CC RESOLUTION 2534l 1 18l RESOLUTION OF INTENTION NO. 2534 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DECLARING ITS IN- TENTION TO ORDER THE VACATION AND ABANDON- MENT (SUBJECT TO THE RESERVATION AND EXCEP- TION OF CERTAIN EASEMENTS AND RIGHTS OF WAY) OF A CERTAIN PORTION OF DULEY ROAD WITHIN SAID CITY. The City Council of the City of E1 Segundo, California, pursuant to the provisions of the "Street Vacation Act of 1941, " being Part 3 of Divi- sion 9 of the Streets and Highways Code of the State of California, does here- by resolve, declare, determine and order as follows: SECTION 1. That it is the intention of the City Council of the City of E1 Segundo, California, to order the vacation and abandonment (sub- ject to the reservation and exception of easements and rights of way as here- inafter set forth) of a certain portion of Duley Road, within said City, which is more particularly described as follows: That portion of the southeast quarter of Section 7, Township 3 South, Range 14 West, in the Rancho Sausal Redondo, in the City of El Segundo, County of Los Angeles, State of California, as per map recorded in Book 1, Pages 507 and 508 of Patents in the office of the County Recorder of said County, described as follows: BEGINNING at a point in the South line of said Section 7, distant thereon South 89° 55' 25" East 3262. 82 feet from the southwest corner of said Section 7, said point also lying in the southerly prolongation of the westerly line of Duley Road (40 feet wide); THENCE North 0° 00' 23" West 50 feet along said southerly prolongation to a point in the northerly line of E1 Segundo Boulevard (100 feet wide), said point being the TRUE POINT OF BEGINNING for this description; THENCE continuing North 01 00' 23" West along said westerly line of Duley Road a distance of 1156 feet to a point in a line parallel with and 33 feet southerly measured at right angles from the easterly pro- longation of the center line of Grand Avenue (66 feet wide) as shown on Parcel Map No. 2622 recorded in Book 35, Page 89 of Parcel Maps, Los Angeles County, California; THENCE South 89° 55' 25" East a distance of 40 feet to a point in the easterly line of said Duley Road; THENCE South 0° 00' 23" East along said easterly line of Duley Road a distance of 1156 feet to a point in the said northerly line of E1 Segundo Boulevard; THENCE North 89° 55' 25" West along said northerly line of El Segundo Boulevard a distance of 40 feet to the point of beginning. For further particulars as to the proposed vacation of said portion of Duley Road, reference is hereby made to map, entitled "PORTION OF DULEY ROAD PROPOSED TO BE VACATED BY RESOLUTION OF INTEN- TION NO. 2534 , if on file and open to public inspection in the office of the City Clerk of the City of El Segundo, California, in the City Hall of said city. SECTION 2. The City Council does hereby determine that the public convenience and necessity require the reservation of certain easements and rights of way for structures enumerated in Section 8330 of the Streets and Highways Code of the State of California, and these proceedings are taken, sub- ject to such reservations and exceptions. The easements and rights of way hereby reserved and excepted from the vacation are the following, to wit: The permanent easement and right at any time, or from time to time, to construct, maintain, operate, replace, remove, and renew sanitary sewers and storm drains and appurtenant structures in, upon, over and across any street or part thereof proposed to be vacated and pursuant to any existing franchises or renewals thereof, or otherwise, to construct, maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits, cables, wires, poles, and other convenient structures, equipment and fixtures for the operation of gas pipe lines, telegraphic and telephone lines, and for the transportation or distribution of electric energy, water, and incidental purposes, including access and the right to keep the property free from inflammable materials, and wood growth, and otherwise protect the same from all hazards in, upon and over the street or part thereof proposed to be vacated. SECTION 3. That the hour of 7:00 P.M., on Tuesday, May 7, 1974, in the Council Chamber in the City Hall, 350 Main Street, in said city, be and the same is hereby fixed as the time and place when and where any and all persons interested in or objecting to the proposed vacation of said portion of said public street may appear before said City Council and be heard and offer testimony and submit evidence in relation thereto. SECTION 4. That the Superintendent of Streets of the City of -2- 11583 E1 Segundo, California, be and he is hereby directed to cause "NOTICE OF STREET VACATION AND OF PUBLIC HEARING THEREON, " to be posted as required by the said Street Vacation Act of 1941, being Part 3 of Division 9 of the Streets and Highways Code of the State of California; and the City Council of said city hereby elects to proceed under the provisions of said Act. SECTION 5. That the City Clerk shall certify to the passage and adoption of this resolution, and shall cause the same to be published once in the E1 Segundo Herald, a weekly newspaper of general circulation, published and circulated in said city and hereby designated for that purpose by the said City Council.
