CC RESOLUTION 253611585 RESOLUTION NO. 2 �3r, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, ORDERING THE VACATION OF A CERTAIN PORTION OF DULEY ROAD WITHIN SAID CITY AS CONTEM- PLATED BY RESOLUTION OF INTENTION NO. 2534. The City Council of the City of E1 Segundo, California, pur- suant to the provisions of the "Street Vacation Act of 1941, " being Part 3 of Division 9 of the Streets and Highways Code of the State of California, does hereby resolve, declare, find, determine and order as follows: SECTION 1. Said City Council after public hearing duly and regularly called, noticed and held, finds and determines from all the evi- dence submitted, that that certain portion of Duley Road within said city described in Resolution of Intention No. 2534 of said Council adopted on the 16th day of April, 1974, is unnecessary for present or prospective public street purposes. SECTION 2. That the public interest and convenience require, and it is hereby ordered, subject to the reservations and exceptions herein- after set forth, that the following portion of the following public street with- in the city, to wit: That portion of the southeast quarter of Section 7, Township 3 South, Range 14 West, in the Rancho Sausal Redondo, in the City of E1 Segundo, County of Los Angeles, State of California, as per map recorded in Book 1, Pages 507 and 508 of Patents in the office -)f the County Recorder of said County, described as follows: BEGINNING at a point in the South line of said Section 7, dis- tant thereon South 890 55' 25" East 3262.82 feet from the south- west corner of said Section 7, said point also lying in the south- erly prolongation of the westerly line of Duley Road (40 feet wide); THENCE North 0° 00' 23" West 50 feet along said southerly pro- longation to a point in the northerly line of El Segundo Boulevard (100 feet wide), said point being the TRUE POINT OF BEGINNING for this description; THENCE continuing North 01 00' 23" West along said westerly line of Duley Road a distance of 1156 feet to a point in a line parallel with and 33 feet southerly measured at right angles from the easterly prolongation of the center line of Grand Avenue (66 feet wide) as shown on Parcel Map No. 2622 recorded in Book 35, Page 89 of Parcel Maps, Los Angeles County, California; THENCE South 89° 55' 25" East a distance of 40 feet to a point in the easterly line of said Duley Road; THENCE South 0° 00' 23" East along said easterly line of Duley Road a distance of 1156 feet to a point in the said northerly line of E1 Segundo Boulevard; THENCE North 890 55' 25" West along said northerly line of E1 Segundo Boulevard a distance of 40 feet to the point of beginning, I 1 586 be, and the same, is hereby closed, vacated and abandoned for public str eet purposes, all as contemplated by Resolution of Intention No. 2534 of the City Council of the City of E1 Segundo, California, adopted on the 16th day of April, 1974. Reference is hereby made to said Resolution of Intention No. 2534 and to the map or plan entitled, "PORTION OF DULEY ROAD PROPOSED TO BE VACATED BY RESOLUTION OF INTENTION NO. 2534, " referred to therein, both of which are on file and open to public inspection in the office of the City Clerk in the City Hall of said City, and both of which, by this reference, are incorporated herein and made a part hereof for further particulars. SECTION 3. The City Council does hereby determine that the pub- lic convenience and necessity require the reservation of the easements and rights of way for structures enumerated in Section 8330 of the Streets and High- ways Code of the State of California, and these proceedings are taken, subject to such reservations and exceptions. The easements and rights of way hereby reserved and excepted from the vacation are the following, to wit: The permanent easement and right at any time, or from time to time, to construct, maintain, operate, replace, remove, and re- new sanitary sewers and storm drains and appurtenant structures in, upon, over and across any street or part thereof proposed to be vacated and pursuant to any existing franchises or renewals thereof, or otherwise, to construct, maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits, cables, wires, poles, and other convenient structures, equipment and fixtures for the operation of gas pipe lines, telegraphic and telephone lines, and for the transportation or distribution of electric engergy, water, and incidental purposes, including access and the right to keep the property free from inflammable materials, and wood growth, and otherwise protect the same from all hazards in, upon and over the street or part thereof proposed to be vacated. SECTION 4. That the City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of original reso- -2- 1 1.5 R i tions of said city shall make a minute of the passage and adoption thereof in the records and proceedings of the City Council of said city in the minutes of the meeting at which the same is passed and adopted; and shall cause a certi- fied copy thereof, attested by the City Clerk under the seal of said city, to be recorded in the office of the County Recorder of Los Angeles County, State of California.
