay or additional comvensation. - 17 - SECTION IA3.120 SICK LEAVE ACCRUED -- PAYMENT ON TERMINATION PRIOR TO DECEMBER 1. Employees who terminate prior to the first day of December while maintaining a balance of more than 1056 hours of sick leave shall also be paid for one-half of their unused accrued sick leave accumulated since the preceding December 1. SECTION IA3.130 VACATIONS. Employees regularly employed shall accumulate vacation time in accordance with the following schedule: 1, twelve working days per year with full salary for the first seven years of continuous service with the City. 2. Seventeen working days per year with full salary after seven years and until the completion of fourteen years of continuous service; 3. There is herewith established an educational incentive pay program which shall apply to uniformed members of the Fire Department enumerated in this Chapter. SECTION 1A4.050 EDUCATIONAL INCENTIVE PAY -- ADMINISTRATION, The Fire fighter's educational incentive _pay program shall be administered in accordance with the "Fire Department Educational Incentive Pay Program" effective on January 1, 1972, a copy of which is on file in the office of the City Clerk. SECTION 1A4.060 EDUCATIONAL INCENTIVE PAY -- ELIGIBILITY. Each employee who qualifies for educational incentive pay shall remain eligible until his employment with the City of El Segundo is terminated or he receives an unsatisfactory performance evaluation. Should an eligible employee receive an unsatisfactory rating, the educational incentive pay shall be discontinued until such time as the employee receives a satisfactory rating. SECTION 1A4.070 EDUCATIONAL INCENTIVE PAY -- MAXIMUM LONGEVITY. The combined total of the educational incentive pay and longevity pay for uniformed members of the Fire Department may not' exceed seventeen percent (17 ranges) of Step E of the salary range set . forth in Section 1A4. 010 of this Chapter. SECTION 1A4.080 EDUCATIONAL INCENTIVE PAY BASIC SALARY SCHEDULE- -STEP ADVANCEMENT. Members of the Fire Department hired on and after July 1, 1974, shall not be eligible for longevity pay. SECTION 1A4.100 LONGEVITY ACHIEVEMENT ON MERIT. Advancement of uniformed members of the Fire Department enumerated in this Chapter to Steps X, Y and Z of the Basic Salary Schedule shall be based on the satisfactory performance of duties as indicated by performance evaluation. An employee in the fire service shall be presumed to merit an increase in pay as provided in Section IA4. 090 unless his current performance evaluation on file rates him below standard or unsatisfactory and the Fire Chief notifies the Personnel Officer and employee in writing at least -ten days in advance of the scheduled increase that the increase in pay should be withheld, stating reasons. If the employee's performance subsequently improves to a satisfactory level, the longevity Day will be granted upon the issuance of satisfactory performance report. , SECTION 1A4.410 STEP ADVANCEMENT- - ANNIVERSARY DATE. SECTION IA4.130 OVERTIME PAY Except as otherwise herein provided, the members of the Fire Department shall work on a fifty-six hour per week schedule in shifts to be promulgated and established from time to time by the City Manager. It is provided, however, that where members of the Department are required to work overtime, such members shall be entitled to additional compensation at straight time rates, based on forty hours per week for special details and assignments other than fire and rescue calls, and when required to work overtime on a regular fire fighting company assignment, shall be -paid straight time based on the regular fifty-six hour week; Fire Department members who are recalled to work at a time other than their scheduled work day shall receive a minimum compensation of $5. 00 per call. SECTION IA4.140 HOLIDAY PAY- -SHIFT WORK. Fire Department personnel who work shifts and are regularly required to work on holidays, notwithstanding any provision herein to the contrary, shall be paid for one hundred twenty hours in lieu of holidays once a year on or about the 10th day of December. Employees who terminate shall be paid holiday pay on a pro rata basis. -23- SECTION 1A4.150 SICK LEAVE: LEAVE WITH PAY DUE TO ILLNESS: ACCUMULATION OF SAME: SHIFT WORK. Sick leave with pay may be granted for an absence from duty because of personal illness, injury, or legal quarantine not compensable under the provisions of the Workmen's Compensation Laws of the State of California. Members of the Fire Service in the positions enumerated in Section 1A4. 