CC RESOLUTION 2551RESOLUTION NO. 2 551 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, ORDERING, CALLING, PROVIDING FOR AND GIVING NOTICE OF A SPECIAL MUNICIPAL ELECTION TO BE HELD IN SAID CITY ON AUGUST 20, 1974 FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED VOTERS OF SAID CITY AN ORDINANCE AMEND- ING TITLE 20 (THE COMPREHENSIVE ZONING ORDINANCE) OF THE "EL SEGUNDO MUNICIPAL CODE" BY AMENDING THE ZONING MAP REFER- RED TO IN SECTION 20.16. 030 OF SAID CODE, AND REPEALING ORDINANCE NO. 820 (MOSAIC TILE COMPANY) WHEREAS, the City Council of the City of E1 Segundo, California, did, on the 2nd day of April, 1974, adopt Ordinance No. 839 providing for the rezoning of Lot 1, Tract No. 2801, as per map recorded in Book 28, Page 3 of Maps in the office of the County Recorder of Los Angeles County, from M -1 (Light Manufacturing) Zone to PRD (Planned Residential Development) Zone, and repealing Ordinance No. 820, entitled: law; and "AN ORDINANCE OF THE CITY OF EL SEGUNDO, CALIFORNIA, EXTENDING A PROHIBITION ON CONSTRUCTION WITHIN CERTAIN STUDY AREAS HEREIN DESCRIBED. ", and WHEREAS, the said Ordinance was duly published as required by WHEREAS, pursuant to authority provided by statute a petition has been filed with the legislative body of the City of E1 Segundo signed by the requisite number of voters, and the City Clerk has so certified; and WHEREAS, the City Council of the City of E1 Segundo has not voted in favor of the repeal of the Ordinance; and WHEREAS, the City Council of the City of E1 Segundo is thereupon authorized and directed by statute to submit the Ordinance to the qualified voters; NOW, THEREFORE, the City Council of the City of E1 Segundo, California, DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER as follows: SECTION ONE. That a special election be held and the same is hereby called to be held in said city on August 20, 1974 for the purpose of submitting to the qualified voters of said city an ordinance hereinafter set forth relating to reclassifying and rezoning from the M -1 (Light Manufacturing) Zone to the PRD (Planned Residential Development) Zone the following described real property located in the City of E1 Segundo, County of Los Angeles, State of California, to wit: Lot 1, Tract No. 2801, as per map recorded in Book 28, Page 3 of Maps in the office of the County Recorder of Los Angeles County, and repealing Ordinance No. 820, entitled: "AN ORDINANCE OF THE CITY OF EL SEGUNDO, CALIFORNIA, EXTENDING A PROHIBITION ON CONSTRUCTION WITHIN CERTAIN STUDY AREAS HEREIN DESCRIBED. " SECTION TWO. That the ordinance submitted to the voters shall be as follows: "ORDINANCE NO. "AN ORDINANCE OF THE CITY OF EL SEGUNDO, CALIFORNIA, AMENDING TITLE 20 (THE COM- PREHENSIVE ZONING ORDINANCE) OF THE 'EL SEGUNDO MUNICIPAL CODE' BY AMEND- ING THE ZONING MAP REFERRED TO IN SEC- TION 20.16. 030 OF SAID CODE; AND REPEAL- ING ORDINANCE NO. 820 (MOSAIC TILE COM- PANY) "THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES ORDAIN AS FOLLOWS: "SECTION 1. That Title 20 (The Comprehensive Zoning Ordi- nance) of the 'E1 Segundo Municipal Code,' and in particular the 'Zoning Map of the City of E1 Segundo' on file in the Planning Department, be and the same is hereby amended by reclassifying and rezoning to PRD (Planned Residential Development) Zone, in the manner hereinafter set forth, the follow- ing described real property located within the City of El Segundo, County of Los Angeles, State of California, to wit: Lot 1, Tract No. 2801, as per map recorded in Book 28, Page 3 of Maps in the office of the County Recorder of Los Angeles County, from M -1 (Light Manufacturing) Zone to PRD (Planned Residential Development) Zone. "SECTION 2. That Ordinance No. 820, entitled: -2- 'AN ORDINANCE OF THE CITY OF EL SEGUNDO, CALIFORNIA, EXTENDING A PROHIBITION ON CONSTRUCTION WITHIN CERTAIN STUDY AREAS HEREIN DESCRIBED.', adopted October 16, 1973, is hereby repealed. "SECTION 3. This ordinance shall become effective at mid- night on the thirtieth day from and after the date of the final passage and adoption thereof. "SECTION 4. The City Clerk shall certify to the passage and adoption of this ordinance; shall cause the same to be entered in the book of original ordinances of said city; shall make a minute of the passage and adoption thereof in the records of the meeting at which the same is passed and adopted; and shall, within fifteen days after the passage and adoption thereof, cause the same to be published once in the El Segundo Herald, a weekly newspaper of general circulation, published and circulated within said City of El Segundo, and which is hereby designated for that purpose. " SECTION THREE. That the polls for said election shall be opened at seven o'clock A. M. of the day of said election and shall remain open continu- ously from said time until seven o'clock P. M. of the same day, when said polls shall be closed, except as provided in Section 14436 of the Elections Code of the State of California. SECTION FOUR. That on the ballots to be used at said special election, in addition to any other matters required by law, there shall be printed substantially the following: PROPOSITION 2. Shall Ordinance No. 839 changing YES the zoning of parcels of land identified as Lot 1 of Tract 2801 (438 Sheldon Street) (Sometimes referred to as the Mosaic Tile Company property) from M -1 (Light Manu- facturing) to PRD (Planned Residential Development) NO Zone be adopted? SECTION FIVE. That a cross ( -L ) placed in the voting square after the word "YES" in the manner hereinbefore provided shall be counted in favor of the adoption of the proposition. A cross ( -�- ) placed in the voting square after the word "NO" in the manner hereinbefore provided shall be counted against the -3- 11630 adoption of the proposition. SECTION SIX. That notice of the time and place of holding said election is hereby given and the City Clerk is hereby authorized, instructed and directed to give such further or additional notice of said election in time, form and manner as required by law. SECTION SEVEN. That the City Clerk shall certify to the passage and adoption of this resolution, shall enter the same in the book of original resolu- tions of said city, and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said city in the minutes of the meeting at which the same is passed and adopted. SECTION EIGHT. That this Resolution shall take effect immediately. PASSED, APPROVED and ADOPTED this 3rd day of , 1974.
