CC RESOLUTION 2613RESOLUTION NOo 2613 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, AUTHORIZING THE CITY OF SANTA MONICA TO REPRESENT THE CITY OF EL SEGUNDO BEFORE THE SUPREME COURT OF THE STATE OF CALIFORNIA IN SERRANO -VS- PRIEST. WHEREAS,, the California Supreme Court has previously invali- dated the method of financing the public school system; and WHEREAS, the decisionof the California Supreme Court in the case of Serrano -vs- Priest will cause a burden upon local city governments and the citizens thereof who are property owners; and WHEREAS, said decision will also deny to local communities con- trol over local public school systems; and WHEREAS, the California Supreme Court is reconsidering said decision; and WHEREAS, the City of Santa Monica intends to file an amicus curaie brief before the Supreme Court; and WHEREAS, because the problems for local communities raised by the Serrano -vs- Priest decision affect the City of El Segundo in the same manner as the City of Santa Monica; and WHEREAS, the City of Et Segundo desires to Participate with the City of Santa Monica in the amicus brief to be filed; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SEGUNDO., CALIFORNIA, DOES RESOLVE AS FOLLOWS: SECTION I. The City Council of the City of Et Segundo hereby authorizes the City of Santa Monica, by and through the office of the City Attorney of the City of Santa Monica, Richard L. Knickerbocker, City Attorney of Santa Monica, his deputies and assistants, to represent the City of El Segundo before the Supreme Court of the State of California through the filing of an amicus brief in the case of Serrano -vs- Priest and through the making of such oral arguments as the Santa Monica City Attorney deems appropriate in the premises and as are permitted.. Said City Attorney of Santa Monica is hereby- expressly authorized to take any and all action before the California Supreme Court in the 1:0 case of Serrano -vs- Priest as he may deem appropriate to protect the in- terests of the Cities of El Segundo and Santa Monica, SECTION 2,, That the City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of original resolu- tions of said City; and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said City-, in the minutes of the meeting at which the same is passed and adopted.