030 of this Chapter who work shifts shall accumulate sick leave at the rate of one twelve -hour day accumulation for each month's service, not to exceed a maximum of 1584 hours. Hours worked in addition to a regular work week shall not entitle an employee to additional sick leave accumulation. . Sick leave taken by an employee shall be deducted from his accumulated credit. SECTION 1A4.160 VACATIONS- -FORTY HOUR WEEK. The members of the Fire Department in the positions enumerated in Section 1A4.030 of this Chapter who work forty hours a week shall accumulate vacation time in accordance with the following schedule: 1. Twelve working days per year with full salary for the first seven years of continuous service with the City. 2. Seventeen working days per year with full salary after seven years and until the completion of fourteen years of continuous service. 3. Twenty -two working days per year with full salary after fourteen years of continuous service. SECTION lA.4. 170 VACATIONS- -SHIFT WORKERS. The members of the Fire Department in the positions enumerated in Section 1A4.030 of this Chapter who work forty hours a week shall accumulate vacation time in accordance with the following schedule: 1. Six shifts per year with full salary for the first seven years of continuous service with the City; 2. Eight and one -half shifts per year will full salary after seven years and until the comple ti on offourteen y ears of continuous service; 3. Eleven shifts per year with full salary after fourteen years of continuous service. SECTION 1A4.1.80 VACATIONS --- GOVERNMENT CODE PROVISIONS. Annual vacations or leaves of absence for members of the Fire Service shall be not less than as required by Section 53250 of the Government Code. - 24 -- • • SECTION 1A4.190 UNIFORM AND SAFETY EQUIPMENT ALLOWANCE.' Following the effective day of this resolution, fire fighting em- ployees who are required to purchase and continuously maintain prescribed items of uniform clothing, personal equipment, and safety equinment shall be com- pensated for a portion of the initial and maintenance costs thereof according to the following: 1. All fire fighting personnel $120. 00 per year, 2. Newly appointed fire department personnel shall be provided with uniform allowances at the time of appointment and thereafter as follows. a. At the time of appointment -150% of annual allowance. b. At first anniversary of appointment- 50% of annual allowance, C. After first anniversary -100% of monthly allowance. SECTION 1A4.200 PROVISIONS OF CHAPTER LIMITED. Said additional compen- sation shall be payable only upon certification by the Chief of Police that the particular officer or member has qualified during the quarter nreceding the certification with a score of 375 or better (indicating score), and that such person is entitled to the additional compensation for a class as set forth in such schedule. SECTION 1A5.050 MOTORCYCLE HAZARD PAY. All members of the Police Service assigned to motorcycle duty shall be comt)ensated by an additional ,payment equal to seven percent of the "E" Step of the Police Officer classi- fication while serving in such capacity. 10 -28- • SECTION 1A5.060 EDUCATIONAL INCENTIVE PAY PROGRAM; OFFICERS ELIGIBLE.' There is established an Educational Incentive Pay Program which shall apply to all sworn personnel of the Police Department, enumerated in this Chanter. 1. All sworn personnel first employed on or after September 1, 1970 who have qualified as hereinafter set forth; 2. All sworn -personnel of the Police Department employed prior to September 1, 1970 who have elected to participate in the orogram and have filed a written election to do so with the Personnel Officer, Such written election shall be irrevocable. SECTION 1A5.070 EDUCATIONAL INCENTIVE PAY PRO- GRAM- -ADMINISTRATION. The program shall be administered in accordance with the revised "Educational Incentive Pay Program Rules, Regulations and Procedures" as revised to August 7, 1972, a copy of which is on file in the office of the City ClQrk. SECTION 1A5.080 EDUCATIONAL INCENTIVE PAY PRO- GRAM--STEP ADVANCEMENT. All sworn nersonnel in the El Segundo Police Department employed prior to September 1, 1970 who have subscribed to and are entitled to the Educational Incentive Pay shall advance to Ste-0 B-1 or 2; C-1 or 2; D-1 or 2; or E-1 or 2 ( to whichever they are entitled by classification and length of service), in accordance with the Educational Incentive Pay Program Salary Schedules for Intermediate or Advanced Certificates set forth in Section 1A5. 020 of this Chapter. - Educational incentive pay shall not be automatic. Each officer must continue to be proficient and is subject to annual examination and evaluation, Should a police officer receive an unsatisfactory rating, the educational incentive pay shall be terminated until such time as the employee re- ceives a satisfactory rating. SECTION 1A5.090 STEP ADVANCEMENT- -BASIC SALARY SCHEDULE. The advancement of a new employee from Step A shall be on the new employee's anniversary date which is established as the day immediately following satisfactory -29- • • completion of his first six months' service; Steps B, C and D contemplate one year's service in each of such classification subject to the limitations of Section IA5. 