CC RESOLUTION 25731.1675 RESOLUTION NO. 2573 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, PROVIDING CERTAIN ADJUSTMENTS IN SALARIES AND OTHER CONDITIONS OF EMPLOYMENT FOR CERTAIN EMPLOYEES OF THE CITY. WHEREAS, representatives of the E1 Segundo City Council and representatives of the E1 Segundo City Employees' Association met and conferred in good faith under the terms of Sections 3500 -3510 of the California Government Code; and WHEREAS, the representatives reached agreement and signed a Memorandum of Understanding on June 19, 1974; and WHEREAS, said Memorandum of Understanding was rejected by the E1 Segundo City Employees' Association; and WHEREAS, the representatives subsequently met and con- ferred on July 12, 1974 and agreed to modifications to the June 19, 1974 Memorandum of Understanding; and WHEREAS, the Board of Directors of the E1 Segundo City Employees' Association is purported to have rejected the subject modifications; and WHEREAS, the City Council desires to implement certain changes in salaries and benefits for employees represented by the E1 Segundo Employees' Association; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES RESOLVE AS FOLLOWS: SECTION 1. Notwithstanding the provisions of Resolution No. 2522, as amended, on and after July 6, 1974, each employee to whom this Section is applicable shall be compensated at a rate of 9. 7 percent higher than the rate shown in said Resolution No. 2522. This Section shall be applicable to all permanent full time employees of the City except: (1) Employees of the Police Department to whom Resolution No. 2566 is applicable; 1.1676 (2) Employees of the Fire Department to whom Resolution No. 2567 is applicable; (3) Employees of the City categorized as Management and Confidential employees to whom Resolution No. 2568 is applicable; (4) The City Clerk; (5) The City Treasurer; (6) The City Manager; (7) The City Attorney. SECTION 2. The provisions of Sections 3 through 6 of this Resolution shall be applicable to all permanent full time employees of the City except: (1) Employees of the Police Department to whom Resolution No. 2566 is applicable; (2) Employees of the Fire Department to whom Resolution No. 2567 is applicable; (3) Employees of the City categorized as Management and Confidential employees to whom Resolution No. 2568 is applicable; (4) The City Clerk; (5) The City Treasurer; (6) The City Manager; (7) The City Attorney. SECTION 3. Notwithstanding the provisions of Resolution No. 2522, as amended, on and after July 6, 1974, all permanent employees who are entitled to receive overtime pay shall be entitled to be off for all City holidays; or if they are required to work upon a City holiday, shall be entitled to time and one -half for such work. SECTION 4. Notwithstanding the provisions of Resolution No. 2522, as amended, employees hired after July 16, 1974, will not be eligible for longevity pay. SECTION 5. Notwithstanding the provisions of Resolution No. 2522, as amended, on and after July 6, 1974, when an employee is on temporary industrial disability, such employee may accrue vacation -2- .1 l F 7'7 without limitation upon the maximum vacation accrual contained in Resolution No. 2522. SECTION 6. Except as provided in Section 3 of this Resolution and notwithstanding the provisions of Resolution No. 2522, as amended, on and after July 6, 1974, employees not exempt under the Fair Labor Standards Act as amended shall be paid at the rate of time and one -half their regular base rate of pay for all hours worked in excess of eight (8) hours per day or forty (40) hours per week. Time not worked while on vacation, holiday, sick time or other leave shall not be deemed time worked for purposes of overtime compensation hereunder. SECTION 7. The provisions of this Resolution shall be applicable to employees of the Library not subject to Resolution No. 2568, subject to confirmation by the Library Board at its next regular meeting. SECTION 8. The City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of original resolutions of said city; and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said city, in the minutes of the meeting at which the same is passed and adopted.
