CC RESOLUTION 2550I i ii213 RESOLUTION NO. 2550 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, ORDERING SUBMITTED TO THE QUALIFIED VOTERS AT A SPECIAL MUNICIPAL ELECTION TO BE HELD TUESDAY THE 20TH DAY OF AUGUST 1974 A CER- TAIN INITIATIVE ORDINANCE AUTHORIZING AN INCREASE IN TAXES FOR THE PURPOSE OF ACQUIRING CERTAIN REAL PROPERTY. WHEREAS, pursuant to the authority provided by Law the City Council of the City of E1 Segundo desires to submit to the qualified voters of the city a measure relating to the property tax rate in the form of the initiative ordinance hereinafter proposed; and WHEREAS, the City Council of the City of E1 Segundo, California, is authorized under the provisions of Section 4019 of the Elections Code of the State of California, to submit to the voters of said City, without a petition therefore, a proposition for the enactment of the new ordinance hereinafter referred to, to be voted upon at any succeeding regular or special City elec- tion; and WHEREAS, said Council, after due consideration, feels that it should exercise its said authority and should, on its own motion, submit to the voters of said City, a proposition for the enactment of said new ordinance hereinafter referred to; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: SECTION ONE. That at a Special Municipal Election to be held in the City of E1 Segundo, County of Los Angeles, State of California, on the 20th day of August 1974 and is hereby ordered submitted to the qualified voters of said city a certain initiative ordinance set forth in Section Two hereof. SECTION TWO. That said inititative ordinance that is to be sub- mitted to said voters shall be and read as follows: 1 16 *.0 "ORDINANCE NO. "AN ORDINANCE OF THE CITY OF EL SEGUNDO, CALIFORNIA, AUTHORIZING THE LEVY OF AN ADDITIONAL TAX OF TWENTY -EIGHT CENTS PER ONE HUNDRED DOLLARS OF ASSESSED VALUATION FOR THE 1974 -75 FISCAL YEAR AND TWENTY -EIGHT CENTS PER ONE HUNDRED DOLLARS OF ASSESSED VALUATION FOR THE 1975 -76 FISCAL YEAR AND PROVIDING THAT SAID FUNDS MAY BE USED ONLY FOR THE PURPOSE OF ACQUIRING, CLEARING, DEVELOPING, IMPROV- ING'AND MAINTAINING CERTAIN REAL PROPERTY. "THE PEOPLE OF THE CITY OF EL SEGUNDO, CALIFORNIA, DO ORDAIN AS FOLLOWS: "SECTION 1. The City Council shall be authorized to levy a prop- erty tax on each One Hundred Dollars of assessed valuation over, above, and in excess of any tax otherwise authorized by law in an amount not to exceed twenty -eight cents for each One Hundred Dollars of assessed valuation for the fiscal year 1974 -75 and in an amount not to exceed twenty -eight cents for each One Hundred Dollars of assessed valuation for the fiscal year 1975 -76. "SECTION 2. The funds raised by the tax levied pursuant to the authority of Section 1 of this ordinance shall be placed in a Special Fund which fund may be used only for the purpose of acquiring, clearing, developing, im- proving and maintaining Lot 1, Tract No. 2801, as per map recorded in Book 28, Page 3 of Maps in the office of the County Recorder of Los Angeles County; and that portion of Lot D, E1 Segundo Sheet 7, as per map recorded in Book 22, pages 54 and 55 of Maps in the office of the County Recorder of Los Angeles County, lying between the easterly line of Sheldon Street (50 feet wide) and the southerly line of Pine Avenue (50 feet wide) as shown on said map; and for the purpose of repaying other funds any sums advanced after the effective date of this ordinance for the purpose of acquiring, clearing, developing, improving and maintaining Lot 1, Tract No. 2801, as per map recorded in Book 28, Page 3 of Maps in the office of the County Recorder of Los Angeles County and that portion of Lot D, El Segundo Sheet 7, as per map recorded in Book 22, Pages 54 and 55 of Maps in the office of the County Recorder of Los Angeles County, lying between the easterly line of Sheldon Street (50 feet wide) and the southerly line of Pine Avenue (50 feet wide) as shown on said map. YM 1 i 1_02)J "SECTION 3. That the Mayor of said City shall sign this ordinance and the City Clerk shall attest the same. Said City Clerk shall further certify to the passage and adoption thereof by the electors of said municipal corpor- ation; shall enter the same in the book of original ordinances of said City; shall make a minute of such passage and adoption thereof by the electors of said City, in the official records of the proceedings of the City Council of said City; and shall, after such adoption, cause this ordinance to be published once in the E1 Segundo Herald, a weekly newspaper of general circulation, published and circulated within said City and which is hereby designated for that purpose. "PASSED, APPROVED and ADOPTED by the people of the City of E1 Segundo, California, at the Special Municipal Election held in the City on Tuesday, the 20th day of August, 1974. For the purpose of submitting the enactment of said ordinance hereinabove referred to, there shall appear upon the ballots to be used at said election, in addition to any other matters required by law to appear thereon, the following question, proposition or measure to wit: PROPOSITION 1. Shall the City Council be authorized to levy a property tax of not to exceed twenty -eight cents on each one hundred dollars of assessed valua- YES tion for the fiscal year 1974 -75 and not to exceed twenty- . eight cents on each one hundred dollars of assessed _ valuation for the fiscal year 1975 -76 over, above and in excess of the tax otherwise authorized by law for the purpose of acquiring, clearing, developing, im- NO proving and maintaining certain property located at 438 Sheldon Street and adjacent railroad right -of -way? SECTION FOUR. That a cross (-�-) placed in the voting square after the word "YES" in the manner hereinbefore provided shall be counted in favor of the adoption of the proposition. A cross (-�—) placed in the voting square after the word "NO" in the manner hereinbefore provided shall be counted against the adoption of the proposition. -3- SECTION FIVE. That the City Clerk be and she is hereby authorized and instructed to give notice of said Special Election in time, form and manner as required by law, and to procure any and all supplies, materials, printed matter and equipment which may be necessary or convenient on the part of said City in order to properly and lawfully conduct said election. SECTION SIX. That this resolution shall take effect immediately. SECTION SEVEN. The City Clerk shall prepare a synopsis of the measure in the time, form and manner required by taw. SECTION EIGHT. That the City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of resolutions of said city, and shall make a minute of the adoption thereof in the records of the proceedings of the City Council of said city in the minutes of the meeting at which the same is passed and adopted.