130 and the advancements therefrom shall be on the anniversary date of the employee; Step E contemplates continued service in such classi- fications until further advancement is indicated by reason of longevity. SECTION 1A5. 100 LONGEVITY ACHIEVEMENT. Steps X, Y and Z of the Basic Salary Schedule (or in the case of sworn personnel of the Police Department entitled to the Educational Incentive Pay, Steps X-1, Y-1 and Z-1, or Steps X-2, Y-2 and Z,2 of the Police Officers' Educational Incentive Pay Program Salary Schedules) are longevity provisions and are to be used in applying the following policy; Upon attaining seven years of continuous service with the City, an employee shall be compensated at Step X (or X-1 or X-2); upon attaining fourteen years of continuous service with .the City, an employee shall be comp- ensated at Step Y (Y-1 or Y-2); and upon attaining twenty-one years of continuous service with the City, an employee shall be compensated at Sten Z (or Z-i or Z-2) provided, however, that employees may be naid at a higher level than the fore- going schedule when necessary to comply with the requirements of Section SECTION 1A5.110 LONGEVITY EXCEPTIONS. The nrovisions of Sten X, Y and Z of the Basic Salary Schedule shall not apply to any sworn member of the Police Department except sworn nersonnel of the Police Department employed before September 1, 1970 who have not elected to participate in the Educational Incentive Pay Program. SECTION IA5.120 STEP ADVANCEMENT- - ANNIVERSARY DATE.' An employee advanced from any range to another range of the Basic Salary Schedule shall receive a new anniversary date which is the date of the change, Other changes in salary, unless specifically directed by the Council or as provided in Section IA5. 130,1 shall not change the anniversary date, except for nromotions made in accordance with the Personnel Merit System Ordinance of the Personnel Rules and Regulations, The City Council reserves the right at any time, and in its sole discretion, to change the range number assigned to any officer or em- ployee and to determine the particular sten in any range number which is to be thereafter assigned to any such officer or employee. SECTION 1A5.130 STEP INCREASES ON MERIT - -BASIC SALARY SCHEDULE. An employee will be eligible for advancement to a higher step on the basis of service time as described in Section 1A5. 090 and satisfactory performance of duties. An employee will be -presumed to merit an increase unless his -30- [J • 181 - Department Head notifies the Personnel Officer in writing at least ten (10) days in advance of the scheduled increase that the increase should be withheld, stating reasons. The reasons shall be provided to the employee in writing. If the em- ployee's performance subsequently improves to a satisfactory level, the step increase will be granted and the date of increase will become the employee's anniversary date. SECTION 1A5.140 OVERTIME PAY -- COMPENSATORY TIME. During Calendar year 1975 compensatory time may be substituted for overtime payment for sworn Police Department employees if approved by the City Manager, pro- vided that the accumulation may not exceed twenty -four (24) hours, or thirty hours for employees assigned to a four -day ten hour working schedule, or three working days at any one time, and no more than eighty hours may be accumulated or used in any one calendar year and compensatory time may not be substituted for hours worked in excess of sixty (60) hours in a seven (7) day period; compensatory time may be used in conjunction with normal vacation with prior approval of the City Manager. No more than three (3) consecutive days for compensatory time may be used. SECTION 1A5.150 OVERTIME PAY. Except as otherwise herein- after provided, the members of the Police Department of said City shall work regularly scheduled shifts to be promulgated and established from time to time by the City Manager. It is provided, however, that where a member of the Police Department is required to render more than eight hours service, or ten hours service when assigned to a four day ten -hour working schedule, in any one day or more than forty hours per week, such .member shall be entitled to receive, and there shall be paid to him, additional compensation for such overtime at one and one -half times his or her regular rate of pay. Straight time only will be paid all police personnel entitled to overtime for the following duty assignments: 1. Approved departmental in- service training and specialized training schools, except that: a. Officers promoted in rank and who are required to attend in- service classes to gain the knowledge necessary to perform their new duties and respons- ibilities of said position, shall not be compensated in overtime pay for the hours spent in training over and above a normal eight -hour day, or a ten -hour day for employees assigned to a four -day ten -hour working schedule; and - 31 - • b. Overtime pay shall not be paid to police personnel who attend a basic recruit school learning the duties and responsibilities of their new career in law enforcement.. 2. Staff meetings. 3. Public relations appearances (speeches, etc. ) 4. Photogranhy work. 5. Such other similar duty that may develop in the future. Police officers required to appear in court during scheduled off -duty hours will be paid for a minimum of two hours duty. Police officers entitled to marksmanship compensation who are required to shoot in Manhattan Beach and who shoot in Manhattan Beach during off -duty hours in order to qualify for marksmanship compensation shall be entitled to be maid one hour at straight time salary rates for each time they are required to shoot but not in excess of once each calendar month. SECTION 1A5.160 HOLIDAYS -- PAYMENT IN LIEU. Police Depart- ment personnel who are regularly required to work on holidays, notwith- standing any provision herein to the contrary, shall be paid for eighty -eight hours in lieu of holidays once a year on or about the 10th day of December. Employees who terminate shall be paid holiday pay on a pro rata basis. SECTION 1A5.170 LATERAL ENTRY PROGRAM. The City shall allow lateral entry of qualified peace officers from other agencies who desire employ- ment in the El Segundo Police Department in the position of policeman in an ad- vanced status, in accordance with the provisions hereinafter set forth. SECTION 1A5.180 LATERAL ENTRY - COMPENSATION UNDER BASIC SALARY SCHEDULE. Subject to the approval of the City Manager, police officers. entering the service of the El Segundo Police Department under the Lateral Entry Program shall receive compensation under the Basic Salary Schedule at the salary step to which they are entitled by their total number of years of law enforcement experience. SECTION 1A5.190 LATERAL, ENTRY- OUALIFICATIONS FOR EDUCATIONAL INCENTIVE PAY. Police Officers who enter the service of the El Segundo Police Department under the Lateral Entry Program and have qualified for and are entitled to the Educational Incentive Pay shall receive compensation in accordance with the Educational Incentive Pay Program Salary schedules for intermediate or Advanced Certificates set forth in Section 1A5. 020 of this Chapter. -32- 11 F) 3 �37 SECTION IA5.200 LATERAL ENTRY - SICK LEAVE TRANSFER- ABLE. Policemen who enter the service of the El Segundo Police Department under the Lateral Entry Program shall be allowed to transfer their accumulated sick leave from the preceding employing agency at a rate of one hundred percent up to a maximum of two hundred forty hours. SECTION IA5.210 LATERAL ENTRY - VACATIONS AND OTHER BENEFITS. Police Officer's who enter the service of the El Segundo Police Department under the Lateral Entry Program shall be new employees with no rights of seniority in the treatment of vacation or any other benefit accrued by right of seniority. SECTION 1A5.220 VACATIONS - The members of the Police Depart- ment in the positions enumerated in Section 1A5.030 of this Chapter shall accu- mulate vacation time in accordance with the following schedule: 1. Ninety-six hours per year with full salary for the first seven years of continuous service with the City. 2. One hundred thirty six hours per year with full. salary after seven years and until the completion of fourteen years of continuous service: 3. One hundred seventy-six hours per year with full salary after fourteen years of continuous service. SECTION IA5.230 VACATIONS - GOVERNMENT CODE PROVISIONS. Annual vacations or leaves of absence for the sworn personnel of the Police Department shall be not less than as required by Section 38634 of the Government Code. SECTION 1A5.240 UNIFORM AND SAFETY EQUIPMENT ALLOWANCES. Following the effective date of this resolution, police department employees who are required to purchase and continuously maintain nrescribed items of uniform clothing, personal equipment and safety equipment shall be compensated for a portion of the initial and maintainance costs thereof according to the following: a. Police officers assigned to motorcycle duty - $21. 00 per month of active duty. b. Police detectives and other who normally wear civilian clothes on duty, but are required to maintain uniforms - $12. 50 per month of active duty. -33- I . 18 118 4 SECTION 1A5.250 POLICE RESERVES. Reserve police officers shall be peace officers within the meaning of Section 830.6 of the Penal Code of the State of California. Reserve police officers shall be provided Workmen's Compensation benefits as if they were paid the minimum wage required to qualify for such benefits. Reserve police officers shall receive no compensa- tion. SECTION IA5.260 CONSULTANT SPECIALISTS. Consultant spe- cialists shall be provided Workmen's Compensation benefits as if they were paid the minimum wage required to qualify for such benefits. Consultant Specialists shall receive no compensation. SECTION 1A5.270 PROVISIONS OF CHAPTER LIMITED. The pro- visions of this Chapter are applicable to members of the police service enumera- ted in Section 1A5. 030 of this Chapter. - 34 - C. Police dispatcher clerk, police cadets and police desk clerks - $9. 00 per month of active duty. d. All other police officers - $15. 00 per month of active duty. 2. Newly appointed police officers shall be provided with uniform allowances at the time of appointment and thereafter as follows: a. At the time of appointment - 150% of annual allowance b. At first anniversary of appointment - 50% of annual allowance. C. After first anniversary 100% of monthly allowance. 3. Newly appointed dispatcher clerks and police desk clerks at the time of appointment 7 $110. 00. SECTION 1A5.250 POLICE RESERVES. Reserve police officers shall be peace officers within the meaning of Section 830.6 of the Penal Code of the State of California. Reserve police officers shall be provided Workmen's Compensation benefits as if they were paid the minimum wage required to qualify for such benefits. For employees not on the payroll on January 1, 1968. (1) Permanent Full-Time Emplovees. Length of service shall be counted from the date of last continuous permanent employment. (2) Permanent Part-Time Employees Length of services a e counted from date of last continuous permanent employment, regardless of hours worked, -provided the positions occupied are specified as permanent part-time positions in the budget or by personnel authorization. (3) Other Part-time or Temporary Employees * Service ME not be counted toward longevity or step increases. b. For employees on the payroll as of January 1. 1968, length of service shall be computed on the length of time an employee has been continuously in the service of the City in any capaci ty. An absence for a period of ninety or more consecutive days shall constitute a break in service for the purpose of determining continuous service. 8. That all employees of said City (excepting those to whom these rules do not apply, as hereinabove or hereinafter set forth, shall render their respective services on a working schedule of forty hours per week, and the City Manager shall designate the particular days and hours such respective employees are to render service to the said City. 9, The City Manager may require any employee or employees to render service for more than the period required by this Chapter in all cases where the City Manager feels that such additional service is essential for the best interests of the City at the time. SECTION 1A6.030 TEMPORARY EMPLOYEES UNCLASSIFIED. Temporary employees for whom no classification or range number is provided or whose compensation is not otherwise fixed by this resolution shall receive such compensation as the City Council shall designate in the resolution or order of appointment for such respective temporary employees, - 36 - 1W • E . 1, J- 8, 7 SECTION 1A6.040 TEMPORARY EMPLOYEES -FRINGE BENEFITS.' Temporary employees and permanent Dart-time employees who by reason of their limited employment schedule do not qualify for coverage under the Public Employees' Retirement Law, shall not receive paid sick leaves, paid vacations and -oaid holidays; permanent nart-time employees who qualify for coverage under the Public Employees' Retirement Law shall receive the fringe benefits accorded all regular full-time emoloyees including vacation and sick leave on a pro rata basis. SECTION IA6.050 TEMPORARY EMPLOYEES--CETA --FRINGE BENEFITS. Temporary employees employed pursuant to the Comprehensive Employment and Training, Act on a full-time basis, shall receive the fringe benefits accorded all regular full-time employees. Temporary employees employed pursuant to CETA on other than a full-time basis shall receive sick leave and vacation time on a pro rata basis. SECTION IA6.060 EMERGENCY APPOINTMENTS. I That not- withstanding any other provision contained in this resolution, it is here- by orovided that in case of any emergency or unusual circumstances or conditions, which may exist or arise within the city, or in any office or department thereof, the City Manager shall have the right and he is hereby authorized, either directly or through the head of the office or denartment affected or involved, to employ such number of additional emi.-)Ioyees as in the opinion of such City Manager may be necessary in order to meet or property dispose of any and all conditions and oroblems which may arise out of or be due to any such emergency; together with full power in any and all such cases to fix the respective reasonable compensations to be -)aid such additional employees, respectively, for such emergency service. Such emergency service shall not continue, however, for a longer neriod than twenty,-one successive days unless by further authority of the City Council expressed by resolution. SECTION IA6.070. PREPARATION AND CONTENT OF CLASS SPECIFICATIONS. Class Specifications shall be ore-oared and maintained under the direction of the City Manager for all nositions. The S,)ecifications shall define the duties of the nositions in each class and the desirable quali- fications for successful performance of such duties. . 37 - SECTION IA6.080 TEMPORARY SERVICE IN HIGHER CLASSI- FICAT.ION. In any case where an employee is qualified for and is required for an appreciable p eriod of time to temporarily serve in and have the responsibility for work in a higher class or position, when anoroved by the City Manager, such employee while so assigned, shall receive the entrance salary rate of that class or whatever step thereof that is not less than five percent above his present rate, whichever is higher. For the .purpose of this section "appreciable period of time" is defined as thirty • consecutive working days or longer for department and division heads and ten consecutive working days or longer for all other classifications. SECTION IA6.090 PROMOTIONS. In all cases where, an employee in any given classification is promoted to a classification for which a higher rate of compensation is nrovided, then such employee so -)romoted shall enter such higher classification at the lowest rate of comnensation provided for such higher classification which exceeds by not less than five percent the rate of compensation received by said employee in such given classification at the time of such promotion, unless otherwise ordered by the City Council. All supervisors shall be paid at not less than the next higher rate than any of their subordinates, exclusive of soecial educational . incentive and longevity oay. In the event that a supervisor is paid a rate of --)ay equal to or lower than one of his regularly assigned sub- ordinates, the supervisor's rate shall be advanced to a stew in his salary range which is next higher than any subordinate's -)ay exclusive of Longevity pay, educational incentive and special •)ay. SECTION 1A6.100 TERMINATION PAY. Upon termination of employ- ment during a --)ay oeriod, oay shalt be prorated and ­,aid for each day worked in said -)ay neriod and the terminal salary warrant shall include accrued vacation -,)ay to the time of termination. - 38 - • I I - VIR SECTION IA6. 110 SICK LEAVE; LEAVE WITH PAY DUE TO ILLNESS; ACCUMULATION OF SAME. Sick leave with pay may be granted for an, absence from duty because of personal illness, injury, or legal quarantine not compensable under the provisions of the Workmen's Compensation Laws of the State of California. Permanent employees shall accumulate sick leave at the rate of one eight-hour day accumulation for each month's service not to exceed a maximum of 1056 hours, except Firemen assigned to fire suppression duty regulated by Chapter IA4. Hours worked in addition to a regular work week shall not entitle an employee to additional sick leave accumulation. Sick leave taken by an employee shall be deducted from his accumulated credit. SECTION 1A6.120 SICK LEAVE CERTIFICATION. Any employee taking sick leave shall, upon his return to work, sign a statement certifying the reasons for such sick leave. Employees absent five or onore consecutive working days, or four consecutive working days for employees assigned to four-day ten-hour working, schedule, must submit a statement from a doctor that the employee was under his care and is able to return to work. The City Manager may, before allowing such leave or before -permitting an employee to return to work., require submission of a doctor's certificate for any absence. Any employee who makes a false claim to Sick or emergency leave or who refuses tocooperate in an investigation by the City of his claim shall be subject to disciplinary action. SECTION IA6.130 SICK LEAVE--PAYMENT OF ONE-HALF ON ACCRUAL. On the first day of December of each year, employees who maintain a balance of 1056, Fire fighters assigned to fire suppression 1584 hours of sick leave accrual shall be paid for one-half the sick leave accumulated and not used during the preceding twelve month period. Payment shall be made on or before December 10. 0 - 39 - • SECTION IA6.140 SICK LEAVE ACCRUED-PAYMENT OF ON RETIREMENT. In the event an employee while in the City's employ retires under the Public Employees' Retirement System with unused sick leave to his or her credit he or she shall be compensated in an amount equal to one-half the value of such sick leave based upon his or her current salary at the time of retirement without the inclusion of overtime -pay or additional compensation. SECTION IA6.150 SICK LEAVE ACCRUED-PAYMENT OF ON DEATH. In the event an employee,, while in the City's employ, dies with unused sick Leave to his credit, his or her estate shall be comoensated in an amount equal to one half the value of such sick leave based upon his or her current salary at the time of his or her death without the inclusion of overtime p -1y or additional compensation. SECTION IA6.160 EMERGENCY LEAVE-FAMILY ILLNESS. Accumulated sick leave may be used as emergency leave for short periods in case of serious illness in the immediate family of the emoloyee or employee's spouse. A maximum of three days emergency leave may be granted in case of death in the immediate family of the employee or employee's spouse. A doctor's certificate stating the nature of the illness of the immediate family of the employee or employee's spouse, or goof of death, maybe required before absence for these reasons shalt be charged to emergency leave. Emergency leave of a maximum of three days may also be granted in cases of extreme and unusual hardshios of an emergency nature. For the purpose of this section immediate family means soouse, child, mother, father or sibling. SECTION 1A6.170 WORKMEN'S COMPENSATION PROVISIONS. Permanent employees who are members of the oublic Em,)toyees Retirement System and who receive injuries that are comnensabte under the California Workmen's Compensation Laws (other than those to whom the )rovisions of Section 4850 of the labor Code apply) shalt be entitled to receive: 0 - 40 - 1. The employee's regular salary for any so-called waiting period nrovided for in the Workmen's Compensation Laws. 2. Thereafter, the period of up to one year or until earlier retirement on disability oension, the difference between the employee's regular monthly salary and the amount of any temporary disability payments. Such payments shall cease when the employee receives a permanent disability award or is physically able to return to work. SECTION IA6.180' WORKMEN'S COMPENSATION PAYMENTS RECEIVED. The City Manager in oreparing demands for compensation under the provisions of the workmen's Compensation Laws of the State of California may require the employee concerned to submit to said City Manager, evidence satisfactory to such City Manager showing the amount of Workmen's Compensation payments received by such emoloyee (exclusive of medical, surgical, hospitalization, appliances, or similar items of costs.) In many instances it may be impossible prior to the time 1-)ayrolls are regularly approved to determine various amounts which may here- after become oayable under the orovisions of the Workmen's Com-)ansation laws of the State of California to various employees due to a variety of reasons and causes, such for example, as delays which may occur in the fixing of compensation amounts in Industrial Accident cases; the failure of the employee to monthly or oromptty receive his Workmen's Compensation allowances etc. In all such cases, the City shalt be under no obligation to make to the employee the oayments orovided for in said Workmen's Compensation laws until such time as such matters can be properly determined. The City Manager may present to the City Council any and all problems which may arise in the Administration of the )rovisions hereof, and the City Council reserves the right to consider such problems and to determine the same and make such adjustments and orders as may be neces- 0 sary and oroper in the oremises. _ 41 - • I 1 (1; 4", SECTIONIA6.190 PHYSICAL EXAMINATIONS. The City Council reserves the right, to be excercised in its discretion to, at any time and from time to time at the expense of said City, require any employee to appear before any duty Licensed t)hysician or surgeon selected by the City Manager and submit to a medical and physical examination with respect to his illness, injury or disability. The failure or refusal of any such employee to submit himself to any such examination, may, in the discretion of the said Council, forfeit any further rights to receive sick leave disability benefits or compensation under the orovisions of this reso lution. SECTION IA6.200 PHYSICAL EXAMINATION -- WRITTEN REPORT. The written report of any such physician or surgeon to said Council may be examined by said Council, the City Manager, and City Attorney of said City but shall otherwise be confidential, provided, however, that the same may be introduced in evidence in any action or proceeding relative to the subject of illness, injury or disability of the oatient or person referred to therein and such physician or surgeon may give testimony respecting the subject of such examination and -the physical condition of the employee therein referred to, and each emoloyee of said City accepting employment, by accepting such employment and rendering service thereunder, does thereby automatically and accordingly so agree. SECTION IA6.210 VACATION TIME ACCRUAL - - VACATION LEAVE AFTER ONE YEAR'S SERVICE. Each officer and employee regularly employed shall accrue vacation time on a monthly basis. Vacation leaves may be taken only after an employee has completed one year's continuous service with the City. SECTION IA6.220 VACATION TIME ACCUMULATED. Vacation time shall be accumulated from date of last continuous permanent employment. All vacations shall be taken at such times as are agreeable - 42- • to the head of the dpeartment and approved by the City Manager. Earned vacations shall not be accumulated for a longer period than for two years, service. SECTION 1A6.230 JURY SERVICE. Employees absent for jury service with the approval of their Department Heads., shall be entitled to, and receive., full salary upon showing absence .occurring by reason thereof, and paying to the City the amount of jury fees received by them for such absence. SECTION 1A6.240 ACCEPTANCE OF GRATUITIES. Officers and employees of the City are enjoined against accepting any form of gratuity from any person with whom they are transacting or have transacted city business on behalf of the City of El Segundo. By this, all personnel are admonished not to accept anything of value, where such transfer of value can be construed as a favor or as an inducement in any manner affecting their decisions in the discharging of city business. SECTIONIA6.250 ANNUAL SALARY SCALE REPORT. The City Council in its desire to maintain a salary experience comparable to that paid by other cities has determined that as a matter of policy it will give careful consideration to the wages paid in the following cities. Culver City Los Angeles Gardena Manhattan Beach Hawthorne Redondo Beach Hermosa Beach Santa Monica Inglewood Torrance and Los Angeles County A comprehensive report setting forth the scale of wages paid by the above-named cities together with a detailed report of all fringe benefits shall be prepared and submitted to the Council members prior to August I of each year. - 43 - • • i I S44 The City Council will review the wage scale of this City at the first meeting next following its receipt by its members of such report. SECTION 1A6.260 MILEAGE REIMBURSEMENT. Officers and employees of the City shall be entitled to reimbursement for City authorized use of their privately owned vehicles in the conduct of city business at the rate of fifteen cents per mile. SECTION IA6.270 PHYSICAL EXAMINATION REQUIREMENTS. Police Officers and Fire Fighters, Sanitation De-nartment em-oloyees, and Department Heads shall be annually examined by a local medical doctor selected by the City, except Police Officers and Fire Fighters under thirty-five years of age, who shall be examined every two years. Additional examinations of these employees as well as of all other employees of the City may be ordered by the City Manager and the medical reports thereof shall become part of the employees personnel records. SECTION IA6.280 OVERTIME PAY - EXCEPTIONS, Only regular salary rates shall be paid in emergencies pertaining to war, civil defense, strike patrol duty, after the first forty-eight hours thereof, flood earthquake, fire or other similar conditions of urgency. SECTION 1A.6.290 FAIR LABOR STANDARDS ACT. APPLICABILITY. Notwithstanding any other provisions in this Title, if the United States Supreme Court holds that the Fair Labor Standards Act is applicable to cities, its provisions will be applied from and after the date that the court fixes for such application or January 1, 1975 whichever date is later. SECTION 2. Resolution No. 2522 passed and adopted on the 5th day of February, 1974, and Resolutions Nos. 2 52 7, 2532, 2566, 2567, 2568, 2573., 2597 and 2606 amending said Resolution No. 2522 and all resolutions and orders of the City Council heretofore passed and adopted with reference to the same, or any of the matters and subjects hereinabove set forth or referred to, are hereby repealed insofar as the same conflict with the provisions hereof. SECTION 3. The City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of original resolutions of said city; and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said city, in the minutes of the meeting a which ��hzcn the same is passed and adopted.
